1964-09-08 CC MinutesMINUTES OF A REGULAR MEETING CITY COUNCIL FARMERS BRANCH, TEXAS September 8, 1964 All members of the City Council Mayor Mayor Pro-Tem Councilmen City Manager City Attorney City Secretary were present: A. J. Airoldi Bill Hamilton Frank Tippitt Ed Rhodes Dick Myers James Upfield J. M. Orman Bob Baker Dorthanna Williams Mayor Airoldi called the meeting to order. Mayor Pro-Tem Hamilton gave the invocation. APPROVAL OF MINUTES The minutes of: a special meeting, August 10, were considered and approved; a regular meeting, August 17, were approved by motion of Councilman Hamilton, a second by Councilman Myers with this addi- tion authorize the Mayor to sign the contract with the Dallas Transit Company for the Club Bus; a special meeting, August 31, were considered and approved. PUBLIC HEARING - 1964-1965 BUDGET City Manager Orman presented the budget as prepared by the City Manager, Department Heads, the Mayor and members of the City Council. After discussion Councilman Hamilton moved that the hearing be closed, seconded by Councilman Tippitt, all voting "ayes". RESOLUTION - SET TAX RATE Upon a motion by Councilman Rhodes, a second by Councilman Myers; Councilmen Rhodes, Myers and Hamilton voting "ayes", Councilman Tippitt voting "nay", the following resolution was passed: WHEREAS, assessments and renditions of all taxable property in the City of Farmers Branch have been made for the year 1964 by the Assessor and Collector of Taxes: NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FARMERS BRANCH, TEXAS: Page 109 SECTION 1. That assessments and renditions for the year 1964 on all taxable property are hereby approved. SECTION 2. That the tax rate to be levied for the year 1964 on all taxable property, real, personal, or mixed, located within the City of Farmers Branch, be, and is hereby fixed at $1.05 per $100.00. SECTION 3. Airoldi City Secretary Mayor ORDINANCE NO. 500 - ADOPTING 1964-1965 BUDGET Upon a motion by Councilman Hamilton, a second by Councilman Rhodes, all voting "ayes", the following captioned ordinance was passed: AN ORDINANCE OF THE CITY OF FARMERS BRANCH PROVIDING FUNDS FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 1964 AND ENDING SEPTEMBER 30, 1965, BY APPROVING THE BUDGET FOR SAID PERIOD AND APPROPRIATING AND SETTING ASIDE THE NECESSARY FUNDS OUT OF THE GENERAL AND OTHER REVENUES OF THE CITY OF FARMERS BRANCH FOR SAID FISCAL YEAR FOR THE MAINTENANCE AND OPERATION OF VARIOUS DEPARTMENTS AND FOR VARIOUS ACTIVITIES AND IMPROVEMENTS OF THE CITY; AND DECLARING AN EMERGENCY. RESOLUTION - APPROVE TAX ROLLS Upon a motion by Councilman Myers, a second by Councilman Hamilton; Councilman Rhodes, Myers and Hamilton voting "ayes", Councilman Tippitt voting "nay"; the following resolution was passed: WHEREAS, the Assessment Rolls for the year 1964, assessing all taxable property located in the City of Farmers Branch, have been prepared in due course; and WHEREAS, the Board of Equalization of the City of Farmers Branch has carefully examined and given hearings to the owners of property desiring to be heard on protests of valuations and has reviewed and fully and finally revised said assessment rolls; and WHEREAS, said Assessment Rolls for the year 1964 are in proper form, and are proper and correct as finally revised and equalized by the said Board of Equalization; now, Page 110 THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FARMERS BRANCH, TEXAS: SECTION 1. That the Assessment Rolls covering taxable property in the City of Farmers Branch, assessed for City purposes for the year 1964, be and the same are hereby in all things approved, confirmed and adopted as the official Assessment Rolls, assessed for the benefit of the City of Farmers Branch for the year 1964. Airoldi Mayor COLLEGE ass with the Council the loca- Branch south of the Farmers reaction was favorable to the ORDINANCE NO. 499 - SHELL OIL COMPANY Upon a motion by Councilman Upfield, a second by Councilman Tippitt, all voting "ayes", the following captioned ordinance was passed: AN ORDINANCE AMENDING THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF FARMERS BRANCH, AS HERETOFORE AMENDED, SO AS TO CHANGE THE FOLLOW- ING DESCRIBED PROPERTY FROM AN "A" APARTMENT DISTRICT CLASSIFICATION TO A "C" COMMERCIAL DISTRICT CLASSIFICATION UNDER A SPECIAL PERMIT, SAID TRACT BEING DESCRIBED AS FOLLOWS: BEING A TRACT OF LAND SITUATED IN THE ISAAC B. WEBB SURVEY, ABSTRACT NO. 1574, CITY OF FARMERS BRANCH, TEXAS, DALLAS COUNTY, TEXAS, AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: (legal description-Webb Chapel and 635); THAT SUCH PROPERTY IS TO BE USED UNDER A SPECIAL PERMIT FOR COMMERCIAL USES, SUBJECT, HOWEVER, TO THE SPECIAL CONDITIONS HEREINAFTER MORE FULLY EXPRESSED; THAT THE PROPERTY SHALL BE IMPROVED ACCORDING TO PLANS AND SPECIFICA- TIONS SUBMITTED THEREFOR, WHICH SHALL BE APPROVED BY THE