City attorney, Jim lanchette, was present.
CITY POLICE FF'~RT'~°TT:
Everett H olt, City `Tarshall, and his deputies met with the Council
to discuss the tic1,ets being written. ?14r. Holt reported that he had
some jZoTnplai~ts fro- different citizens about the department. The
Council agreed that those who speed should be given tickets.
It was suggested ':hat signs reading "Officers on Duty, Speed
La.,rs Enforced." These si~Ms would ?-e put at all four City Limits,
North, Fast, Soul h, and 'Test.
The City Council a=end to buy shgIis as the deputies needed
them, and 20 gallons of -asoline per month for each. This motion
was made by H LT. 'lall.on, seconded by Thomas Reeder. It was
voted to rei-burse Rob Cobb for the installation of red lights on
his car.

TIr. "arvin Springer, planning engineer for the City of Dallas
agreed to come out to Farmers Branch, every other Saturday morning
and make recommendations in changing parts of the city's zoning

ordi-ante. He wanted only to pay for the 'naps he will use.

zoning ordinance until it could be changed. The motion was by H.

Mx. Moore net with the Council to discuss the garbage pickup
service for the City. It was agreed that the first two months would
be on a trial basis. The east part of town would all be picked up
and the north, south, and west parts of town would re ?sir. Moores t

A motion was made by 'T'homas Reeder seconded by H. N. Mballon,
to hire some one to help Lyman Goodnight five and one-half days
per week. Unanircus approval by the Council.

The motion to purchase new t~,x s`latements for this year, was
made by R. J. Knight, seconded by Thomas Reeder. The Council voted
their approval.

The Council discussed several men to serve on the equalization
board for this year. These men will be contacted and appointed
later.

past her property so she would have access to the back of her
property to build a pre-school buildin_;. 'Ir. Lewis was to talk

the notion to accept "r. rlanchette's proposal. This was seconded
by J. `J. Culpepper. Unanimous approval by the Council..

e as Power and Light Co. has a franchise on electric service
here from 1946 for 25 years. This Company has asked for another
15 year extension. There is no way for the people to have to pay
highi:r rates. The Council. recommended the City Attorney check
into this offer.

The current bills were in the amount of 657.02. A motion
to ray these bills was made by P. 1. 'larcom, seconded by Thomas
Reeder. Unanimous approval by Council.

was passed by the City Council of the City of Farmers Branch,
Texas, establishing policies rol9tin, to the construction and
installation by the City of Farmers Pranch, Texas, of waterworks
and sanitary sewera;e facilities and/or extensions and betterments
when same are re-iuested by a rrivate Individual, fire or corporation
and same are within the city li-its of the City of Farmers Branch,
Texas: Fstablishin; a procedure for the initiation, financing
and construction and installation of s-iid faci-ities and/or
extensions and betterments; regulation desi.-n, construction and
installation of such; providing for the reimbursement to a private
individual, firm or corporation of monies deposited with the City
of Farmers Branch, Texas, for the said construction and installa-
tion at zero interest rate and in a manner not in conflict with
the provisions of the 1951 bond ordinance, and repealing all
ordinances in conflict herewith, reference to which is here made
for all purposes; and

Farmers Branch, Texas, to amend said ordinance to cancel all
refunds and reirbursements to nrivate individuals, firms or
corporations of monies deposited after the date of this amendment,
to protect the interests of the City of Farmers Branch, Texas;

OF FAR' ERS RRA!TCH, TEXAS:
(1) That Parayraphs No, 1 and No. 11 of said ordinance

above described he and the same are hereby amended to read
as follows:
■ 111. The City Council of the City of Farmers
Branch, Texas, will consider the proper application
of a private individual, firm or corporation that
waterworks and/or sanitary sewerage facilities
and/or extensions or betterments to the existing
waterworks and sanitary sewerage systems be constructed
and installed by the City at the direct
cost of the applicant, and subject to the terms and
conditions hereinafter set out in this ordinance.
No reimbursement of direct costs shall be made to
applicant.
"II. Said instrument of agreement shall incorporate
either verbatim or by reference the following terms
and conditions:
(a) The work to be done shall cr-nform to the
standards and specifications of the City of Farmers
Branch and the standards and requirements of the
Texas State Board of Health.
(B) In the event the total cost is under the total
of funds deposited in excrow and actually incorporated
in the funds of the City of Farr,ers i-Branch, the
difference less chargeable tapping and connection
fees, shall be rebated to the applicant upon accept-
ance of the work done by the City.
(c) Total co&t is defined as including the follow-
ing items of cost and no other:
1. Preliminary engineering ex ense directly
bearing on the construction and installation
within the scope or revised scope of the app-
lication. This shall not be construed to mean
promotional or development expenditures nor
engineering expense necessarily incurred in
platting, plannin„ or design rut extraneous to
the renuested construction and installation un-
less same are incurred -t the direct reauest of
the City Council in connection with clarifica-
tion or revision of the application or for
si ilar reasons the City itself, after consult-
ation with the applicant, undertakes such
necessary expense. Generally preliminary
engineering expense shall be regarded as such
expense incident to the preparation of the
application and unnecessary otherwise. Expenses
of a preliminary nature presenting doubt as to
proper inclusion in the total cost for reimburse-
ment shall be validated by the City Council be-
fore being included in the total cost as defined.

2. Total contract cost of constructirn and
installation as authorized by the City Council.
3. Engineering fees on the contract cost of
construction and installation as authorized by
the City Council.
4. Legal and administrative costs of the City
of Farmers Branch, Texas, directly bearing on the
project as included in the app-oved applica-
tion, such as advertising for bids, inspection.
"(d) If the bids as received indicate a final total
cost inexcess of funds in escrow, the applicant
shall deposit additional funds to cover the
anticipated deficit or the project shall be
abandoned. The City of Farmers Branch, Texas, shall
not be held liable for such abandonment but shall
be compensated out of the funds deposited for any
expenses directly incurred up to date of abandon-
ment.

within public right of way lines or easements,
shall, upon certification of co-iletion and a,-proval
of construction and installation by the City of
Fanners Branch, Texas, through its lawful represen-
tatives, beco-e the property of the City of Farmers
?ranch, Texas, and the City binds -r(? rn' ,ates
itself to rain Lain and operate t : facilities con-
structed and installed as integ-al. parts of the
existing; waterworks and sanitary sewerage systems."
(2) This amendment shall not affect the existing
vested contractual rights of individuals, firms or
corporations to reimbursement of funds already
deposited prior to date of this amendment under
said ordinance of march 11, 1952.
