Mr. Orval M. Barger, Webb Chapel Baptist Church, gave the invocation. APPROVAL OF MINUTES Special Meeting, December 10, 1963 - Tippitt/Oradat Regular Meeting, December 16, 1963 - Oradat/Tippitt Special Meeting, December 19, 1963 - Rhodes/Oradat ORDINANCE NO. 452 - ANNEXATION AREA DISANNEXED BY DALLAS Upon a motion by Councilman Tippitt, a second by Councilman Hamilton, all voting "ayes" , an ordinance was passed to execute an agreement with the City of Dallas for the City of Farmers Branch to annex an area to be disannexed by the City of Dallas; to publish notice in the Dallas Times Herald on January 8, 1964 and set Public Hearing date for January 20, 1964. Caption of the Ordinance: AN ORDINANCE APPRUJIOG A 1k7RITTEN AGREEMENT APPORTIONING OVERLAPPED AREA OF EXTRA-TERRITORIAL JURISDICTION OF THE CITY OF DALLAS AND THE CITY OF FARMERS BRANCH IN ACCORDANCE WITH THE MUNICIPAL ANNEXATION ACT; PROVIDING FOR SEVERABILITY AND DECLARING AN EMERGENCY. ORDINANCE 140. 453 - PUBLIC HEARING-BILLBOARDS & ADVERTISING SIGNS Upon a motion by Councilman Oradat, a second by Councilman Upfield, all voting "ayes", an ordinance was passed, after holding due hear- ings and affording a full and fair hearing to all property owners generally and to the persons interested and situated in the affected area and in the vicinity thereof, amending the Comprehensive Zoning Ordinance. Caption of the ordinance: Page 28 AN ORDINANCE AMENDING THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF FARMERS BRANCH, TEXAS, AS HERETOFORE AMENDED, BY AMENDING ARTICLE X. SECTION 1 AND ARTICLE XI, SECTION 1, SO AS TO DELETE FROM ARTICLE X, SECTION 1 THE USE OF "COMMERCIAL BILLBOARD OR ADVERTISING SIGN", AND ADDING SUCH USAGE TO ARTICLE XI, SECTION 1; PROHIBITING THE USE OF COMMERCIAL BILLBOARDS OR ADVERTISING SIGNS IN "C" COMMERCIAL DISTRICT; PROVIDING FOR THE PENALTY NOT TO EXCEED TWO HUNDRED ($200.00) DOLLARS FOR EACH OFFENSE AND DECLARING AN EMERGENCY. REPORT ON ANNUAL AUDIT Mr. Brud Smith of Smith, Baines and Griffith, the City's auditors, gave a report on the audit for the 1962-1963 fiscal year. After a lengthy discussion Councilman Tippitt moved; accept the annual financial report as prepared and publish combined balance sheets 38 and 39 for general information in the official newspaper; seconded by Councilman Rhodes, all voting "ayes'". ORDINANCE NO. 454 - STREET PROJECT NO. 24 - R-O-W VALuVOOD PARKWAY Upon a motion by Councilman Rhodes, a second by Councilman Upfield, all voting "ayes", an ordinance was passed appropriating $3,000.00 to this project. Caption of the ordinance: AN ORDINANCE SETTING FORTH THE AMOUNT OF THE AWARD TO RUFUS S. HEAD, ET AL, AS DETERMINED BY A SPECIAL CONDEMNATION COURT FOR RIGHT--OF- WAY NEEDED FOR VALWOOD PARKWAY EXTENSION AND APPROPRIATING FUNDS THEREFOR OUT OF THE STREET IMPROVEMENT BOND FUND UNAPPROPRIATED SURPLUS. RESOLUTION - ROGER SULLIVAN COMPANY - PARK & STREET DEDICATION Upon a motion by Councilman Oradat, a second by Councilman Rhodes, all voting "ayes'", a resolution was passed accepting a dedication of a tract of 12.70 acres of land for street and park purposes; this tract bounded on the east by Josey Lane, on the north by Raw- hide Parkway, on the west by Tom Field Road and on the south by Golfing Green Drive. ORDINANCE NO. 455 - THIRD FIRE DISTRICT Upon a motion by Councilman Tippitt, a second by Councilman Hamilton, all voting "ayes", the following captioned ordinance was passed: AN ORDINANCE OF THE CITY OF FARMERS .BRANCH, TEXAS AMENDING THE BUILDING CODE OF THE CITY OF FARMERS BRANCH; DEFINING THE FIRST FIRE DISTRICT TO BE THOSE AREAS ZONED "C°" AND "C SPECIAL PERMIT" CLASSIFICATION UNDER THE ZONING ORDINANCE; PROHIBITING THE USE OF CERTAIN BUILDINGS WITHIN THE LIMITS OF THE FIRST FIRE DISTRICT; Page 29 REQUIRING CERTAIN TYPES OF MATERIALS TO BE USED IN THE CONSTRUCTION AND REPAIR OF BUILDINGS WITHIN THE FIRST FIRE DISTRICT; MAKING THE ORDINANCE APPLICABLE TO EXISTING BUILDINGS; PROHIBITING THE ISSUANCE OF BUILDING PERMITS UNLESS PROPOSED STRUCTURE COMPLIES WITH THE REQUIREMENTS OF THE BUILDING CODE; PROHIBITI14G THE MOVING OF BUILD- INGS WITHIN THE LIMITS OF THE FIRST FIRE DISTRICT WITHOUT COMPLIANCE WITH THE BUILDING CODE; PROVIDING FOR A THIRD FIRE DISTRICT AND DEFINING THE THIRD FIRE DISTRICT TO BE THOSE AREAS ZONED "L-M" AND "L-M SPECIAL PERMIT", "H-M" AND "H-M SPECIAL PERMIT", CLASSIFICATIONS UNDER THE ZONING ORDINANCE; PROVIDING THAT THE REGULATIONS IN THE FIRST FIRE DISTRICT SHOULD BE APPLICABLE TO THE THIRD FIRE DISTRICT EXCEPT AS MODIFIED HEREIN; PROVIDING A SEVERABILITY CLAUSE; FIXING A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO HUNDRED ($200.00) DOLLARS FOR EACH OFFENSE AND MAKING EACH DAY OF VIOLATION A SEPARATE OFFENSE; AND DECLARING Ali EMERGENCY. ORDINANCE NO. 456 - CALL ELECTION TO AMEND CITY CHARTER Upon a motion by Councilman Tippitt, a second by Councilman Rhodes, all voting "ayes", an ordinance was passed for the purpose of sub- mitting to the qualified voters of the City an amendment to the Home Rule Charter: Amendment No. 1 That Article VII, Section 7.01, of the Charter shall be amended so as to read as follows: "Section 7.01 - Elections. "The regular City election shall be held annually on the first Saturday in April commencing in the year 1966, at which time officers will be elected to fill those offices which become vacant that year. The City Council shall fix the hours and place for holding such election. The City Council may, by resolution, order a special election, fix the time and place for holding same, and provided all means for holding such special election. "On the first Saturday in April, A.D. 1966, there shall be elected at an election to be called for that purpose Councilmen for Place No. 1, Place No. 3 and Place No. 5, who shall serve for a term of one (1) year and until their successors have been elected and shall qualify.
