1958-03-24 CC MinutesMINUTES OF A SPECIAL MEETING BOARD OF COUNCILMEN FARMERS BRANCH, TEXAS MARCH 24,s 1958 1 The City Council met in a special meeting on March 24, 1958 at the City Hall at 7:30 P. M. for a public hearing for rezoning several pieces of property. The following were present: Mayor Councilmen City Manager City Secretary City Planner Lawson Lewis Thomas Reeder 4ohn Wilsey Dehrayne White Oley Attebery John Gray Naomi Goodhight Bob Hollin Mayor Lewis called the meeting to order. Councilman Wilsey brought the 1 1 invocation. H. D. LEWIS PROPERTY Mr. H. D. Lewis had made application for zoning change from single family class- ification R-10 to single family R-7.5. The planning and zoning commission's reccm- mendati.on was that this request be denied. The council denied the request on a motion by Councilman Attebery, seconded by Councilman White, after no one appeared to speak for or against. The vote was unanimous. MRS. DACE KELLY Mrs, Cxrace Kelly had made application for zoning change from R-16 to MR (multiple-res.) at 2557 Havenhurst. The planning and zoning commission's recomnen- dationwas that this request be denied. The council denied the request on a motion by Councilman Wilsey, seconded by Councilman Reeder, after Mayor Lewis asked for opinions from the floor. No one spoke for or against. The vote to deny was unanimous. DR. HFRU SPIVEY Dr. Henry Spivey had made application for zoning change from R7.5 to Commercial zoning classification to permit construction of a service station on lot 23, Block C on Valley View and Wilmington. The planning and zoning counission's recommendation was that this request be denied. Mayor Lewis asked for comments from the floor. Dr. Spivey objected to the denial. Mrs. Wells, Mrs. Maxwell and Mrs. Wallace approved the denial. After studying the request, the council denied the zoning change on a motion by Councilman Wilsey, seconded by Council Reederon the grounds that business activity would be detrimental to the adjoining residential property and would be 121 in violation of the deed restriction in affect on the Farmersdell Addition. The de- nial vote was unanimous. LE6NON A 2 E BAPTIST CHURCH Rev. D. L. Wadley, pastor of the Le mm Avenue Baptist Church had made applica- tion for a special permit for a clinic and hospital at 13565 Webb Chapel Rd. This property is now zoned R-16. The planning and zoning commission's recommendation was to approve the request subject to several conditions. Mayor Lewis asked for comments from the floor. Those opposing the change were Mr. and Mrs. Bobby Jack McCord, Marilyn Brooks Cox, Mr. and Mrs. William S. Crutchfield qr., Mr. and Mrs. Jack Maner, and Mrs. R. B. Howard. TNeir protest was that a clinic would lower the value of their property, increase traffic too much on Webb Chapel Road, property would have no resale value, and that a clinic should be in a shopping center. Mr. Bob Hamm spoke for the clinic stating that a clinic was needed very much in that area and that his belief was it would not,ra hazard of any kind. After the council heard from everyone interested in this special-peMkt, they voted for approval of the request for a special permit for a clinic only subject to the following conditions; 1. The development shall be generally in conformance with the site plan as approved by the City Planning Commission and attached to the ordinance and made a part of the ordinance. 2. That parking shall be provided at the minimum ratio of one space for each 250 sq. ft. of building area with a minimum five spaces and that no parking shall be permitted beyond the front building line. 3. That all means of engress and egress to the property shall be approved by the City Planning Commission and that the provision of a circular drive within the required front yard shall be prohibitAd and that no loading or un- ICadirgof vehicles or parking be permitted in the front yard as required. 4. Thab the minimum set back shall be 75' from the new right-of-way line of Webb Chapel Road and that no structure or portion of the main building shall extend into this required yard. 5. That in the event construction is not started on this clinic within a six-month time period from the date of this ordinance, the property shall be utilized onltr for those uses permitted in the single family zoning classification. 6. The architecture of the proposed building shall be in conformance with the prospective submitted with the application and the architecture shall be of a residential character so as to blend harmoniously with the deve- lpoment found on nearby properties. 7. Tha* the required right-of-way for the widening of Webb Chapel Road to. 122 major thorough.,fare standards be provided prior to the passage of this ordinance and the approval of any building permits. 8. That the clinic use intended for this property does not permit the sale of pharmaceutical products or drugs, the maintenance of facilities for overnight and bed patients, and especially prohibits hospitil use and pharmacy. 9. That a sign with a maximum area of 12 sq. ft. shall be permitted within the required front yard, but not closer than 25' to the new right-of-way line of Webb Chaple Road. This sign shall not be illuminated nor have flashing or intermittently lighted features associated with it. 1O.The proper screening shall be provided where deemed necessary by the City Planning Commission for the protection to the properties on the opposite side of the street as well as those adjoining and abutting the site in question. The motion to grant the church request was made by Councilman Wilsey, second- ed by Councilman Reeder. Councilmen Reeder, Wilsey and White voted for the request. Councilman Attebery did not vote because of living in that area. CATO_CORP Mr. L. J. Hexter had made application for the Cato Corp. for a change of zoning from R-10 single family residential to MR multiple family residential. Tract of land 33 acres north of ©alwood Pkwy and east of Josey. The planning and zoning commission's recommendation was that this request be approved subject to the following conditions: 1. That development shall be generally in conformance with the approved site plan attached to the ordinance and made a part thereof. 2. That the density of the project be limited to a maximum 450 units. 3. That the size of the units range between 450 sq. ft. to 750 sq. ft. or more per unit, so as to permit the proper distribution of luring accommodation sizes required in such a protect. 4. That the construction of the project be brick and that the deed restrictions which will be placed on the property controlling the development be submitted to the City Planning and Zoning Commission for consideration and approval prior to the issuance of any building permits. 5. That requirements pertaining to treatment of the area adjacent to open drainage ditch be withheld until such time as recommendations are made by the city's engineering the drainage aspects of the development and their recommendations as to their most desirable treatment to avoid erosion and washout and other damages caused by the water carried in this drainage ditch. 6. That the proposed street be paved 40' wide and to city specifications. 7. That all drainage structures, parking areas, and service drive surfaces 123 shall be installed at the developer's expense and in accordance with the requirements of the city. Screening on the North line of property - subject to Commission's recom- mendations 6' fence or wall or shrubbery. Mayor Lewis asked for comments from the floor. r. Donald Erickson asked about transporation problems and schools for the families in this apart- ment area. Mr. Hexter explained that this would be developed as the town needed it. The council then approved this zoning change with the recommended conditions listed above by motion made by Councilman White, seconded by Councilman Attebery. The vote was unanimous. CIVIL DEFENW - HOME EMERGENCY CORP By request made by Civil Defense Director Sam. Page, the council appointed Mrs. W. M. Goodwin as Director of the Home Emergency Corp. on a motion by Councilman Attebery, seconded by Councilman Reeder. There being no further business, the meeting adjourned.
