MINUTES OF A CALLED MEETING
BOARD OF COUNCILMEN
FARMERS BRANCH, TEXAS
September 1, 1959
The City Council convened in a called meeting on September 1, 1959
at the Community Building at 7:30 P.M. with the following present:

The meeting was called for the purpose of discussing the results
of the public hearing on zoning which was held August 31, 1959.
Upon a motion of Councilman Attebery, seconded by Councilman Mallon,
an ordinance was passed which bore the following caption:
ORDINANCE NO. 201
AN ORDINANCE AMENDING.THE COMPREHENSIVE ZONING ORDINANCE
OF THE CITY OF FARMERS BRANCH, AS HERETOFORE AMENDED, SO
AS TO CHANGE THE FOLLOWING DESCRIBED PROPERTY FROM AN
"R-10" RESIDENTIAL CLASSIFICATION TO AN "R-2" RESIDENTIAL
CLASSIFICATION WITH A SPECIAL PERMIT FOR "OFFICE BUILDING",
SAID TRACT BEING DESCRIBED AS LOT 1, BLOCK B OF WATHENIA
PARK ADDITION AND THE FOLLOWING DESCRIBED PROPERTY FROM
AN "R-10" RESIDENTIAL CLASSIFICATION TO AN "R-2" RESIDEN-
TIAL CLASSIFICATION WITH A SPECIAL PERMIT FOR "APARTMENT
BUILDINGS", SAID TRACT BEING DESCRIBED AS FOLLOWS: LOT 1,
BLOCK A; LOTS 1 THROUGH 6, BLOCK C; AND LOTS 1 AND 2,
BLOCK D OF WATHENIA PARK ADDITION, TO THE CITY OF FARMERS
BRANCH, TEXAS; THAT SUCH PROPERTY IS TO BE USED FOR EITHER
"R-2" RESIDENTIAL PURPOSES OR UNDER A SPECIAL PERMIT FOR
OFFICE BUILDINGS AND APARTMENT BUILDINGS, SUBJECT, HOWEVER,
TO THE SPECIAL CONDITIONS HEREINAFTER MORE FULLY EXPLAINED;
THAT THE PROPERTY SHALL BE IMPROVED ACCORDING TO PLANS AND
SPECIFICATIONS SUBMITTED THEREFOR WHICH SHALL BE APPROVED
BY THE CITY COUNCIL, AND SUBJECT TO THE CONDITIONS CONTAINED
HEREIN; PROVIDING FOR A PENALTY NOT TO EXCEED TWO HUNDRED
($200.00) DOLLARS FOR EACH OFFENSE; AND DECLARING AN EMER-
GENCY.
Upon a motion by Councilman Knox, seconded by Councilman Mallon,
the following resolution was passed:

RESOLUTION
WHEREAS, the City of Farmers Branch has recently annexed an area
which is bounded on the east by the St. Louis and Southwestern
Railroad, on the south by Valley View Road and on the west by
Marsh Lane; and
WHEREAS, under the provisions of the City's Comprehensive Zoning
Ordinance, this area has been temporarily classified for "R!1"
Single-Family Dwelling purposes; and
WHEREAS, the City Planning and Zoning Commission, after conducting
a public hearing to determine the permanent zoning for said area,
has recommended that the area be zoned "L-M" Light Manufacturing
(subject to approval of development plan); and
WHEREAS, Harkey Brick and Supply Company has applied for a permit
to move a temporary office building into said area for the purpose
of conducting a building materials business.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FARMERS BRANCH, TEXAS:
SECTION 1.
That
Harkey Brick and Supply Company be granted a tem-
porary perm
it to
move a skid-mounted temporary office building onto
a tract of
land which is located in the aforementioned area.
SECTION 2.
That
this temporary permit be effective for a period
of 90 days
from
the date of its issuance.
SECTION 3. That at the end of said 90 days, Harkey Brick and Sup-
ply Company will either remove the temporary office building and
all materials pertaining to its business or will remove the tempo-
rary office building and construct a permanent building in keeping
with requirements for the development of area, all depending on the
outcome of the pending zoning hearing and the decision of the City
Council on the permanent zoning to be assigned to the area.
SECTION 4. That Harkey Brick and Supply Company signify agreement
with the above provisions by signing and returning one copy of this
resolution to the City of Farmers Branch.
SECTION 5. That this resolution take effect from and after its
passage.
Various aspects of the zoning hearing were discussed and as they
were decided upon, the changes were made on the map. Mr. Hollin
was instructed to incorporate the changes on the revised map and
present it as soon as it had been completed. Changes in the text

as they pertained to accessory buildings and child nurseries were
briefly mentioned by the City Manager and will be discussed more
in detail when the ordinance is presented for Council action.
