1955-05-01 CC MinutesMINUTES OF A SPECIAL MEETING OF BOARD OF ALDERMEN FARMERS BRANCH, TEXAS JUNE 1, 1955 The Board of Aldermen met in a special meeting on June 1, 1955, at 7:30 PM, at the City Hall with the following present: Mayor Lawson Lewis Aldermen Thomas Reeder R. J. Knight J. W. Culpepper B. A. Marcom RESOLUTION ,#202 On a motion by Mr. Marcom, seconded by Mr. Reeder, the Council accepted the resolution known as Resolution 202 which is as follows: RESOLUTION NO. 202 WHEREAS, by a resolution heretofore passed by the City Council of the City of Farmers Branch, all that portion of the following street: Josey Lane from Valley View Lane to Richland Avenue shall be improved by curbing; and, WHEREAS, by the terms of said resolution, specifications were ordered to be made by the Building Official, for the improvement of said street, as provided by said resolution; and, WHEREAS, the said specifications have been prepared and are now submitted to the City Council for approval and adoption; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FARMERS BRANCH: SECTION 1. That the specifications so presented to the City Council of the City of Farmers Branch by the Building Official and prepared by him for the improvement of said street enumerated above, as hereinbefore defined, having been carefully considered by the City Council, be, and the same are hereby approved and adopted as the specifications for the improvement of the said street. SECTION 2. The City Council, in initiating this proceeding, is acting under the terms and provisions of the Act passed at the First Called Session of the Fortieth Legislature of the State of Texas, and known as Chapter 106 of the Acts of said Session, together with any amendments thereto, now shown as ARTICLE 1105b of Vernon's Texas Civil Statutes. SECTION 3. That this resolution shall take effect from and after its passage. Passed this 1 day of June a , 1955• Lawson Lewis Mayor, City of Farmers Branch, Texas RESOLUTION #203 On a motion by Mr. Reeder, seconded by Mr. Culpepper, the Council accepted Resolution #203 which is as follows: RESOLUTION NO. 203 WHEREAS, the City Council of the City of Farmers Branch is of the opinion that it is necessary to levy an assessment against the property and the owners thereof abutting upon the following: Josey Lane from Valley View Lane to Richland Avenue, and direct the City Secretary to give notice of said hearing, as required by law; and, WHEREAS, the City Council has heretofore, by resolution, ordered the improvement of the street enumerated above, by curbing said street on both sides with 6-inch height roll-type integral curbs; with standard 6-inch thickness reinforced concrete drive approaches where homes and drives now exist, and any existing curbs or gutters in place, meeting these specifications, or which can be utilized, shall be left in place, if any, and corresponding credits to the property owners shall be allowed on the assessments; and, WHEREAS, the Building Official of the City of Farmers Branch has, in accordance with the law, filed his report with the City Council, setting forth the participation by the property owners, in the cost thereof, to- gether with the names of the owners and the description of said property, and the work to be done adjacent thereto, and the amounts to be assessed against each lot or parcel and its owner and all other matters required by the applicable law; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FARMED BRANCH: SECTION 1. That the report or statement filed by the Building Official having been duly examined is hereby approved. SECTION 2. That it is hereby found and determined that the cost of improvements on the hereinafter secribed street, with the amount or amounts per front foot proposed to be assessed for such improvements against abutting property and the owners thereof are as follows, to-wit: Josey Lane from Valley View Lane to Richland Ave. to be improved with a standard 6" height roll type integral curbs and gutters. Rasberry " 123.00 168.51 168.51 Josey Lane from Valley View land to Richland Street TOTAL PROPERTY OWNER'S COST - ASSESSMENTS $5,212.07 TOTAL COST OF IMPROVEMENTS $5.,212.07 All assessments, however, are to be made and levied by the City Council as it may deem just and equitable, having in view the special benefits in enhanced value to be received by such parcels of property and owners thereof, the equities of such owners, and the adjustment of the apportionment of the cost of improvements so as to product a substantial equality or benefits received and burdens imposed. SECTION 3. That a hearing shall be given to said owners of abutting property, or their agents or attorneys and all persons interested in said matter, as to the amount to be assessed against each owner and his abutting property and as to the benefits to said property by reason of said improvement, or any other matter or thing in connection therewith, which hearing shall be held in the Town Hall of the City of Farmers Branch, County of Dallas, on the 16 day of June, 1955, at 0 o'clock P.M., at which time all the said owners, their agents or attorneys or other interested persons are notified to appear and be heard, and at said hearing said owners and other persons may appear., by counsel or in person, and may offer evidence, and said hearing shall be adjourned from day to day until fully accomplished. _1 7 The City Secretary of the City of Farmers Branch is hereby directed to give notice of the time and place of such hearing and of other mat- ters and faats in accordance with the terms and provisions of the Act passed at the First Called Session of the Fortieth Legislature of the State of Texas, and known as Chapter 106 of the Acts of said Session, together with an y amendments thereto, now shown as Article 1105 B of Vernon's Texas Civil Statutes. Said notice shall be by advertisement inserted at least three times in a newspaper published in the City of Dallas, Texas, the first publication to be made at least ten (10) days before the date of said hearing. Said notice shall comply with and be in accordance with the terms and provisions of said Act. Although not required by law, the City Secretary is hereby further directed to give notice of said hearing by mailing to said owners, their agents or attorneys, a copy of said notice by registered mail, deposited in the Post Office at Farmers Branch, Texas, ten (10) days prior to the date of said hearing, provided, however, that any failure of the City Secretary to mail said notice, or any failure of the property owners to receive said notice, shall not invalidate these proceedings. SECTION 4. That this.resoltLtion shall take effect from and after its passage. Passed this _1 day of June , 1955. The hearing notices are to be mailed on the 6th of June, 1955. 3 /4 TON TRUCK The Council approved the purchase of a 3/4 ton truck from Huffines Motor Company, who was the low bidder.
