1963-11-04 CC MinutesMINUTES OF A REGULAR. MEETING CITY COUNCIL FARMERS BRANCH, TEXAS November 4, 1963 Members of the City Council present were: Mayor A. J. Airoldi Councilmen Frank Tippitt W. D. Oradat Dan Regan City Manager J. M. Orman Assistant City Attorney Bob Baker Mayor Pro-Tem Hamilton and Councilman Rhodes were attending Texas Municipal League Meeting in Houston Mayor Airoldi called the meeting to order. Mr. W. T. Smith, Valley View Church of Christ gave the invocation. FISH FRY Chief Bob Yager issued invitation to Councilmen and their wives to attend a fish fry on Monday, November 11 at Central Fire Station at 7:00 p.m. ACCEPTANCE OF FIRE STATION NO. 2 Station has been inspected by the Mayor and Councilmen present at 6:45 p.m. Councilman Oradat moved, seconded by Councilman Regan to accept the station; all voting "ayes". APPROVAL OF MINUTES OF OCTOBER 24 Change cost of insulation in library from $60 to $90 and decrease amount left for books by a corresponding amount. Councilman Regan so moved, seconded by Councilman Tippitt; all voting "ayes". REVISED SITE PLAN OF DR. BEN LAWRENCE'S SHOPPING CENTER Dr. Lawrence had requested that he be allowed to revise his plot plan so that he could erect four pole signs near the front property line of his new shopping center on Valley View Lane. The City Planning and Zoning Commission has recommended denial of the request. Councilman Tippitt made a motion that for the present time three pole signs be allowed, Councilman Regan seconded with Tippitt and Regan voting "ayes" and Councilman Oradat voting "nay". SITE PLAN OF W. H. SIMMONS No one was present for this item, even though our City Attorney had been advised that it would be considered at this time. Page 9 ORDINANCE NO. 441 - PAYMENT TO BROOKHAVEN DEVELOPMENT INC. Ordinance was presented that appropriated $19,221.69 from Street Improvement Bond Fund to Street Project No. 34 which included paving Brookhaven Club Drive extra width and extra thickness from Marsh Lane to Golfing Green Drive and through Unit No. 7. Interest was computed as agreed upon in minutes of July 6, 1955. Cost analysis was as follows: Paving Brookhaven Club Drive from Marsh Lane to Golfing Green Drive $13,221.48 Interest 2,090.66 Paving Brookhaven Club Drive in Unit #7 3,593.13 Interest 316.42 Total $19,221.60 Councilman Tippitt moved passage of the ordinance, seconded by Councilman Regan; all voting "ayes". Caption of the ordinance: AN ORDINANCE SETTING FORTH THE AMOUNT DUE BROOKHAVEN DEVELOPMENT, INC. FOR EXTRA WIDTH PAVING ON BROOKHAVEN CLUB DRIVE AND APPROPRIATING FUNDS THEREFOR OUT OF THE STREET IMPROVEMENT BOND FUND UNAPPROPRIATED SURPLUS. ORDINANCE NO. 442 - PAYMENT _T©BROOKHAVEN DEVELOPMENT, INC. Ordinance was presented that appropriated $7,019.96 from Water Bond Fund to Water Project No. W-21 which included City's net cost for installation of water lines in Brookhaven's Units 1, 2, 4, 5 and 7 (the developer having installed large lines in Units 1 and 2 for which the City owed him the cost over that of an 8-inch line and the City having installed large lines in Units 4, 5 and 7 for which he owed the City the cost of 8-inch lines). Caption of the ordinance: Page 10 AN ORDINANCE SETTING FORTH THE NET AMOUNT DUE BROOKHAVEN DEVELOPMENT, INC. FOR CERTAIN WATER LINES INSTALLED IN BROOKHAVEN COUNTRY CLUB ESTATES AND APPROPRIATING FUNDS THEREFOR OUT OF THE WATER BOND FUND UNAPPROPRIATED SURPLUS. MACON MANOR SITE PLAN REVISION Mr. Dave Macon requested a change in his site plan. It involved changing size and location of recreational area and sizes of park- ing areas. Action was delayed pending checking proposed changes with new apartment regulations. APPOINTMENTS TO PARK AND RECREATION COMMISSION Upon a motion by Councilman Oradat, seconded by Councilman Regan, all voting "ayes", Mr. Tucker Latham was appointed to fill vacancy (George Oyster resigned) and to serve until May, 1964 and Mr. Ray Thompson was appointed to fill vacancy (Larry Wallace resigned) and to serve until May, 1966. (Amended and corrected, Special Meeting, November 7, 1963) ORDINANCE NO. 443 - ANTI-NOISE An ordinance designed to prohibit certain noises within the City was passed upon a motion by Councilman Tippitt, seconded by Council- man Regan; all voting "ayes". Caption of the ordinance: AN ORDINANCE OF THE CITY OF FARMERS BRANCH, TEXAS, PROHIBITING CERTAIN NOISES WITHIN THE CITY; PROVIDING FOR A PENALTY NOT TO EXCEED B40 HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE; AND DECLARING AN EMERGENCY. COOPER CONCRETE COMPANY CONTRACT ON DRIVES & PARKING AREAS Deficiencies in thicknesses of slabs constructed under this contract were discussed. From cores that were taken, all work came within the allowable tolerance except the driveway in front of Fire Station No. 2; however, that portion of the slab between the right-of-way line and the existing pavement did meet the specifications. Upon a motion by Councilman Oradat, seconded by Councilman Tippitt, all voting "ayes", payment for this contract will be made on the basis of a 6-inch thick driveway in front of the fire station instead of a 7-inch and a deduction of the $180 cost of coring from the amount due the contractor. AWARD OF PAVING CONTRACT Uvalde Construction Company and Austin Paving Company submitted bids on paving Squire Place, Goodwater Street and Valwood Parkway. Upon a motion by Councilman Oradat, seconded by Councilman Regan, all voting "ayes", the contract was awarded to Uvalde Construction Com- pany on the basis of their low bid of $59,183.46.
