1953-06-13 CC MinutesTHE STATE OF TEXAS COUNTY OF DALLAS CITY OF FARMERS BRANCH On this the 13th day of June, 1953, the City Council of the City of Farmers Branch, Texas, convened in called meeting, at the regular meeting place with the following members thereof, to wit: Lawson Lewis, Mayor, J. W. Culpepper, H. N. Mallon, Aldermen, R. J. Knight, Edward N. Kerr, City Secretary, being present, with the following absent: B. A. Marcom and Thomas Reeder, constituting a quorum, at which time the following proceedings were had: Alderman Culpepper introduced a resolution and made a motion that it be adopted. The motion was seconded by Alderman Mallon. The motion carrying with it the adoption of the resolution prevailed by the following vote: AYES: Aldermen Culpepper, Mallon, Knight and Mayor Lewis. NOES: None. The resolution as adopted is as follows: RESOLUTION BY THE CITY COUNCIL OF THE CITY OF FARMERS BRANCH, TEXAS, CANVASSING RETURNS AND DE- CLARING RESULT OF AN ELECTION ON THE QUESTION OF THE ISSUANCE OF $400,000.00 WATERWORKS IMPROVEMENT AND EXTENSION BONDS AND ON THE QUESTION OF THE ISSUANCE OF $100,000.00 SEWER IMFROVE~ENT AND EXTENSION BONDS. WHEREAS, heretofore on the 26th day of May, 1953, the City Council of the City of Farmers Branch, Texas, adopted a resolution calling an election to be held in said City on the 13th day of June, 1953, on the following propositions: PROPOSITION NO. 1 "Shall the City Council of the City of Farmers Branch, Texas, be authorized to issue the bonds of said City in the amount of $400,000.00, maturing serially in such installments as may be fixed by the City Council, the maximum maturity being not more than Thirty (30) years from their date, bearing interest at a rate not to exceed Five (5%) per cent per annum, payable annually or semiannually, and to levy a tax sufficient to pay interest as it accrues and principal as it matures on said issue of bonds, for the purpose of improving and extending the City's Waterworks System, as authorized by the Constitution and laws of the State of Texas." PROPOSITION NO. 2 "Shall the City Council of the City of Farmers Branch, Texas, be authorized to issue the bonds of said City in the amount of $100,000.00, maturing serially in such installments as may be fixed by the City Council, the maximum maturity being not more than Thirty (30) years from their date, bearing interest at a rate not to exceed Five(5%) per cent per annum, payable annually or semiannually, and to levy a tax sufficient to pay interest as it accrues and principal as it matures on said issue of bonds, for the purpose of improving and extending the City's Sewer System, as authorized by the Constitution and laws of the State of Texas". and WHEREAS, said election was duly held at the time and place specified after due notices as required by law had been given by posting and publication: and WHEREAS, there were cast at said election the following votes : PROPOSITION NO, _1 "FOR THE ISSUANCE OF WATE13WOR.KS IMPROVEMENT AND EXTENSIO'• BONDS" 58 Votes; "AGAINST THE ISSUANCE OF WATERWORKS IMPROVE- MENT AND EXTENSION BONDS" 11 Votes. PROPOSITION NO. 2 "FOR THE ISSUANCE OF SEWER IMPROVEMENT AND EXTENSION BONDS". ~7 Votes; "AGAINST THE ISSUANCE OF SEWER INPROVEMENT AND EXTENSION BONDS" 11 Votes, as it reflected in the election returns heretofore filed with the City Secretary; and 1 WHEREAS, only qualified taxpaying voters owning taxable property in said City and who had duly rendered their property for taxation were allowed to vote; BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FARMERS BRANCH, TEXAS : 1. That said election was duly called; that notice was 1 1 given in accordance with law and in accordance with the resolution calling the election; that the election was held in accordance with law; that the return of said election has been made by the proper officers; that a majority of the qualified voters who own taxable property in said City and who have duly rendered the same for taxation voting at said election have voted in favor of the issuance of said bonds. 2. That the City Council be and it is hereby in all things authorized, ordered and directed to issue said bonds and to do any and all things necessary or convenient in connection therewith. Texas THE STATE OF TEXAS ; COUNTY OF DALLAS CITY OF FARMERS BRANCH : I, the undersigned, City Secretary of the City of Farmers Branch, Texas, do hereby certify that the above and foregoing is a true, full and correct copy of a resolution adopted by the City Council of the City of Farmers Branch, Texas, (and of the minutes pertaining there- too on the 13th day of June, 1953, canvassing returns and declaring result of an election on the question of the issuance of $400,000,00 Waterworks Improvement and Extension Bonds, and on the question of the issuance of $100,000.00 Sewer Improvement and Extension Bonds, which resolution is of record in the minutes of said City Council.
