Members of the Planning and Zoning Commission present: Chairman, Joe Patterson Commissioner Charles Beck Commissioner John Bingham Commissioner Bronson Blackson Commissioner Bill Glancy Commissioner David Honnoll Commissioner Debbie King Commissioner Jason O'Quinn Members of the Planning and Zoning Commission not present: Commissioner Bob Baxter Commissioner Matt Burton Vice Chairman, Nancy Hardie Members of City Staff present: Andy Gillies, Director of Planning Jim Sellards, Planning Analyst Stacy Henderson, Recording Secretary Chairman Patterson called the meeting to order at 7:02 p.m. A.1 Consider approval of the minutes of the June 23, 2008 Planning and Zoning Commission meeting and take appropriate action. Chairman Patterson asked the Commission if they had any changes or corrections to the minutes of June 9, 2008. Mr. Glancy stated on page 3, paragraph 2, the statement he made should read he cited a particular location where an aboveground storage tank was placed on Valley View Lane that could have been placed below ground and been less obtrusive to the area." A motion was made by Commissioner O'Quinn and seconded by Commissioner Honnoll to approve the minutes as corrected. The motion carried unanimously. C.1 Public Hearing: Consider the request of 7-Eleven, Inc./CDS Development for a specific use permit for a gasoline fueling station and convenience store at 12103 Webb Chapel Road within the Local Retail-2 zoning district and take appropriate action. Chairman Patterson opened the public hearing and read the following information into the record. The applicant is proposing to demolish the existing Shell service station at the northwest corner of Webb Chapel Road and LBJ Freeway and replace it with a new Shell gasoline fueling station and 7-Eleven convenience store. No vehicle repair service or car wash is proposed. The existing Shell service station is zoned Local Retail 2 (LR-2). This zoning district requires a Specific Use Permit for a gasoline station. The existing station operates under the requirements of a Specific Use Permit approved in 1968. The extensive redevelopment of the site requires review and approval of a new Specific Use Permit and Site Plan The proposed new development will include a new one-story, convenience store building containing 3,010 square feet and a new gas canopy containing 8 fueling pumps. There are three existing entry drives to the property, two along Webb Chapel Road and one along LBJ Freeway. The new site plan proposes the closure of the southernmost entry from Webb Chapel Road. Extensive landscaping, sidewalk and signage improvements are also included in the proposal. Only one freestanding sign is allowed per property in the LR-2 zoning district under current sign regulations. There are two freestanding signs in the proposed on the new site plan, therefore as a condition of this Specific Use Permit and Associated Site Plan the applicant must obtain a variance from the Zoning Board of Adjustment for the second free-standing sign proposed along Webb Chapel Road. Staff recommends approval of the proposed Specific Use Permit and Associated Site Plan with the following condition. 1. The applicant must obtain a variance for the second freestanding sign proposed along Webb Chapel Road before a sign permit is issued for the additional freestanding sign. Jim Sellards, Planning Analyst, presented a summary of the proposal for the Specific Use Permit for the Shell/7-Eleven facility, stating that: The existing Shell service station will be demolished and replaced with a new 3,010 square-foot 7-Eleven convenience store building, a new 1,800 square-foot (8-pump), Shell gasoline-fueling canopy, and new concrete drives and parking areas. A new masonry enclosure for the dumpster will be built on the on the south side of the new convenience store building. A new sidewalk will be built along Webb Chapel Road. 2 • The existing southeast entry drive on Webb Chapel Road will be closed. • Approximately 20% of the new facility will be landscaped with new trees, shrubs, flowers and turf. • The existing free-standing 50 foot pylon sign at the southwest corner of the property will be reduced to 46 feet and contain logos for Shell and 7-Eleven. • The existing freestanding sign at the southeast corner will be demolished and a new 8- foot-square logo and pricing monument sign will be placed at the northeast corner. Chairman Patterson asked if anyone in the audience or any of the Commissioners had any questions. Commissioner Glancy asked about the widths of the travel lanes on either side of the fueling canopy. Ms. Reid responded that the driveway would be 28' wide between the convenience store parking area and the canopy and 24' between the canopy and Webb Chapel Road. Planning Director Andy Gillies responded that staff and the applicant had looked at different configurations for the pumps, trying to maximize the distance between the front-loaded parking and the fueling canopy and that this configuration was the best design that allowed 8 fueling stations. Ms. Reid also responded that the total distance between the building's sidewalk and the canopy will be the total of 46 feet. Commissioner Blackson asked how the number of pumps for the facility was determined. Ms. Reid stated the proposed number of pumps was determined by 7-Eleven's formulary. Ms. Reid added that the existing Shell station has 8 fueling stations. Commissioner O' Quinn asked if there had been interference in the past between vehicles turning out of the service station using the existing southernmost Webb Chapel entry and traffic turning onto the west-bound LBJ service road. Mr. Gillies answered that there had been congestion problems in the pat and the City Traffic Engineer, David Davis, strongly recommended that the southernmost Webb Chapel entry be closed. Commissioner O' Quinn asked, assuming approval, what the timing is for the completion of the proj ect? Ms. Reid responded that 7-Eleven and Shell would like to have the facility open by the end of this year or in January of next year. Chairman Patterson asked if anyone in the audience had any questions or comments. Having no one come forward to speak, Chairman Patterson requested a motion to close the public hearing. 3 A motion was made by Commissioner Bingham and seconded by Commissioner Glancy to close the public hearing. The motion carried unanimously. Upon closing the public hearing, a motion was made by Commissioner Bingham and seconded by Commissioner O'Quinn to recommend approval of the specific use permit and associated site plan for 12103 Webb Chapel. The motion carried unanimously. Adjournment: There being no additional items on the agenda, a motion was made by Commissioner O'Quinn and seconded by Chairman Patterson to adjourn the meeting at 7:20 p.m. The motion carried unanimously.
