MINUTES OF A REGULAR MEETING
April 19, 19 71

Mayor Grimmer called the regular City Council meeting of April 19, 1971
to order at 7:30 P.M. Councilman Linn gave the invocation.
APPROVAL OF MINUTES
Upon a motion by Councilman McClung, a second by Councilman Flaherty,
all voting "aye", approved the minutes of the regular City Council meeting
of April 5, 1971 as written.
THE OATH OF OFFICE WAS ADMINISTERED BY MAYOR GRIMMER TO
W. R. LINN.
MAYOR PRO-TEM ELECTED
Councilman Flaherty nominated Councilman Linn for Mayor Pro-Tem.
Councilman Binford .moved the nominations cease. W. R. Linn was declared
by acdamation Mayor Pro-Tem. All voted "aye".
CHIEF GREEN RESIGNED
City Manager Paul West announced that he accepted with regret the resignation
of Chief Pete Green. Chief Green is retiring from police work to enter private
business. The Council expressed regret to see him leave the city. Chief Green
expressed appreciation for all the cooperation and friends he has received
from the Council and citizens of Farmers Branch.
PUBLIC HEARING - REQUEST FOR ZONE CHANGE FROM PD-5 (C) AND
R-6 TO LI. PROPERTY LOCATED AT 2514 SABLE, 3.453 ACRES IN THE
THOMAS KEENAN SURVEY, PART OF ABSTRACT 733. REQUESTED BY
HA L FERGUSON.
Mayor Grimmer opened the public hearing. After some discussion that the
sign posted on the property announcing the public hearing announced the
the Planning and Zoning Public Hearing but did not announce the City Council's

Public Hearing, the Council recessed the public hearing until May 3, 1971.
PUBLIC HEAR ING - REQUEST FOR A SPECIFIC USE PERMIT FOR AN
INSTITUTION OF PHILANTHROPIC NATURE, ON THE FOLLOWING
TRACT: 12704 BEE STREET, APPROXIMATELY ONE (1) ACRE ON THE
NORTHEAST CORNER OF THE INTERSECTION OF BEE STREET AND
SABLE STREET. REQUESTED BY CARL W. BELL.
Mayor Grimmer opened the public hearing. Mr. Carl Bell stated he did
not have anything to add to his request that had been before the Planning
and Zoning Commission. His request was for a Specific Use permit so
that an institution of philanthropic nature may be maintained at 12704 Bee
Street. Mr. Bell represents the committee forming the "Truth House".
There was no other person present speaking for the request. There were
no persons present opposing the request.
Councilman Korioth made a motion to close the public hearing. Councilman
Linn seconded and all voted "aye".
After some discussion, Councilman Korioth moved to grant the request
for a Specific Use permit for 12704 Bee Street as recommended by the
Planning and Zoning Commission. Councilman McClung seconded and
all voted "aye "o
Mr. Bell did ask for the return of $100. 00 which had been paid for the
zoning change, since this is a non-profit organization.
City Manager Paul West stated the fee is part of the regulations in the
zoning ordinance and it has not been a policy in any case to return this
fee.
CERTIFICATE OF APPRECIATION
Mayor Grimmer presented a certificate of appreciation to Mrs. Tina Busby,
the Pre-School Teacher, for her Arts and Crafts classes at the Recreation
Center, winning First Place at the State Fair of Texas Spring Jubilee Young
People's Parade. Mrs. Busby thanked the Council and also thanked Mr.
Graff who built the wagon and Mrs. Warren who donated the wagon.
PROCLAMATION - LIBRARY WEEK
Mayor Grimmer signed a proclamation proclaiming the week of April 18 - 24,
1971 as Library Week in Farmers Branch.
ORDINANCE NO. 878 - PRO RATA ORDINANCE
After some discussion, Councilman Linn moved to adopt the following
captioned ordinance:

RATA. CHARGES, PROVIDING FOR THE REPEAL OF
ORDINANCE NO. 384, PROVIDING FOR THE EFFECTIVE
DATE OF THE ORDINANCE AND PROVIDING A SEVERA.BILITY
CLAUSE.
Councilman Korioth seconded the motion and all voted "aye
FLOOD PLAIN PROPERTY REMOVED - FREE TRACT
After some discussion on the elevation of the property being above the
established flood plain elevation, and stipulations in the resolution
releasing the City from any damages caused by flooding, a motion
by Councilman McClung, a second by Councilman Korioth, all voted
"aye", passed a resolution removing from the flood plain the Free
Tract located on Senalac just south of the City Shop, and providing
that Mr. Jerry R. Free, known to be the property owner, execute a
written release releasing the City of Farmers Branch from any
damage or claim arising from any overflow of water or flooding.
REQUEST FOR WATER AND SEWER BY MR. MAURICE HOUSE.
Mr. House was not present at the time this item was discussed but
did arrive later. Mr. House had requested a variance in the sub-
division ordinance to allow a septic tank on property adjoining south of
Decorators Furniture on the west service road of I. H. 35E.
The previous ordinance concerning pro rata regulations was discussed
and the Council asked the City Manager to explain the new ordinance
to Mr. House.
After .more discussion, a motion by Councilman Korioth, a second
by Councilman Linn, all voting "aye", rejected Mr. House's request.
After Mr. House did arrive~the new pro rata ordinance no. 878 was
explained to him.
ORDINANCE NO. 876 - SETTING WATER TAPPING FEES
After some discussion, a motion by Councilman Flaherty, a second by
Councilman Linn, all voting "aye", adopted the following captioned
ordinance:
AN ORDINANCE OF THE CITY OF FARMERS BRANCH, TEXAS
AMENDING ORDINANCE NO. 206, SECTIONS 1, 2, and 3 BY
RESETTING TAPPING FEES; AND DECLARING AN EMERGENCY.

