1963-09-09 CC MinutesMINUTES OF A REGULAR MEETING CITY COUNCIL FARMERS BRANCH, TEXAS September 9, 1963 Members of the City Council present were: Mayor A. J. Airoldi Mayor Pro-Tem Bill Hamilton Councilmen Frank Tippitt Ed Rhodes W. D. Oradat Dan Regan City Manager J. M. Orman Assistant City Manager Sohn C. Dodson City Secretary Dorthanna Williams - Mayor Ai.roldi called the meeting to order. Mr. Bourdon Smith, Christ Methodist Church, gave the invocation. MINUTES OF PREVIOUS MEETINGS Councilman Tippitt moved to table consideration of minutes until the next meeting, seconded and passed. PUBLIC HEARING - 1963-1964 ANNUAL BUDGET City Manager Orman read the Budget Message to the Mayor and Members of the City Council. After discussion the Estimate of Resources was revised to show the beginning Cash Balance of October 1, 1963 to be $13,000, leaving an Estimated Cash Balance on September 20, 1964 to be $2,800. After this revision the 1963-1964 Proposed Budget was approved and adopted on motion by Councilman Oradat, second by Councilman Hamilton, all voting "ayes". RESOLUTION-APPROVE ASSESSMENT ROLLS Upon a motion by Councilman Rhodes, a second by Councilman Hamilton, all voting "ayes", the following resolution was passed and approved: WHEREAS, the Assessment Rolls for the year 1963, assessing all taxable property located in the City of Farmers Branch, have been prepared in due course; and WHEREAS, the Board of Equalization of the City of Farmers Branch has carefully examined and given hearings to the owners of property desir- ing to be head on protests of valuations and has reviewed and fully and finally revised said assessment rolls; and WHEREAS, said Assessment Rolls for the year 1963 are in proper form, and are proper and correct as finally revised and equalized by the said Board of Equalization; now, e 126 THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FARMERS BRANCH, TEXAS: SECTION 1. That the Assessment Rolls covering taxable property in the City of Farmers Branch, assessed for City purposes for the year 1963, be and the same are hereby in all things approved, confirmed and adopted as the official Assessment Rolls, assessed for the benefit of the City of Farmers Branch for the year 1963. SECTION 2. That this resolution shall take effect from and after its passage as provided. RESOLUTION - SET TAX RATE AT $1.75 Upon a motion by Councilman Hamilton, a second by Councilman Oradat, all voting "ayes", the following resolution was passed and approved: WHEREAS, assessments and renditions of all taxable property in the City of Farmers Branch have been made for the year 1963 by the Assessor and Collector of Taxes: NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FARMERS BRANCH, TEXAS: SECTION 1. That assessments and renditions for the year 1963 on all taxable property are hereby approved. SECTION 2. That the tax rate to be levied for the year 1963 on all taxable property, real, personal, or mixed, located within the City of Farmers Branch, be, and is hereby fixed at $1.75 per $100.00. SECTION 3. That this resolution shall take effect from and after its passage as provided. AUDIT OF 1962-1963 OPERATIONS Councilman Tippitt moved, employ Smith, Baines and Griffeth, C.P.A., as auditors for the fiscal year 1962-1963 and that the report be published in the official newspaper of the City; seconded by Council- man Hamilton, all voting "ayes". TRAFFIC PROBLEMS IN CITY After much discussion on the problem areas Tippitt moved that the Mayor be authorized mittee of five persons from the citizenry gate the feasibility, and if feasible, the Commission for Farmers Branch; seconded by voting "ayes". in the City, Councilman to appoint an interim Com- Df Farmers Branch to investi- scope, of a Citizens Traffic Councilman Hamilton, all Page 127 ORDINANCE NO. 422 - RELEASING APPROPRIATED FUNDS TO UNAPPROPRIATED SURPLUSES Upon a motion by Councilman Hamilton, a second by Councilman Oradat, all voting "ayes", an ordinance was passed returning funds to unappropriated surpluses: four sanitary sewer projects - $5,412.16; four water projects - $11,578.25; twelve street projects - $21,862 and one fire station project - $773.82. Caption of the ordinance: AN ORDINANCE SETTING FORTH THE AMOUNTS OF UNDERRUNS ON CERTAIN CONSTRUCTION PROJECTS; RELEASING THESE AMOUNTS FROM THE APPROPRIATED ACCOUNTS AND RETURNING THEM TO THE UNAPPROPRIATED SURPLUSES. ORDINANCE NO. 423 - WATER PROJECT NO. W-14 - DENNIS LANE Upon a motion by Councilman Oradat, a second by Councilman Rhodes, all voting "ayes", the following captioned ordinance was passed: AN ORDINANCE SETTING FORTH THE COST OF INSTALLING AN 8-INCH WATER LINE ON DENNIS LANE BETWEEN VALWOOD PARKWAY AND LONGMEADE DRIVE AND APPROPRIATING FUNDS THEREFOR OUT OF THE WATER BOND FUND UNAPPROPRIATED SURPLUS. ORDINANCE NO. 424 - STREET PROJECT NO. 15 - COOKS BRANCH Upon a motion by Councilman Hamilton, a second by Councilman Oradat, all voting "ayes", the following captioned ordinance was passed: AN ORDINANCE SETTING FORTH THE ACTUAL COST OF LINING COOKS BRANCH WITH A CONCRETE CHANNEL BETWEEN SPRING VALLEY ROAD AND THE KATY RAILROAD AND APPROPRIATING THE ADDITIONAL FUNDS NEEDED TO CARE FOR