1957-06-17 CC MinutesMINUTES OF A REGULAR MEETING OF BOARD OF COUNCILMEN FARMERS BRANCH, TEXAS JUNE 17, 1957 The City Council met in a regular meeting at 7:30 P.M., on June 17, 1957, at the City Hall with the following present: Mayor Lawson Lewis Councilmen Thomas Reeder Janes Brodhead John Wilsey H. N. Mallon Dewayne White City Mgr. John J. Gray City Secy. Naomi Goodnight The meeting was called to order by Mayor Lewis. The invocation was brought by Rev. Roy C. Williams, Pastor of Farmers Branch Church of Christ. The minutes were then read by the secretary and approved as read. BOND PROGRAM EXPLANATION Mr. Louis Lyne, Mr. Gil Tucker, Mr. Joe Rady and Mr. Lewis Nichols were here to explain all phases of the proposed bond program. Quite a number of citizens were present and asked questions concerning the different municipal improvements the Revenue Bond Issue and the Tax Bond Issue would cover. After a complete discussion and explanation, Councilman Wilsey made a motion calling an election on the issuance of Waterworks and Sewer System Improvement and Extension Revenue Bonds, $870,000, and Tax Bond Improvements, $950,000. This motion was seconded by Councilman White. The resolution as follows: A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF FARMERS BRANCH, TEXAS, CALLING AN ELECTION ON THE QUESTION OF THE ISSUANCE OF WATERWORKS SYSTEM IMPROVEMENT AND EXTENSION REVENUE BONDS; SEWER SYSTEM IMPROVEMENT AND EXTENSION REVENUE BONDS; PARK BONDS; PUBLIC BUILDING BONDS; FIRE AND POLICE STATION BONDS; STORM SEWER BONDS AND STREET IMPROVEMENT BONDS. 67 WHEREAS, The City Council of the City of Farmers Branch, Texas, deems it advisable to issue the bonds of said City for the purposes hereinafter mentioned; and BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FARMERS BRANCH, TEXAS: 1. That an election be held in said City of Farmers Branch, Texas, on the 13th day of July, 1957, at which election the following proposi- tions shall be submitted: PROPOSITION NO. 1 1 "Shall the City Council of the City of Farmers Branch, Texas, be authorized to issue the bonds of said City in the amount of $5509000.00, maturing serially in such installments as may be fixed by the City Council, the maximum maturity being not more than Thirty Five (35) years from their date, bearing interest at a rate not to exceed Five (5%) per cent per annum, for the purpose of improving and extending the City's Waterworks System; to be issued in accordance with and secured in the manner provided in Articles 1111-1118, both inclusive, of the Revised Civil Statutes of Texas, 1925, as amended, Chapter 249, Acts of the Regular Session of the 51st Legislature and Chapter 250, Acts of the 51st Legislature, as amended by Chapter 23, Acts of the 52nd Legislature, each bond to be conditioned that the holder thereof shall never have the right to demand payment of said obligation out of funds raised or to be raised by taxation, secured by a pledge of the net revenues from the operation of the City's Waterworks and Sewer System." PROPOSITION NO. 2 "Shall the City Council of the City of Farmers Branch, Texas, be authorized to issue the bonds of said City in the amount of $320,000.00, maturing serially in such installments as may be fixed by the City Council, the maximum maturity being not more than THIRTY Five (35) years from their date, bearing interest at a rate not to exceed Five (5%) per cent per annum, for the purpose of improving and extending the City's Sewer System; to be issued in accordance with and secured in the manner provided in Articles 1111-1118, both inclusive, of the Revised Civil Statutes of Texas, 1925, as amended, Chapter 249, Acts of the Regular Session of the 51st Legislature and Chapter 250, Acts of the 51st Legislature, as amended by Chapter 23, Acts of the 52nd Legislature, each bond to be conditioned that the holder thereof shall never have the right to demand payment of said obligation out of funds raised or to be raised by taxation, secured by a pledge of the net revenues from the operation of the City's Waterworks and Sewer System." PROPOSITION NO. 4 "Shall the City Council of the City of Farmers Branch, Texas, be authorized to issue the bonds of said City in the sum of $150,000.00, maturing serially in such installments as may be fixed by the City Council, the maximum maturity date being not more than Thirty Five (35) years from their date, and bearing interest at a rate not to exceed Five (5%) per cent per annum, and to levy a tax sufficient to pay the interest as it accrues and principal as it matures on said issue of bonds, for the purpose of the construction of a public building to be used as a Community Building, as authorized by the Constitution and laws of the State of Texas." PROPOSITION NO. 5 "Shall the City Council of the City of Farmers Branch, Texas, be authorized to issue the bonds of said City in the sum of $1609000.00, maturing serially in such installments as may be fixed by the City Council, the maximum maturity date being not more than Thirty Five (35) years from their date, and bearing interest at a rate not to exceed Five (5%) per cent per annum, and to levy a tax sufficient to pay the interest as it accrues and principal as it matures on said issue of bonds, for the purpose of constructing and permanently equipping Fire and Police Stations within said City, as authorized by the Constitu- tion and lags of the State of Texas." PROPOSITION NO. 6 "Shall the City Council of the City of Farmers Branch, Texas, be authorized to issue the bonds of said City in the sum of $244,000.00, maturing serially in such installments as may be fixed by the City Council, the maximum maturity date being not more than Thirty Five (35) years from their date, and bearing interest at a rate not to exceed Five (5%) per cent per annum, and to levy a tax sufficient to pay the interest as it accrues and principal as it matures on said issue of bonds, for the purpose of the construction of Storm Sewers within said City, as authorized by the Constitution and laws of the State of Texas." PROPOSITION NO. 7 "Shall the City Council of the City of Farmers Branch, Texas, be authorized to issue the bonds of said City in the sum of $251,000.00, maturing serially in such installments as may be fixed by the City Council, the maximum maturity date being not more than Thirty Five (35) years from their date, and bearing interest at a rate not to exceed Five (5%) per cent per annum, and to levy a tax sufficient to pay the interest as it accrues and principal as it matures on said issue of bonds, for the purpose of impr6ving the streets within said City, as authorized by the Constitution and laws of the State of Texas." 