BOARD OF COUNCILMEN

FEBRUARY 16, 1959
The City Council convened in a regular meeting on February 16, 1959
at the Community Building at 7:30 P. M. with the following present:

Mayor Lewis called the meeting to order. Bourdon Smith, Pastor of
Christ Methodist Church gave the invocation.
The minutes of a regular meeting of January 19 were approved.
VISITORS
Addison Bradford, 3106 Brook Hollow Drive, representing a group of
residents of Brookhollow Addition, presented a petition for rezon-
ing the property south and east of Brookhollow Addition from R-7.5
to R-16. He asked the Council to take action immediately and call
a public hearing as soon as possible. He added the failure of the
Planning and Zoning Commission to render a "yes" or "no" had brought
them to the City Council. Councilman Attebery moved the Council in-
stigate a public hearing as soon as possible, duly seconded by Coun-
cilman Knox, passed unanimously. A public hearing was set for March
10, 19 59 .
Mr. Don Waller, 2511 Squire Place and Mr. Paul Waller, 2559 Green-
hurst, appeared in behalf of Eddie Smith, a juvenile, whose rights
have been violated by certain members of the Police Department ac-
cording to the two men. They gave several instances in which they
thought the boy had been mistreated by the policemen. The boy's
father was with them but had asked the men to speak for him. They
also asked for $50 in fines to be refunded to the boy. Councilman
Attebery said he would like for Eddie to meet with Rev. Bourdon
Smith, Chairman of the Juvenile Committee. No action was taken on
this, except Councilman Knox assured them the Council would investi-
gate the case thoroughly and take action if such is found to be nec-
essary.
RECOMMENDATION FROM MINISTERIAL ASSOCIATION
Rev. Bourdon Smith brought a recommendation from the Association that
the Council consider the mid-week services at most of the churches in
scheduling the baseball games for the summer and close the ball parks
on Wednesday nights. Councilman Attebery told him we do not have e-
nough ball parks at this time but if they could close one night it
would be Wednesday night. Councilman Knox said they would have many
complaints either way.

REPORT FROM JUVENILE COMMITTEE
Rev. Bourdon Smith, Chairman of Juvenile Committee, reported the orig-
inal purpose of the Committee was to be an extended arm of Juvenile
problems, the same general idea of the Big Brother Organization. He

said they have had good results with some of the cases, some, not so
good. They have planned a meeting with Police Chief Courtney and Sam
Davis of Juvenile Commission of the City of Dallas hoping to get a
closer relationship with the Police Department in working with these
problem children. Mr. Smith also reported the Committee now has a to-
tal of eight (8) people.
Mr. Hixon asked the Council for an independent appraisal of the area a-
round the Brookhollow Addition. The Commission wants a full report on
whether the houses within the Brookhollow Addition are being devaluated.
Councilman Attebery moved the City hire someone for this service, duly
seconded by Councilman Knox, passed unanimously.
Mr. Hixon gave a report on the Recommendations of the Planning and Zon-
ing Commission, copies of which had been mailed to the Mayor and Council-
men. The Commission recommended that the City not get involved in a
municipal hospital. The Commission can approve Clinics but the basic
needs of the people will still not be served, the only advantage is that
it provides the doctors an assurance of income. Mr. Hixon suggested that
they get the doctors in the area together so that only one hospital would
be built. Mayor Lewis said they could not give assurance that there
would not be other hospitals (hospitals could be built in zones that are
already commercial) but could assure them that the Council would not give
a special permit. Mr. Hixon said there would probably have to be two
different kinds of hospitals, M.D.'s and D.O.'s. Councilman Attebery re-
ported Dr. Winslow, D.O. had called him and has money and land for a 25-
bed hospital. Mr. Hollin said if he has five (5) acres he can build a
clinic and hospital in one buildingr8~g yRaaq meet the City Ordinance.
The Planning and Zoning Commission/that they have a joint meeting with
the City Council and invite all of the area doctors to discuss a hospi-
tal for the area including Farmers Branch, Lewisville, Carrollton, Ad-
dison and North Dallas. The meeting was set for Tuesday, April 7.
REPORT ON LITTLE LEAGUE BASEBALL
Nolan Poovey, Director of Recreation, gave a report on the Little League
program which includes boys 8-12 years of age. He has had two men from
the Arlington Little League Organization to attend a meeting here and
help get the Organization started. They have applied for the 1959 Fran-
chise and are waiting for their reply. They now have four teams and are
expecting to have two more. They have elected the following officers
President, O. O. Bullock, Vice President, Dewayne White; Treasurer, B.C.
Pool; Secretary, Jim Gunn and Player Agent, Don Bell.
The Council members discussed lighting for a new field. Mayor Lewis sug-
gested some of them approach the Carrollton School Board for permission
to put a lighted baseball field on a school ground. Manager Orman author-

