1961-03-20 CC Minutes1 MINUTES OF A REGULAR MEETING CITY COUNCIL FARMERS BRANCH, TEXAS 20, 1961 March The City Council met Community Building at Mayor Councilmen in a regular meeting 7:30 p m. with all City Manager Assistant City Manager City Secretary on March 20, 1961 at the members present: Oley E. Attebery Sam Page H. N. Mallon John Wilsey Don Knox Bill Hamilton J. M. Orman John C. Dodson Dorthanna Williams Mayor Attebery called the meeting to order. Mr. Bob Bolding, Youth and Music Director of the Valwood Baptist Church gave the invocation. ORDINANCE NO. 277-REGULATING SPEED OF TRAINS City Manager Orman read the ordinance as prepared. Councilman Page said he would suggest a maximum speed limit be incorporated in the ordinanceā€ž Councilman Knox moved passage of the ordinance as written, after saying if a maximum speed limit is desired it can be incorporated in the ordinance later; seconded by Councilman Page, all voting "ayes". Caption of the ordinance reads as follows: AN ORDINANCE OF THE CITY OF FARMERS BRANCH REGULATING THE SPEED OF LOCOMOTIVES OR TRAINS AT CROSSINGS NOT PROTECTED BY FLASHING SIGNAL DEVICES; PROHIBITING LOCOMOTIVES OR TRAINS FROM OBSTRUC- TING PUBLIC STREET CROSSINGS FOR MORE THAN FIVE CONSECUTIVE MINUTES; REQUIRING RAILROAD COMPANIES TO MAINTAIN THEIR ROAD- BED AND RIGHT-OF-WAY WITHIN THE LIMITS OF ANY PUBLIC STREET; PROVIDING A SEVERABILITY CLAUSE; FIXING A PENALTY OF FINE NOT TO EXCEED THE SUM OF $200.00 FOR EACH OFFENSE; AND DECLARING AND EMERGENCY. ORDINANCE NO. 278-IENDOR'S ORDINANCE City Manager Orman read the ordinance as prepared. Councilman Hamilton suggested, under Section 9, hours of operations, add days of operations, Monday's through Saturday's. Councilman Mallon suggested, add repealing all other Vendor's ordinances. With these changes Councilman Mallon moved passage of the ordinance, seconded by Councilman Knox, all voting "ayes". Caption of the ordinance reads as follows: AN ORDINANCE OF THE CITY OF FARMERS BRANCH REQUIRING PEDDLERS AND SOLICITORS TO OBTAIN A PERMIT BEFORE OPERATING WITHIN THE LIMITS OF THE CITY OF FARMERS BRANCH; PROVIDING FOR AN INVESTI- GATION FEE OF $10; MAKING EXCEPTIONS WITH REGARD TO THE PAYMENT OF THE FEE; PROVIDING FOR APPLICATION FOR PERMIT, INVESTIGATION, Page 64 AND APPEAL FROM DENIAL OF PERMIT; PROHIBITING LOUD NOISES AND SPEAKING DEVICES; FIXING HOURS OF OPERATION; REGULATING USE OF STREETS; REQUIRING CERTIFICATE OF HEALTH; REQUIRING ORDINANCE TO BE ENFORCED BY POLICE DEPARTMENT; EXCEPTING CERTAIN PUBLIC UTILITY COMPANIES, INSURANCE AGENTS AND OTHERS LICENSED BY THE STATE OF TEXAS; AND PERSONS SELLING TO BUSINESS ESTABLISHMENTS; PROVIDING A SEVERABILITY CLAUSE; FIXING A PENALTY OF FINE NOT TO EXCEED THE SUM OF $200.00 FOR EACH OFFENSE; REPEALING ORDINANCES 81, 93 and 102; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FARMERS BRANCH, TEXAS: RESULT OF SANITATION STUDY Mayor Attebery said, we want to get the garbage cans off the front lawns, my feeling is that this is one of the greatest things we can do, it is the number one complaint in the City, seems to me we should tub the garbage out. Councilman Knox said he would not be for contracting for garbage col- lection. Councilman Mallon asked, if we adopt tubbing out will we have to contract it out? City Manager Orman said, with the equipment we have now we can do it, at least until the city grows more. It will cost about 25% more to "tub-out". Mayor Attebery said he would suggest building carts with wheels so the collectors can cart the garbage to the trucks. Councilman Mallon said, authorize the City Manager to start now to get the garbage cans off the streets. All Councilmen agreed. Mayor Attebery said, we should not relax our efforts to get the alleys paved but can use this method until such time as alleys can be paved. AMENDMENT TO ORDINANCE NO. 153-SUBDIVISION REGULATIONS City Manager Orman gave copies of a report on costs involved