CITY COUNCIL AND SUBJECT TO THE CONDITIONS CONTAINED HEREIN; PROVIDING FOR A PENALTY NOT TO EXCEED TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE; AND DECLARING AN EMERGENCY. Page 111 The City Council then reviewed the original ordinance dated February 17, 1964 (Ordinance No. 463) concerning this tract of land, including apartment zoning, which indicates these three phases: (1) service station and fence, (2) concrete lined channel, screening and fences and (3) apartments. CLUB BUS SERVICE Councilman Tippitt suggested that the Committee meet with Dallas Transit Company to consider amending the contract to read at such time as the bus service begins to show a profit the Transit Company will reimburse the City of Farmers Branch for any loss incurred by the City. All members of the Council were in agreement. SCHOOL CROSSINGS The City Council held a lengthy discussion on school crossings which are considered dangerous for small elementary school children. PUBLIC HEARING ZONE AREA ANNEXED FROM CITY OF DALLAS This hearing involved "L-M" Zoning and to allow mining of sand and gravel on two tracts with-r the area. There was no opposition to the zoning as recommended by the Plan Commission. Councilman Tippitt moved that the hearing be closed, seconded by Councilman Hamilton, all voting "ayes". Councilman Rhodes moved that an ordinance be written zoning the area annexed from Dallas on January 20, 1964 (Ordinance No. 457) "L-M" Manufacturing with provisions for allowing mining, etc., per Texas Bitulithic Company's previous agreement with the City of Dallas and also consideration of the drainage problem; seconded by Councilman Tippitt, all voting "ayes". The Council requested that the City Engineer make a profile of the drainage area. VALLEY VIEW LANE R-O-W ACQUISITION After a report from City Attorney Louis Nichols, Councilman Tippitt moved, abandon Valley View Lane right-of-way acquisition program present project due to lack of funds, from Holbrook to Stemmons Freeway (with the exception of Fred Marsh Garage); seconded by Councilman Hamilton, all voting "ayes". ORDINANCE NO. 501 - TAXI-CAB Upon a motion by Councilman Rhodes, a second by Councilman Hamilton, all voting "ayes", the following captioned ordinance was passed: AN ORDINANCE OF THE CITY OF FARMERS BRANCH, TEXAS, REGULATING THE OPERATION OF TAXICABS WITHIN THE CITY; PROVIDING FOR FRANCHISES; PRO- VIDING A PENALTY NOT TO EXCEED TWO HUNDRED DOLLARS FOR EACH OFFENSE AND DECLARING AN EMERGENCY. Page 112 RESOLUTION - FINAL PAYMENT - WATER PROJECT NO. W-24 Upon a motion by Councilman Hamilton, a second by Councilman Rhodes, all voting "ayes", a resolution was passed whereas, C. P. Hentzen, Inc. has completed the construction of a 12-inch water main along Marsh Lane from Valley View Lane to Brookhaven Club Drive and an 8-inch connection between Valley View Lane and Havenhurst along the west service road, in accordance with the plans and specifications; that this project is hereby accepted and final payment in the amount of $10,943.19 is authorized; and that this payment be made from funds previously appropriated to this project. RESOLUTION - FINAL PAYMENT - SANITARY SEWER PROJECT NO. S-18 Upon a motion by Councilman Hamilton, a second by Councilman Tippitt, all voting "ayes", a resolution was passed whereas, Cullum Construc- tion Company has completed the construction of a sanitary sewer trunk main along Farmers Branch Creek between Valley View Lane and a point east of Dooley Road, in accordance with the plans and specifications; that this project is hereby accepted and final payment in the amount of $6,621.72 is authorized; and that this payment be made from funds previously appropriated to this project. MARVIN SPRINGER ZONING STUDY Upon a motion by Councilman Hamilton, a second by Councilman Rhodes, all voting "ayes", payment of $2,179.07 was approved for Marvin Springer and Associates for a zoning study and recommendations on the area annexed from Addison and an 80-acre tract at Marsh Lane and Valley View Lane. JOE J. RADY - R-O-W AGENT Upon a motion ISy Councilman Tippitt, a second by Councilman Hamilton, all voting "ayes", payment of $316.66 was approved to Joe J. Rady Company for the right-of-way agent's work on Valley View Lane. ORDINANCE NO. 502 - APPROPRIATING AND RELEASING FUNDS-BOND PROJECTS Upon a motion by Councilman Tippitt, a second by Councilman Hamilton, all voting "ayes", the following captioned ordinance was passed: AN ORDINANCE APPROPRIATING ADDITIONAL FUNDS TO VARIOUS BOND FUND PROJECTS TO MEET ACTUAL COSTS AND RELEASING FUNDS FROM VARIOUS BOND FUND PROJECTS TO THE UNAPPROPRIATED SURPLUSES WHERE APPROPRIATED FUNDS HAVE EXCEEDED ACTUAL COSTS. RAWHIDE SWIMMING POOL City Manager Orman was instructed to keep Rawhide Pool open on Saturday and Sunday, 1 to 7 p.m., through September and to open the pools the middle of May in 1965.
