West John Boyle J. W. Wade Sherry Walden Ruth Ann Parish Mayor Binford called the City Council meeting of July 2, 1979 to order at 7:30 P.M.. AGENDA ITEM NO. A.1-INVOCATION. Councilman Johnson gave the invocation. AGENDA ITEM NO. A.2-APPROVAL OF MINUTES After some consideration, a motion y Councilman Dodd, a second by Councilman Ouevreaux, all voting "aye", approved the minutes of the Regular Meeting of June 18, 1979 and the Special Meeting of June 26, 1979. AGENDA ITEM NO. B.1-PRESENTATION OF SERVICE AWARD. Mr. Domingo Romero o the Sanitation Division wi 1 be presented a ten year service award at a later date because he was out of the city on this date. AGENDA ITEM NO. B.2-PRESENTATION OF BOARD APPLICATIONS TO CITY COUNCIL. Mayor Binford stated that this item is placed on the agenda of each meeting in order to give anyone who would like to serve on an advisory board or commission an opportunity to meet and address the City Council. No one was present. AGENDA ITEM NO. B.3-PRESENTATION OF SLIDE PROGRAM. Fire Chief R. L. Yager presented a slide program explaining the functions and operations of the Fire Department. Vol. 31, Page 54. AGENDA ITEM NO. C.1-DISCUSS CITY BUS SYSTEM. REOUESTED BY STEPHEN PE Mr. Pegues was not present to discuss this item as he had requested. AGENDA ITEM NO. C.2-CONSIDER PROPOSAL FROM MR. CLARENCE COCKRELL OF SALIN CORPORATION FOR THE PAVING OF A PORTION OF SPRING VALLEY' ROAD FROM DENTON DRIVE EAST APPROXIMATELY 300 FT. AND DRIVEWAY ACCESS ONTO SPRING VALLEY ROAD FROM PROPERTY BEING DEVELOPED IN CARROLLTON. Mr. Clarence Cockrell and his son, Chris were present and presented a request for access to their property in Carrollton from Spring Valley Road. The property is located entirely in the city limits of the City of Carrollton. Spring Valley Road is located entirely in the city limits of the City of Farmers Branch. Mr. Cockrell explained that he would like to develop his 3.64 acre tract located on the northeast corner of Spring Valley Road and Denton Drive. Three warehouse building sites are proposed on this tract. Mr. Cockrell explained of being unsuccessful in obtaining access to his property from Denton Drive across the railroad tracts. Mr. Cockrell stated that he would be willing to pave a 24' concrete section within the existing 25' right-of-way along the length of his property to provide better access off Spring Valley Road. A discussion was held between members of the City Council and Mr. Cockrell relating to the use of the existing street by the residents facing Valwood Parkway; the addition of traffic if commercial or industry developments opened onto Spring Valley; constructing the street to a normal 50' street; dedication of an additional 25' right-of-way by Mr. Cockrell along his property; and of the railroad company not giving permission for access across the rail- road tracts. City Attorney John Boyle explained that the City of Carrollton, if desired, has the ability to pursue an access by extending Denton Drive across the railroad right-of-way as part of the city's over- all road program. After more discussion of seeking access to the property from Denton Drive, a motion by Councilman Quevreaux, a second by Councilman Dodd, all voting "aye", denied the request presented by Mr. Cockrell. AGENDA ITEM NO. C.3-CONSIDER REOUEST FROM FARMERS BRANCH LIONS CLUB. Mr. Ron Shap of the Farmers Branch Lions Club requested approval to enter iti-to a joint venture with the City of Farmers Branch to cooperate in the construction of a section of Oran-Good Park for a playground for the blind, handicapped and normal citizens of the City. He stated that the Lions Club shall furnish the funds to purchase the materials consisting of but not limited to: childrens playground equipment, water fountains, lighting, pathways, signs, picnic tables and landscaping. Funds are to be contributed on an annual basis. The purchase of materials will be as funds allow. Vol. 31,Page 55. After some discussion, a motion by Councilman Dodd, a second by Councilman Quevreaux, all voting "aye", approved the request of the Farmers Branch Lions Club to contribute funds on an annual basis for a playground on Oran Good Park. AGENDA ITEM NO. C.4-CONSIDER REQUEST FOR TEMPORARY USE OF CIVIC OR PHILANTHROPIC NATURE BY THE FARMERS BRANCH LIONS CLUB. A motion by Councilman Dodd, a second by Councilman Quevreaux, all voting "aye", adopted