MINUTES OF A SPECIAL MEETING
MARCH 23, 1970
All members of the City Council were present:

Mayor Grimmer called the meeting of March 23, 1970 to order
at 6:30.P. M.. Councilman Linn gave the invocation.
BA.TCHING PLANT _ON_NORTHEAST CORNER OF VALLEY VIEVT
LANE AND WILMINGTON DRIVE
After some consideration, a motion by Councilman Korioth, a second
by Councilman McClung, all voting "aye", passed a resolution
authorizing Austin Paving Company to locate a temporary batching
plant on the northeast corner of Wilmington Drive and Valley View Lane.
SUB-DIVISION IMPROVEMENTS FOR PARKWAY SOUTH ADDITION
Mayor Grimmer opened the discussion by pointing out that the agreement
by deed which the park land was dedicated along Rawhide Creek west of
Josey Lane appears that the street be located as requested by Mr. Heiser.
The dedication deed that had been supplied to the Council provided that
the land dedicated to the City was dedicated for park and street purposes.
Mr. Heiser was present and is a part property owner who requested
the Council to authorize half the cost of paving Golfing Green Drive from
Josey Lane to Tom Field Road and also half the cost of putting in the
water line along Golfing Green Drive. Mr. Heiser stated the
dedicated deed provided as their intent that the southern line of the
park would be the centerline of the proposed Golfing Green Drive
which would line up Golfing Green that was presently there. He said
with doing it that way this prevented the off-set in the street.

The Council discussed that in 1964 when the Council accepted the
dedication by deed, the City acted in good faith and in an oversight in 1969
the Council passed the ordinance whereby it states that the developer
provides putting in the street.
The Council discussed the legality of the deed and the ordinance.
A.ttorney Bob Baker stated he and Attorney Louis Nichols had discussed
both the deed and the ordinance and Mr. Nichols said it would be the
decision of the Council on the interpretation.
The Council discussed that if the Council had had the deed the night
the ordinance was passed it would have simplified matters at that time.
The Council discussed the cost of putting in Golfing Green Drive and
the water line and the cost of Tract 3 which had been offered by dedication
to the City.
After more discussion, Councilman Korioth moved that`` to the centerline
of Golfing Green Drive"be put in, the centerline of the street be the
property line between Rawhide Park and the Heiser Tract; and, that the
city purchase Tract 3 on Mr. Heiser's plat from the developer at the
price it costs the developer to put in half the street, half the water
line in said street, the cost of putting in both sides of the street along
the north side of Tract 3, and half the cost of the alley adjacent to
Tract 3. Councilman Linn seconded the motion. Motion carried "all
voting aye

Upon a motion by Councilman Korioth, a second by Councilman McClung,
all voting "aye", adjourned the special meeting of the City Council of
March 23, 1970.
