1963-08-05 CC MinutesMINUTES OF A REGULAR MEETING CITY COUNCIL FARMERS BRANCH, TEXAS August 5, 1963 Members of the City Council present were: Mayor A. J. Airoldi Mayor Pro-Tem. Bill Hamilton Councilmen Frank Tippitt Ed Rhodes W. D. Oradat Dan Regan Assistant City Manager John C. Dodson City Secretary Dorthanna Williams PUBLIC HEARING - DR. MASSAD REQUEST Dr. Eugene Massad requested that Ordinance Nos. 148 and 243 be amended to allow for bed patients and for the sale of pharmaceuti- cal products at his clinic on Webb Chapel Road. The Plan Commis- sion recommended denial of this request. Mr. Vito Acciarito made the presentation for the request for Dr. Massad. Dr. Massad, Dr. Reynolds, Messrs. Attebery, Sullivan and Perry of Longmeade Drive; Mrs. Bailey, Havenhurst, Mrs. Acciarito, Messrs. Daugherty, Ferguson and others spoke in favor of the request. Those speaking against the request were: Dr. McGinn, Messrs. McCombs, Wells and Smith of Onyx Lane; Messrs. Moore and Cruisckshank of Webb Chapel Road and others. Councilman Rhodes asked for a show of hands of those for and those against the request. Councilman Tippitt suggested this be amended to a show of hand of those living within 200 feet of the property under request. Mayor Airoldi called for a show of hands of those for the change in zoning - 3; those opposed - 12. Councilman Regan moved approval of the request with special permit to include screening, single story construction and approval of site plan by the Plan Commission and the City Council; seconded by Councilman Tippitt. Councilmen Regan and Tippitt voting "ayes", Councilmen Rhodes, Hamilton and Oradat voting "nays". OPENING OF STEMMONS Mr. Gerald Pointer, invited the members opening ceremonies asked the Mayor for FREEWAY Chairman of Chamber of Commerce Highway Committee, of the Council to attend and take part in the Df Stemmons Freeway on August 15, 2:00 p.m. He a Proclamation to be published before this date. Page 116 PUBLIC HEARING - NORTHWOOD HOMES REQUEST Northwood Homes requested a change of zoning from "R-2" to "R-31" on the Brin property on Webb Chapel Road north of Chapel Hill Addi- tion. The Plan Commission recommended that this request be denied but that the property be zoned"R-2.5". Mr. Harold Pollman of Northwood Homes presented the case for the change. Mrs. Jessie Brin, John Brin, Pete Fonberg of Northwood Homes, Messrs. Cornelius, Reeves and Ashvill of Brisbane; Messrs. Russell and Secrest of Eunice; Hamm, Heartside and Lukin of Damas- cus spoke in favor of the request. Mrs. Brin presented letters in favor of the request from Mr. and Mrs. Downing and Mr. Jones, Damas- cus, Mr. Brothers, Eunice, Mr. Marsh, Chapparal and Mr. Hunsaker, Webb Chapel Road. Mr. Addison Bradford, Brook Hollow Drive, was opposed to the request. Councilman Oradat moved denial of the request from "R-2" to 11R-31" and that the property be zoned "R-2.5", seconded by Councilman Hamil- ton. Councilmen Tippitt, Hamilton, Oradat and Regan voting "ayes" Councilman Rhodes voting "nay". ORDINANCE NO. 412 - SPECIAL PERMIT OFFICE BUILDING, CHARLES ALLEN Upon a motion by Councilman Rhodes, a second by Councilman Oradat, all voting "ayes" with the exception of Councilman Tippitt who abstained (because he was not present at the public hearing) an ordinance was passed approving a change from "R-5" to Special Per- mit Office Building. Caption of the ordinance: AN ORDINANCE AMENDING THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF FARMERS BRANCH, TEXAS, AS HERETOFORE AMENDED, SO AS TO CHANGE THE FOLLOWING DESCRIBED PROPERTY FROM "R-5" RESIDENTIAL CLASSIFICATION TO "C" COMMERCIAL CLASSIFICATION UNDER A SPECIAL PERMIT FOR OFFICE BUILDINGS ONLY, SAID TRACT BEING DESCRIBED AS FOLLOWS: (Legal description - 2571 Valley View Lane); THAT SUCH PROPERTY IS TO BE USED UNDER A SPECIAL PERMIT FOR OFFICE BUILD- INGS ONLY, SUBJECT, HOWEVER, TO THE SPECIAL CONDITIONS HEREINAFTER MORE FULLY EXPRESSED; THAT THE PROPERTY SHALL BE IMPROVED ACCORDING TO PLANS AND SPECIFICATIONS SUBMITTED THEREFOR WHICH SHALL BE APPROVED BY THE CITY PLAN AND ZONING COMMISSION AND THE CITY COUN- CIL AND SUBJECT TO THE CONDITIONS CONTAINED HEREIN; PROVIDING FOR A PENALTY NOT TO EXCEED TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE; AND DECLARING AN EMERGENCY. SIMMONS MACHINERY COMPANY SITE PLAN Mr. Bill Simmons presented a site plan for Council approval for his property located on the south side of Valley View Lane approximately 1,200 feet west of Wallace Road. The Plan Commission approved the site plan on July 26, 1963. Page 117 After a lengthy discussion concerning the type of building that was planned, display location of the machinery and equipment, and the type of business that the building was to house, at the suggestion of Councilman Hamilton the request was taken under advisement until Mr. Simmons could: (1) investigate the possibility of constructing a masonry building in this area, (2) consider the location on the lot for the display of the machinery to be sold. REPORT ON COSTS OF STREET AND TRAFFIC SURVEY Mr. John Duff, Joe Rady and Company, gave a brief report and said he will give progress reports from time to time. He advised the State may help on this survey. ORDINANCE NO. 412 - PROHIBITING WINDOW PEEPING ETC. Upon a motion by Councilman Tippitt, a second by Councilman Oradat, all voting "ayes" the following captioned ordinance was passed: AN ORDINANCE OF THE CITY OF FARMERS BRANCH, TEXAS, PROHIBITING TRESPASSING ON THE PROPERTY OF OTHERS; PROHIBITING WINDOW PEEPING AND EAVESDROPPING; PROVIDING FOR A PENALTY NOT TO EXCEED TWO HUNDRED DOLLARS ($200.00); AND DECLARING AN EMERGENCY. ' AIR CONDITION PATROL CARS Councilman Tippitt moved that air conditioners be installed in three patrol cars for the Police Department, that these cars be used for patrolling only; seconded by Councilman Hamilton, all voting "ayes".