2. That said election shall be held at the City Hall, within said City, and the following named persons are hereby appointed direct- ors of said election: 69 1 Delbert Moore, Jr., Mrs. Flora Rowe, Bob Whitten, Mrs. John Harrison Presiding Judge, Assistant Judge, Clerk, Clerk. 3. The said election shall be held under the provisions of Chapter 1, Title 22 of the Revised Civil Statutes of 1925, as amended, including the provisions of Article 704, as amended by Chapter 382, passed at the First Called Session of the Forty Fourth Legislature, and only legally qualified electors who own taxable property in the City and who have duly rendered the same for taxation shall be qualified to vote. 4. The ballots for said election shall have written or printed thereon the following: PROPOSITION NO. 1 "FOR THE ISSUANCE OF WATERWORKS SYSTEM IMPROVEMENT AND EXTENSION REVENUE BONDS" "AGAINST THE ISSUANCE OF WATERWORKS SYSTEM IMPROVEMENT AND EXTENSION REVENUE BONDS" PROPOSITION NO. 2 "FOR THE ISSUANCE OF SEWER SYSTEM IMPROVEMENT AND EXTENSION REVENUE BONDS" 1 "AGAINST THE ISSUANCE OF SEWER SYSTEM IMPROVEMENT AND EXTENSION REVENUE BONDS" PROPOSITION NO. 3 "FOR THE ISSUANCE OF PARK BONDS" "AGAINST THE ISSUANCE OF PARK BONDS" PROPOSITION NO. 4 "FOR THE ISSUANCE OF PUBLIC BUILDING BONDS" "AGAINST THE ISSUANCE OF PUBLIC BUILDING BONDS" PROPOSITION NO. 5 "FOR THE ISSUANCE OF FIRE AND POLICE STATION BONDS" "AGAINST THE ISSUANCE OF FIRE AND POLICE STATION BONDS" PROPOSITION NO. 6 1 "FOR THE ISSUANCE OF STORM SEWER BONDS" "AGAINST THE ISSUANCE OF STORM SEWER BONDS" 70 PROPOSITION NO. 7 1 1 D "FOR THE ISSUANCE OF STREFT IMPROVEMENT BONDS" "AGAINST THE ISSUANCE OF STREET IMPROVEMENT BONDS" 5. A substantial copy of this resolution signed by the Mayor of said City and attested by the City Secretary shall serve asproper notice of said election. Notice shall be given in accordance with Article 704, Revised Civil Statutes of 1925, as amended by Chapter 382, passed at the First Called Session of the Forty Fourth Legislature, supra. The Mayor is authorized and directed to have a copy of said notice posted at the City Hall and at two other public places within said City not less than fifteen days prior to the date fixed for holding said election. There being no newspaper published within this City, the Mayor shall cause said notice to be published on the same day in each of two successive weeks in the"Farmers Branch Times", a newspaper published within Dallas County, and having a general circulation in the City of Farmers Branch. The date of the first publication shall be not less than fourteen days prior to the date set for said election. Except as otherwise provided in said Article 704, as amended, the manner of holding said election shall be governed by the laws governing general elections. UNDERWOOD COMPANY FINANCIAL AGENTS On a motion by Councilman Reeder, seconded by Councilman Brodhead, the R. A. Underwood Company was approved as the financial agents for the City of Farmers Branch in the bond election; and the Fiscal Agency Contract was signed. DOG LEASH LAW ORDINANCE #134 On a motion by Councilman Mallon, seconded by Councilman Wilsey, the Council approved Ordinance #134 which is the dog leash law. Under this law, dogs over six (6) months old must be vaccinated and tagged and it will be illegal to allow any dog to run at large in the city limits. GRASS & WEED ORDINANCE #135 The grass and weed ordinance #135 makes it llegal to let grass and weeds grow over twelve (12) inches high; high weeds must be cleared after cutting. This motion to accept Ordinance #135 was made by Councilman Mallon, seconded by Councilman Wilsey. TRUST INDENTURE REPORT, T.R.A. The Council heard a detailed report on the trust indenture on the Trinity River Authority's proposed sewage system which was presented by City Engineer Joe Rady, City Attorney Louis Nichols, and Manager Gray. SEWER CLEANING EQUIPMENT The Council authorized the purchase of sewer cleaning equipment to cost $5,124.00. This motion was made by Councilman Mallon, seconded by Councilman White. ELECTRIC MEMEOGRAPH MACHINE On a motion by Councilman Mallon, seconded by Councilman White, the Council authorized the purchase of an electric mimeograph machine at $220.00. FEDERAL DISASTER AID The Council authorized Mayor Lawson Lewis to sign application for Federal Disaster Aid. The resolution is as follows: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FARMERS BRANCH, TEXAS: That the Mayor be; and he is hereby authorized to execute for and, in behalf of the City of Farmers Branch Applicationsto the Governor of the State of Texas for certain Federal financial assistance as set out in the United States Law #875. EMPLOYEES' VACATION TIME The Council approved on a motion by Councilman White, seconded by Councilman Mallon, a new vacation schedule for city employees., VACATION TIME PER YEAR Employees on 5 day week will be allowed 10 working days of vacation. Employees on 52 day week will be allowed 11 vacation days. Employees on 6 day week get 12 days. There being no further business, the meeting adjourned. City Secretary 1 [i 73