in paving various widths of streets. He presented a plat from the Master Plan showing different types of streets. He explained the extent of City participation will need to be determined before costs can be estimated for the bond program. This report was for the Council's study. The question was raised whether or not property owners whose property backed up to streets would be assessed. Mr. Orman was instructed to inquire into the policy of the City of Dallas since it was not known what policy is usually followed. JAYCEES' REQUEST USE OF SCOUT HUT Mr. Avery Bradley, president of the Jaycees, appeared before the Coun- cil to request the use of the green frame building in Gussie Field 6daterworth Park as a meeting place for the Jaycees. Page 65 Mayor Attebery asked if they wanted it for the Jaycees' use exclusively? Mr. Bradley said, no, there are other civic clubs who will want to use it. Councilman Hamilton asked about sanitary facilities in the building. There are none. The building is now being used as a working place for the boxing club. The Council suggested that Mr. Bradley meet with the Park Board after looking the building over and work out something with them. The Park Board will then make their recommendations to the Council. COUNCIL OF GARDEN CLUBS -ORDINANCE NO. 282 Mrs. Tompie Dyer presented a picture of the way the area will look at Valley View Lane and Highway '77 when the beautification is completed. Mayor Attebery said, we have agreed to maintain this area but actually we are going to have to go a little bit further. This can't all be done by contributions, the city will have to show their interest, too. Councilman Page presented costs and estimated costs on plants, grass seed, sprinkling system, wall, etc. Mayor Attebery asked if the Council would be in favor of the City contributing $500? Councilman Knox said, it is a civic project and they should get the people to do all they will first but he was in favor of blading the property off and putting in the sprinkling system. Mrs. Dyer said, if they ever plan to do anything, do it in time for the contest which they hope to win with this plan. Councilman Hamilton asked if the City has some money to help with this project. He believed it most worthwhile and was in favor of helping all they can. Councilman Wilsey moved, appropriate $210 for the water system, allow $50 for grass seed or sod and fertilizer and $15 for the picture which will be permanent property of the City; provided, foliage at the approximate cost of $300 be provided by others; seconded by Councilman Knox, passed unanimously. The total amount of $275 to be appropriated from the Park Bond Fund. CITY OF ADDISON PROJECT Mayor Attebery announced a meeting with the property owners and the Councils of Addison and Farmers Branch had been set for Thursday, March 23 in the Farmers Branch Council Room at 8:00 p.m. Letters have been mailed to all property owners involved. Councilman Mallon said, we have to agree we will put the sewer up to the division line. Mayor Attebery said, yes. Councilman Wilsey asked, when will we have to put in the sewer? Mayor Attebery said they will have to give a stated time, one year, eighteen months or so. It will have to be included in the bond program. SPECI,7%L PERMIT PROVISIONS FOR MEDICAL CENTER City Manager Orman said recommendations from the proponents of the center and from the property owners had not been received and they were due that day. The Council gave instructions for the City Attorney to contact the attorneys for them, get their ideas and comments and draw up the ordinance for the Council's consideration. Page 66 CONSIDER REVISED COSTS ON DENNIS ROAD OPENING City Manager Orman said, the initial estimated cost to the City on this project was $12,326. This was based on the County's initial set of plans. after numerous conferences between Mr. Napier and the County Engineer's office it was apparent that the initial storm sewers were inadequate. The revised estimated total cost for the City is now $22,185 or an increase of $0,859 over the original estimated cost. He reported there remains an unappropriated balance in the Storm Sewer Bond Fund and the County is spending some $26,000 on this project. Councilman Knox moved, approve plan increasing cost to $22,185, seconded by Councilman Mallon, all voting "ayes". 