Resolution No. 79-011 granting permission for the Farmers Branch Lions Club to place a sign on Oran Good Park to help advertise their commitment to raise funds for a playground on the park. AGENDA ITEM NO. C.5-CONSIDER REOUEST FROM MR. GARY RICH TO ENTER INTO CONTRACT WITH THE CITY FOR THE PAINTING OF ADDRESSES ON CURBS. In ormation: Ordinance No. 980 requires that any person or group desiring to paint addresses on curbs must enter into a contract with the City, which shall be negotiated with the Director of Public Works. It has been the policy of the City Council that such contracts would be granted only to non-profit groups. Mr. Gary Rich and Mr. Randahl Sullivan presented a request to enter into a contract with the City for the painting of addresses on curbs. This proposed contract would extend through September 30, 1979, and would be for private profit. The fee charged would be $3.95 for a single set and $5.95 for two sets of numbers, and 2% of gross receipts would be paid to the City for inspection costs. The color coordination will be white on red. Mr. Rich described the procedure of painting the numbers on the curbs. After some discussion, a motion by Councilman Ouevreaux, a second by Councilman Weidinger, all voting "aye", authorized the City Manager to enter into a contract with Mr. Gary Rich and Mr. Randahl Sullivan for the painting of addresses on curbs. AGENDA ITEM NO. D.la -D.1L- CONSENT ITEMS. A motion by Councilman Johnson, a second by Councilman. Haggerty, all voting "aye", approved Agenda Consent Items D.la through DAL. The items approved are as follows: a. A final plat of Northbelt Business Center located at the southwest intersection of Beltwood Parkway and Beltwood Parkway South. b. A final plat for street right-of-way dedication of Valwood Center located adjacent to the north right-of-way of Valwood Park- way just west of Interstate Highway 35E. C. Authorized the City Manager to enter into a Developers' Contract with L. S. Thompson, Jr., ET AL, for the Valwood Center ' Addition., and accepted a Hold Harmless Agreement. Vol. 31. Page 56. d. Adopted the following captioned Ordinance No. 1256, pro- hibiting trucks on Golfing Green Drive from Webb Chapel Road to Brookhaven Club Drive: AN ORDINANCE OF THE CITY OF FARMERS BRANCH, TEXAS, PROHIBITING TRUCKS OR TRAILERS EXCEEDING MANUFACTURER'S RATED CARRYING CAP- ACITY OF 3/4 TON ON GOLFING GREEN DRIVE BETWEEN WEBBS CHAPEL ROAD AND BROOKHAVEN CLUB DRIVE, PROVIDING FOR EXCEPTIONS; PROVIDING FOR INSTALLATION OF SIGNS; PROVIDING A PENALTY CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND DECLARING AN EMERGENCY. e. Adopted the following captioned Ordinance No. 1261, amending the sign ordinance: AN ORDINANCE OF THE CITY OF FARMERS BRANCH, TEXAS, AMENDING THE CODE OF ORDINANCES OF THE CITY OF FARMERS BRANCH AS HERE- TOFORE AMENDED, BY AMENDING SECTION 3-38, EXCEPTIONS TO ARTICLE; BY ADDING EXCEPTION NUMBER 13 TITLED "TEMPORARY GASOLINE FLAGS"; PROVIDING A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE; AND DECLARING AN EMERGENCY. MAYOR BINFORD ANNOUNCED THAT THE ITEMS ON THE AGENDA FOR THE GENERAL SESSION HAVE BEEN CONCLUDED. AFTER A SHORT RECESS THE COUNCIL MEETING WILL RECONVENE FOR ITEMS IN THE EXECUTIVE SESSION. THE MEETING WILL RECONVENE INTO GENERAL SESSION AFTER THE ITEMS HAVE BEEN DISCUSSED IN THE EXECUTIVE SESSION. ARTICLE 6252-17, OF THE OPEN FETING LAW PROVIDES THAT SUCH ITEMS AS PERSONNEL MATTERS, LAND ACQUISITION AND PENDING AND CONTEMPLATED LITIGATION MAY BE DISCUSSED IN CLOSED SESSION. AGENDA ITEM NO. E.1-EXECUTIVE SESSION. An Executive Session was held relating to discussions of personnel matters. THE MEETING WAS RECONVENED INTO GENERAL SESSION. AGENDA ITEM NO. E.2-ACTION ON PERSONNEL MATTERS DISCUSSED IN THE EXECUTIVE SESSION. A motion by Councilman Haggerty, a second by Councilman Johnson, all voting "aye", elected Councilman Dodd to make a report on the Parks and Recreation Board and report back to the Council. A motion by Councilman Johnson, a second by Councilman Haggerty, all voting "aye", removed Jack Vickers.from the Zoning Board of Adjustments and Building Code Board of Appeals, since the meeting dates of the board interfered with his work schedule. AGENDA ITEM NOS. E.3 & E.4 -NO NECESSARY ACTION TAKEN. AGENDA ITEM NO. F.1-ADJOURNMENT. A motion by Councilman Quevreaux voting "aye", adjourned the City at 8:42 P.M..