ORDINANCE NO. 877 - SETTING SEWER TAPPING FEES.
After some discussion, a motion by Councilman Binford, a second by
Councilman McClung, all voting "aye", adopted the following captioned
ordinance:
AN ORDINANCE OF THE CITY OF FARMERS BRANCH,
TEXAS, ESTABLISHING THE CHARGES FOR TAPS INTO THE
CITY'S SEWER MAINS, ESTABLISHING A. FEE FOR STREET
CUTS, AND DECLARING AN EMERGENCY.
POLICY FOR SWIMMING POOL ADMISSION.
After some discussion, a motion by Councilman Korioth, a second by
Councilman Binford, all voting "aye", adopted a resolution setting the
swimming pool admission prices; 25 under 18 years of age, 50 for
18 years and above, baby pool children admitted free; and, whereas
a season .metal tag may be purchased at $6. 00 for students, $7. 50 for
adults, and $30. 00 for families of 5 or .more; and, whereas any pass
book held by citizens for year of 1970 will be accepted.
POLICY FOR USING LIGHTED BALL FIELDS
After some discussion, a motion by Councilman Korioth, a second by
Councilman Linn, all voting "aye", adopted a resolution setting fees for
non-league play on city ball fields for the use of lights and the following
rates are established:
Showman Park - $ 3. 00 per hour
Cox Park South - $ 2. 50 per hour
All Other Parks- $ 2. 00 per hour.
Mr. Barney Wood, chairman of the Farmers Branch Sports Council,
spoke in concern of the soccer and football programs. He also commended
Mr. John Burke and City Manager Paul West for the cooperation they
have given.
DRUG STUDY 1
After some discussion on the expenditures mentioned in the Drug Study
Report, Councilman Linn made a motion to table any further discussion on
the Drug Study Report and requested that Mr. Newman Smith, project
chairman of the Steering Committee, call a joint-meeting between the
.members of the City Council of Carrollton, the members of the Carrollton-
Farmers Branch School Board, and the members of the City Council of
Farmers Branch, in order to sit down and find out which way are we going
and under what conditions. Councilman Korioth seconded the motion and
all voted "aye
DRUG ADULT PROGRAM - COUNCILMAN KORIOTH.
Councilman Korioth stated he would like the Council to be thinking about a
Drug Adult program which he believes could be handled through our Police
Department. He stated he would like to postpone this discussion until after
the meeting as mentioned above on the Drug Study Report takes place.

f DEDICATION DEED FOR STREET PURPOSES ON ALPHA ROAD - Harry Wells
After reviewing the location on a transparency and some discussion, a
motion by Councilman Binford, a second by Councilman McClung, all voting
"aye", authorized the City Manager to acquire and accept the dedication deed
from Harry Lee Wells and others for street right-of-way on Alpha Road.
DALLAS COM--7 tUTER TAX
The proposed Commuter Tax that has been proposed by Dallas was
discussed. One thought that was discussed at some length was: if Dallas
could tax people who live outside of Dallas but work in Dallas so could
the other cities. A resolution opposing the commuter tax was presented.
After some discussion and amending, Councilman Binford moved to adopt the
resolution opposing the Dallas Commuter Tax. Councilman Korioth
seconded the motion. The motion carried 3 to 2 with Councilmen
Binford, Korioth, and Flaherty voted "aye" and Councilmen Linn and
McClung voted "no".
STATE LEGISLATION
Mayor Grimmer read a resolution favoring House Bill 25.
Councilman Korioth moved to pass the resolution favoring House Bill 25.
Councilman Flaherty seconded. All voted "aye".
Mayor Grimmer read a resolution favoring House Bill 1553.
A motion by Councilman Linn, a second by Councilman Korioth, all voting "aye",
passed the resolution favoring House Bill 1553.
Mayor Grimmer read a resolution amending House Bill 594.
A. motion by Councilman Korioth, a second by Councilman Binford, all voting "aye",
disregarded House Bill 594 resolution. (This bill was heard the day of this
.meeting. )
Mayor Grimmer read a resolution opposing House Bill 1540.
A. motion by Councilman Korioth, a second by Councilman Binford, all voting
"aye", passed a resolution opposing House Bill 1540.
Mayor Grimmer read a resolution opposing House Bill 556.
A motion by Councilman Linn, a second by Councilman Korioth, all voting "aye",
passed the resolution opposing House Bill 556.
Mayor Grimmer read a resolution opposing House Bill 1477.
A. motion by Councilman Linn, a second by Councilman Flaherty, all voting
"aye", passed the resolution opposing House Bill 1477.
Mayor Grimmer read a resolution opposing Senate Bill 892.
A motion by Councilman Linn, a second by Councilman McClung, all voting
"aye", passed the resolution opposing Senate Bill 892.

CITY MANAGER REPORTS
City Manager Paul M. West gave reports from various departments of the
city.
EXECUTIVE SESSION
Reappointment to Boards.
G. T. McClain, Barbara Glenn and John Miniter, members of the
Library Board, terms expire this month and next.
Jack Knight and Ed Sostecke, members of the Planning and Zoning
Commission, terms expire next month.
Upon a .motion.-by Councilman Korioth, a second by Councilman Binford,
all voting "aye", reappointed the ones mentioned above for a term to expire
May 1, 1973 if they wish to serve.
ADJOURNMENT
Upon a motion by Councilman McClung, a second~by Councilman Korioth,
all voting "aye", adjourned the regular meeting of the City Council of April 19,
1971 at 9:50 P.M.
