Linn Councilmen: Ray Flaherty Bill McClung Bill Binford Councilman Quevreaux was absent due to being out of town. Wade Ruth Ann Parish Mayor Grimmer called the Special City Council meeting of August 14, 1973 to order at 9:35 A. M. . AGENDA ITEM: - CONSIDER AUTHORIZING THE FILING OF AN INJUNCTION TO PREVENT THE CITY OF DALLAS FROM RESTRICTING WATER IN FARMERS BRANCH. City Manager Paul West stated that by reason of refusal of the City of Dallas to raise the rate of the flow of the water supply for Farmers Branch, this Special meeting was called. Mr. West told of the water supply being low and the refusal of the City of Dallas to raise the rate of flow upon the request of the City of Farmers Branch. Special Counselor Frank Booth and Paul West gave an up to date report on the status of the water contract. After much discussion, a motion by Councilman Linn, a second by Council- man Binford, all voting "aye", adopted Resolution No. 73-035 that authorizes the filing of an injunction to prevent the City of Dallas from restricting water in Farmers Branch. The resolution is attached for record. ADJOURNMENT. Upon a motion by Councilman Binford, a second by Councilman McClung, all voting "aye", adjourned the Special meeting of the City Council of Page 700. FTC 1 IZ) VA C Jr Q~ ly.. 9 ~ C TQ~~ y FIE 0 ` ~ CQ, r ILA 40 J sa~°°°~` , JQSE ~ lk, '.Ai ~r UW"nJ✓ r r . r,: I Z RESOLUTION NO. 73-035 WHEREAS, the City of Farmers Branch is presently involved in liti- gation before the Texas Water Rights Commission, an agency of the State of Texas in which the City of Farmers Branch, Texas is requesting a hearing to fix water rates; and WHEREAS, the City of Dallas has refused during the pendancy of this hearing to supply the quanitity of water necessary for the City of F=rmers Branch and its citizens; and WHEREAS, it is now necessary to institute legal action in the District Courts to require the City of Dallas to furnish sufficient water to the City of Farmrs Branch until said hearing before the Texas Water Rights Commission; and WHEREAS, an emergency meeting has been called by the City Council of the City of Farmers Branch to authorize the City of Farmers Branch's legal counsel, Booth and Lloyd, to institute suit. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FARMERS BRANCH, TEXAS: SECTION 1. The City:;of Farmers Branch, Texas, through its legal counsel is hereby authorized to institute all legal actions necessary to restrain the Cityebf Dallas from refusing to supply the necessary quantities of water to the City of Farmers Branch. SECTION 2. The City Manager is authorized to retain special counsel to assist his office in filing and presenting such a petition.
