HomeMy WebLinkAboutOrdinance No. 3471 Amending Fee Schedule relating to Utilities, Water & Sewer Service Ratesa0 �1!Z� ORDINANCE NO. 3471 AN ORDINANCE OF THE CITY OF FARMERS BRANCH, FARMERS TEXAS, AMENDING THE FARMERS BRANCH CODE OF BRANCH ORDINANCES, APPENDIX A "FEE SCHEDULE," RELATING TO FEES ESTABLISHED PURSUANT TO CHAPTER 86 "UTILITIES," ARTICLE IV "SERVICE RATES AND BILLING PROCEDURE," SECTION 86 -276 "WATER SERVICE RATES" AND SECTION 86 -277 "SEWER RATES "; PROVIDING A SAVINGS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND, PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Farmers Branch, Texas, finds it to be in the public interest to amend the City of Farmers Branch Code of Ordinances, Appendix A "Fee Schedule" and /or related sections of the Code of Ordinances in order to better reflect the cost of certain services provided by the City of Farmers Branch. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FARMERS BRANCH, TEXAS, THAT: SECTION 1. The Code of Ordinances of the City of Farmers Branch, Appendix A "Fee Schedule" shall be amended in part to read as follows: A. The portion of Appendix A, "Fee Schedule," of the Code of Ordinances of the City of Farmers Branch, Texas, relating to Chapter 86 "Utilities," Article IV "Service Rates and Billing Procedure," Section 86 -276 "Water Service Rates," and Section 86 -277 "Sewer Rates," shall be amended to read as follows: Section this Code Description New or Revised Rate Chapter 86. Utilities Article IV. Service Rates and Billing Procedure 86- 276(a) Water service rates (monthly rate): First 2,000 gallons or less: Minimum (all meter sizes), and meters connected solely to fire protection systems, per unit.......... 19.75 Meters connected solely to fire protection systems charged for 3/4 -inch meter, regardless of size. To qualify for rate on this type of account, the establishment must have a prior 12 -month annual water consumption of 75 million gallons or more from all of their water account or accounts. Should any sentence, paragraph, subdivision, clause, phrase or section of this Ordinance be adjudged or held to be unconstitutional, illegal or invalid, the same shall not affect the validity of this Ordinance as a whole, or any part or provision thereof other than the part so decided to be invalid, illegal or unconstitutional, and shall not affect the validity of the Code of Ordinances as a whole. SECTION 3. This Ordinance shall be effective immediately upon final passage; provided, however: A. The rates established by the amendment set forth in Section I.A. of this Ordinance shall be effective for billing cycles commencing on or after October 1, 2017.