THIS ACTUAL COST. ORDINANCE NO. 425 - STREET PROJECT NO. 17 - TRAFFIC SIGNAL Upon a motion by Councilman Oradat, a second by Councilman Hamilton, all voting "ayes", the following captioned ordinance was passed: AN ORDINANCE SETTING FORTH THE ACTUAL COST OF INSTALLING TRAFFIC SIGNALS AT JOSEY LANE AND VALLEY VIEW LANE AND APPROPRIATING THE ADDITIONAL FUNDS NEEDED TO CARE FOR THIS ACTUAL COST. ORDINANCE NO. 426 - FIRE STATION PROJECT NO. FS-2 Upon a motion by Councilman Regan, a second by Councilman Tippitt, all voting "ayes", the following ordinance was passed: WHEREAS, on December 3, 1963, Ordinance No. 376 was passed by the City Council appropriating $1,500 out of the Street Improvement Bond Fund to Fire Station Project No. FS-2; and Page 128 WHEREAS, these funds were considered a loan to the Fire Station Bond Fund until funds became available in the Fire Station Bond Fund, said funds being used to purchase an auxiliary power plant for the Police and Fire Departments and to move the antenna to the vicinity of the two stations; and WHEREAS, the plant has been purchased, the antenna has been moved and funds are now available in the Fire Station Bond Fund with which to repay this loan. ORDINANCE NO. 427 - TRANSFER FUNDS - GFR TO ACCOUNTS 6 ANL 7 Upon a motion by Councilman Hamilton, a second by Councilman Regan, all voting "ayes", the following ordinance was passed: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FARMERS BRANCH, TEXAS: SECTION 1. That the following transfer of funds be approved, said funds to be used for air conditioning three police cars: From - GFR to Account 6 - $686.00. SECTION 2. That the following transfer of funds be approved, said funds to be used for personnel, clothing, supplies, etc. for the suburban fire station during August and September: From - GFR to Account 7 - Total $7,488.00. ORDINANCE NO. 428 - PARK PROJECT NO. 8 - RECREATION CENTER Upon a motion by Councilman Rhodes, a second by Councilman Tippitt, all voting "ayes", the following ordinance was passed: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FARMERS BRANCH, TEXAS: SECTION 1. That there is hereby appropriated out of the Park Bond Fund Unappropriated Surplus the sum of $2,765.73. SECTION 2. That these funds be appropriated to Park Project No. 8. SECTION 3. That the sum of $250.29 be transferred from GFR to Park Project No. 8. ORDINANCE NO. 423 - BROOKHAVEN SHOPPING CENTER TO APARTMENTS Upon a motion by Councilman Hamilton, a second by Councilman Oradat, Councilmen Rhodes, Hamilton, Oradat and Regan voting "ayes"; Council- man Tippitt abstaining (not present at Public Hearing held on June 24); the following captioned ordinance was passed: Page 129 AN ORDINANCE AMENDING THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF FARMERS BRANCH, AS HERETOFORE AMENDED, SO AS TO CHANGE THE FOLLOW- ING DESCRIBED PROPERTY FROM A "C" COMMERCIAL CLASSIFICATION UNDER A SPECIAL PERMIT FOR A SHOPPING CENTER TO AN "A" APARTMENT CLASSIFICA- TION UNDER A SPECIAL PERMIT, SAID TRACT BEING DESCRIBED AS FOLLOWS: (Legal Description); THAT SUCH PROPERTY IS TO BE USED UNDER A SPECIAL PERMIT FOR APARTMENT USES, SUBJECT, HOWEVER, TO THE SPECIAL CONDITIONS HEREINAFTER MORE FULLY EXPRESSED THAT THE PROPERTY SHALL BE IMPROVED ACCORDING TO PLANS AND SPECIFICATIONS SUBMITTED THEREFOR, WHICH.SHALL BE APPROVED BY THE CITY PLAN COMMISSION AND SUBJECT TO THE CONDITIONS CONTAINED HEREIN; PROVIDING FOR A PENALTY NOT TO EXCEED TWO HUNDRED D DOLLARS ($200.00) FOR EACH OFFENSE; AND DECLARING AN EMERGENCY. ORDINANCE NO. 430 - BRIN PROPERTY FROM "R-2" TO "R-2.5" Upon a motion by Councilman Hamilton, a second by Councilman Regan, all voting "ayes", the following captioned ordinance was passed: AN ORDINANCE AMENDING THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF FARMERS BRANCH, AS HERETOFORE AMENDED, SO AS TO CHANGE THE FOLLOW- ING DESCRIBED PROPERTY FROM AN "R-2" RESIDENTIAL CLASSIFICATION TO AN "R-2.5" RESIDENTIAL CLASSIFICATION, SAID TRACT BEING DESCRIBED AS FOLLOWS: (Legal Description); PROVIDING FOR A PENALTY NOT TO EXCEED TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE; AND DECLARING AN EMERGENCY. COTTON BELT TOLLROAD After discussion of this proposed tollroad Councilman Tippitt moved, resolve - notify the Transit Authority that the City Council of the City of Farmers Branch agrees with their present plans to stop at the Outer Loop, seconded and passed unanimously. DRAINAGE DITCH ALONG COTTON BELT RAILROAD After discussion on this subject with Mr. Don Church the Council agreed to ask Mr. Church and the Katy Railway Company to present a proposal to the City of Farmers Branch of what they will do to alleviate this drainage problem. MARVIN SPRINGER REPORT City Manager Orman said that he had met with Mr. Springer on August 30. Mr. Springer will have his report on the "L-M" area west of Highway 35E completed (includes health standards, development standards, etc.) in two to three weeks. CHANNEL IMPROVEMENTS WEST OF FRISCO RAILROAD City Manager Orman reported that the County Court order on this project will be on the basis of the City and the County sharing equally in the Page 130 cost with the City securing the easements.
