MINUTES OF A REGULAR. MEETING
January 3, 1977
Members of the City Council present were:

Member of the City Council absent was:
Councilman W. R. Linn
Councilman Linn's absence was recognized as an excused absence because
he was out of town on business.
The following members of the City Administration were present:
City Manager Paul M. West
City Attorney Doug McCallon
City Secretary J. W. Wade
Director of Staff Services Glenn Moore
Secretary Ruth Ann Parish
Mayor Grimmer called the City Council meeting of January 3, 1977 to
order at 7:30 p, m. .
AGENDA ITEM NO. 1. -INVOCATION.
Glenn Moore gave the invocation.
AGENDA ITEM NO. 2. -APPROVAL OF MINUTES
After some consideration, a motion by Councilman Dodd, a second by
Councilman Johnson, all voting "aye", approved the minutes of the City
Council meeting of December 20, 1976, as submitted.
AGENDA ITEM NO. 3. -PRESENTATION OF MERITORIOUS AWARD.
Mayor Grimmer presented a Meritorious Service Award to Zenaida Yoingco
for actions resulting in the saving of a fellow student from serious burns by
extinguishing a fire in the student's hair and clothing on December 7, 1976.

AGENDA ITEM NO. 4. -CONSIDER. ORDINANCE PROHIBITING CERTAIN
BUSINESSES WITHIN SPECIFIED DISTANCE OF CHURCHES, SCHOOLS,
RESIDENTIAL AREAS AND PUBLIC PARKS.
Mayor Grimmer gave the following information from a memo to the City
Council from the City Administration: The proposed Ordinance No. 1122
being presented prohibits the operation of businesses such as adult movie
picture theaters, nude modeling studios, adult book stores, nude or semi-
nude wrestling studios, or businesses which offer activities between male
and female persons when one is nude or semi-nude within 1000 feet of any
church, public or private elementary or secondary school, kindergarten,
residential area or public park.
After reviewing the ordinance and discussion of including 'colleges' with
the other specified distances listed, a motion by Councilman Dodd, a
second by Councilman Binford, all voting "aye", adopted the following
captioned ordinance No. 1122:
AN ORDINANCE OF THE CITY OF FARMERS BRANCH,
TEXAS, PROHIBITING OPERATION OF CERTAIN ENTER-
PRISES IN SPECIFIED AREAS; PROHIBITING THE OPERA-
TION OF BUSINESSES THAT OFFER. WRESTLING BETWEEN
MEMBERS OF THE OPPOSITE SEX IN AREAS NEAR. CHURCHES,
SCHOOLS, RESIDENTIAL AREAS, PUBLIC PARKS, COLLEGES,
JUNIOR. COLLEGES OR. UNIVERSITIES, PRIVATE OR. PUBLIC
OR PROPRIETARY; PROHIBITING BUSINESSES THAT DISPLAY
BOOKS, MAGAZINES, NEWSPAPERS, PICTURE, PHOTO-
GRAPHS AND DRAWINGS THAT CONTAIN CERTAIN SEXUAL
MATERIAL FROM OPERATING NEAR. CHURCHES, SCHOOLS,
RESIDENTIAL AREAS, PUBLIC PARKS, COLLEGES, JUNIOR.
COLLEGES OR. UNIVERSITIES, PRIVATE OR. PUBLIC OR. PRO-
PRIETARY; PROVIDING A DEFENSE; PROVIDING FOR. MEASURE-
MENT OF DISTANCES; PROHIBITING EXHIBITION OF CERTAIN
SEXUALLY EXPLICIT FILMS IN SPECIFIED AREAS; PROVIDING
A DEFINITION; PROVIDING INJUNCTIVE RELIEF; PROVIDING
A SAVINGS CLAUSE; PROVIDING A PENALTY OF FINE NOT TO
EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200. 00);
AND PROVIDING AN EFFECTIVE DATE.
AGENDA ITEM NO. 5. -CONSIDER. AUTHORIZING THE ADVERTISEMENT
FOR. BIDS FOR. EIGHT 1977 FOUR.-DOOR. VEHICLES FOR. THE POLICE
DEPARTMENT.
After some discussion between the members of the City Council and the
City Manager concerning the specifications on the vehicles, a motion by
Councilman Quevreaux, a second by Councilman Binford, all voting "aye",
authorized the advertisement for bids for eight 1977 four-door vehicles
for used by the Police Department.

OTHER. COMMENTS
Mr. Alvin Thomas was in the audience and recognized by the Council.
MAYOR. GRIMMER. ANNOUNCED THAT THE ITEMS ON THE AGENDA
FOR. THE GENERAL SESSION HAD BEEN CONCLUDED. AFTER. A
SHORT RECESS THE COUNCIL WILL RECONVENE FOR ITEMS IN THE
EXECUTIVE SESSION. THE MEETING WILL RECONVENE INTO GENERAL
SESSION AFTER. THE ITEMS HAVE BEEN DISCUSSED IN THE EXECUTIVE
SESSION.
Mayor Grimmer explained that Article 6252-17, Section 2 of the Open
Meeting Law provided that such item as pending and contemplated litiga-
tion may be discussed in closed session.
AGENDA ITEM NO. 6. -EXECUTIVE SESSION
Discuss Pending and Contemplated Litigation
City Manager Paul West gave an up-to-date status report on the Water
Rate Case with Dallas.
City Attorney Doug McCallon gave an up-to-date status report on the
Pansonic and Honda Tax Case.
THE MEETING WAS RECONVENED INTO GENERAL SESSION.
AGENDA ITEM NO. 7. -ADJOURNMENT.
Upon a motion by Councilman Johnson, a second by Councilman Binford,
all voting "aye", adjourned the City Council meeting of January 3, 1977 at
8:15 P.M..
