Mr. Wible of Austin Construction Company presented plans for the
building, he asked that all Morton's 400 acres be removed from the
First Fire Zone and also removed from special permit. Councilman
Regan said, the Fire Zone Ordinance is not onlly to protect the
area but to also protect all citizens of the city from losses which
set the fire rates as pertains to insurance. He asked what they
plan to build that would not come under the First Fire Zone.
After much discussion on building materials, Fire Zones, etc.,
Councilman Tippitt moved that an ordinance be prepared which would
removed "L-M", "L-M Special Permit", "H-M" and "H-M Special Permit"
from First Fire Zone and placing all in Third Fire Zone, seconded
by Councilman Regan; Councilmen Tippitt, Rhodes, Oradat and Regan
voting "ayes", Councilman Hamilton voting "nay".
TAX PAYMENT FROM LEWISVILLE STATE BANK WITHOUT PENALTY AND INTEREST
A Hershel Williams owed the City $262.50 for 1961 taxes on some
heavy equipment. The Lewisville State Bank repossessed the equip-
ment and sold it to several individuals. They had now proffered
a check for the $262.50 without including $33.45 penalty and interest.
Councilman Rhodes made a motion that the check for $262.50 be accepted

and that the penalty and interest charges be forgiven; seconded by
Councilman Oradat, all voting "ayes".
RESOLUTION - DELETION OF DELINgUENT TAXES
Upon a motion by Councilman Tippitt, a second by Councilman Oradat,
all voting "ayes", a resolution was passed where various delinquent
real estate and personal property taxes owed to the City in the
amount of $27.95 for the year 1560, $76.35 for the year 1961 and
$155.80 for the year 1962; that the taxes involved have been deemed
uncoliectable for various reasons which include removal of assets,
etc., thus making collection impossible; that these deletions be
made from both the real estate and the personal property delinquent
tax rolls.
ORDINANCE NO. 433 - TRANSFER OF FUNDS
Upon a motion by Councilman Tippitt, a second by Councilman Oradat,
all voting "ayes", an ordinance was passed that the following trans-
fer of funds be approved:

ORDINANCE NO. 434 - STREET PROJECT NO. 24
Upon a motion by Councilman Oradat, a second by Councilman Hamilton,
all voting "ayes", an ordinance was passed that there is hereby
appropriated out of the Street Improvement Bond Fund Unappropriated
Surplus the sum of $725.00; that these funds be appropriated to
Account No. 1 C-4 to reimburse that account for funds expended for
legal fees in connection with Street Project No. 24 (Valwood Parkway
Extension - west).
RESOLUTION - PURCHASE OF CONCRETE SAVE
Upon a motion by Councilman Tippitt, a second by Councilman Oradat,
all voting "ayes", a resolution was passed where on September 25,
sealed bids were received for furnishing a concrete saw; of the
five bids received, the one submitted by Ross Machinery Company in
the amount of $1,820 and one which met the specifications was con-
sidered the lowest and best bid; that this saw be purchased from
Ross Machinery Company at their bid price of $1,820; that it be
paid for from funds in Accounts 11 Z-2 and 101 Z-2 (taking $910
from each account).