ized Mr. Poovey to get an estimate on costs of lighting a field. Council-
man Attebery asked Mr. Poovey if they could have some kind of meet at the
swimming pool during the season. Mr. Poovey said they would plan some-
thing such as an invitational swim meet and/or an out-door AAU girls div-
ing meet. He said they will have an opening splash day with intertain-
ment and also planning a big Fourth of July celebration.
PARK AND RECREATION COMMISSION
Councilman Reeder moved that the following people be appointed to this
Commission to complete the nine members: Mr. W. N. Bentsen, H. J. Heusin-
kveld, D. D. Moore, Jr., Jim T. Payne, Mrs. S. L. Dalton, Mrs. W. T.
Cloake and Mrs. Don Knox; duly seconded by Councilman Knox, passed unan.
Manager Orman said he would write letters to all members of this commis-
sion and at a very early date have a meeting with them and explain their
duties.
BOARD OF EQUALIZATION
The Council appointed the following to the above board for the coming
year: George Hixon, Chairman, Ed Rhodes, Sam Page and Oran or Truett Good
as an alternate.
FINAL PAYMENT FOR WATER MAINS
Councilman Knox moved to pass a resolution authorizing final payment to
R. S. Dickerson on his contract with the City for water mains in Brook-
hollow and Sunbeck Circle Additions, duly seconded by Councilman Attebery,
passed unanimously.
PURCHASE OF WATER MAIN FROM CITY OF DALLAS
Councilman Reeder moved the City of Farmers Branch confirm approval of
agreement to purchase the 8`° water main for $5,588.25 from the City of
Dallas along Denton Drive when that area is annexed to the City of Far-
mers Branch and take steps to service the area from Farmers Branch,
duly seconded by Councilman Knox, passed unanimously.
FIRE AND POLICE DISPATCHERS
Councilman Reeder moved that the Council confirm the approval of low
the salar~of the dispatchers for the Fire and Police De-
partment, Councilman Attebery dulysecon d passed unanimously.
ORDINANCE No. 176
Councilman Knox moved, duly seconded by Councilman Attebery and passed
unanimously an ordinance was passed abandoning a portion of Webb Chapel
Road. Caption of the ordinance reads as follows:
AN ORDINANCE OF THE CITY OF FARMERS BRANCH ABAN-
DONING A PORTION OF A PUBLIC STREET HERETOFORE
DEDICATED TO THE COUNTY OF DALLAS, AS HEREINAFTER
MORE PARTICULARLY DESCRIBED; PROVIDING THAT SUCH
ABANDONMENT SHALL BE ONLY INSOFAR AS APPLICABLE
TO THE PUBLIC RIGHT,TITLE AND INTEREST IN AND TO
THAT PORTION OF SUCH STREET BELONGING TO THE CITY
OF FARMERS BRANCH; AND DECLARING AN EMERGENCY.

REQUEST FROM MR. WEBB ROBERTS
Manager Orman read a letter from Mr. Webb Roberts requesting to have
$2,000 refunded to him. This amount was loaned to the City of Farmers
Branch. Mr. Orman was requested by the Council to check the contract
with City Attorney Louis Nichols and if the City owes the money to Mr.
Roberts to take steps to refund this amount to him.
WILLIAM E. LASSATER CLAIM
Manager Orman read a letter from Attorney Nichols advising that'the
Council acknowledge that the claim was received, reviewed and denied
by the City. Councilman Knox moved that the Council do so, duly second-
ed by Councilman Reeder, passed unanimously.
FIRE FIGHTING AGREEMENT WITH DALLAS COUNTY
Upon a motion by Councilman Reeder, duly seconded by Councilman Attebery
and passed unanimously, an ordinance was passed relative to fire fight-
ing agreement with Dallas County.
MISCELLANEOUS
Manager Orman was authorized to write a letter, requested by Bob Langdon,
expressing approval of the athletic program of the Farmers Branch Athle-
tic Association.
Manager Orman reported he is working with Carrollton on division of the
Dr. Thompson property. They are now preparing field notes. Mr. Nichols
has written a letter to Dr. Thompson on the extension of Valwood Park-
way. He offered six months rather than the 90 days that has been re-
quested. Dr. Thompson accepted, and it will be up to the City to re-
quire the right-of-way.
Manager Orman announced to the Councilmen that the following Monday night
The League of Texas Municipalities would meet at the Dallas Hotel. Dr.
Claunch of S. M. U. would be the speaker.
There being no further business the meeting was adjourned.