1 1 BIDS ON STREET PATCHING ROLLER City Manager Orman explained this Three bids were received: F. M. Equipment Company Dalworth Machinery Company Moody-Day Company, Inc. item appears on this year's budget. $2,411.64 2,122.30 2,055.84 After careful study and consideration Director of Public Works, F. L. Napier, recommended the Essick Model VR-20-W bid by F. M. Equipment Company at the higher cost. Councilman Wilsey said he feels Mr. Napier knows much more about this equipment than they do and they are interested in getting the most for their money. Councilman Wilsey moved award bid to F. M. Equipment Company in accordance with Mr. Napier's recommendation, seconded by Councilman Knox, all -.Toting "ayes'. BUILDING LINE ON DENTON ROAD City Manager Orman reported it is recommended that a building line be established on Denton Road between Havenhurst and Valwood Parkway in order to provide for the eventual widening of the street. A 30-foot set-back from the property line is recommended. Councilman Mallon moved, provide for a 30-foot set-back on the west side of Denton Road between Havenhurst and Valwood Parkway, seconded by Councilman Wilsey, all voting "ayes'. CURFEW ON GO-CP.RT OPERATIONS ON VALLEY VIEW L2zaqE City Manager Orman told the Council Mr. Skinner has made a request that the Go-Cart track on Valley View Lane be required to cease operations at 10:00 p.m. Councilman Wilsey asked, is there any way we can study this before we take action? lie was not adverse to setting a curfew but would like to know more about it, hear the other side, etc. It was agreed the Council would defer action and ask Mr. Skinner and Mr. Dickerson, owner of the Go-Cart track to appear before the Council. RESOLUTION-FYKE ROAD Upon a motion by Councilman Wilsey, seconded by Councilman Knox, all voting "ayes", a resolution was passed that the County Commissioner's Court be respectfully requested to render all possible assistance in participating with Farmers Branch and Carrollton in the improvement of Fyke Road due to its strategic position between two schools; being Page 67 shown on the City's Master Plan as a thoroughfare; being the division street between the two cities; and destined to become a street of major importance to both cities and to the Carrollton School District. _PROPOSED BOND PROGRr M Councilman Mallon said he thought the Mayor's suggestions in his memo to the Council were just wonderful. They have fulfilled all the obli- gations of the last bond program except the sub-fire station and he would like to see something done on this before the next bond program. Councilman Knox said he agreed but they made the mistake of not appro- priating enough money and they must not make this mistake again. There was discussion of what might be done, temporary quarters, sign, etc. No formal action was taken by the Council. APPOINTMENT TO THE PARK COMMISSION Upon a motion by Councilman Wilsey, seconded by Councilman Mallon, all voting "ayes", Mr. George Oyester, 2851 Ermine Way, was appointed to the Park and Recreation Commission to replace Delbert Moore whose term expires in May; and to a full two year term following, this term to expire May, 1963. APPOINTMENT TO PLANNING AND ZONING COMMISSION Upon a motion by Councilman Knox, seconded by Councilman Page, all voting "ayes', Mr. W. D. Oradat, 3041 Marl-, Twain, was appointed to serve the unexpired term of Mr. Charles L. Smith. Mr. Oradat's term to expire May, 1963. REPORTS FROM CITY MANAGER a. Monthly Financial Report. b. T.R.A.
