Mayor Dodd called the City Council meeting of August 2, 1982 to order
at 7:30 P.M. The meeting was televised.
AGENDA ITEM NO. A.1-INVOCATION.

Councilwoman Dingman made,,a motion that an emergency item be placed on
the agenda as Agenda Item 'T~Q. C.4-Consider Request To Close Luna Road
For This Weekend And Take Ap~ropriate Action. Councilman Weidinger
seconded the motion with all meibers voting "aye". The emergency item
was placed on the agenda as AgenItem No. C.4.
AGENDA ITEM NO. B.1-PRESENTATION OF BOARD APPLICATIONS.
Mayor Dodd explained that this item is placed on the agenda to give
citizens an opportunity to present applications to the Council for
serving on any of the various advisory boards.
No one was present to present an application.

AGENDA ITEM NO. B.2-PRESENTATION OF AWARD TO THE SANITATION DIVISION.
Mayor Dodd presented an award for the best color, identification and
design for the solid waste vehicles category for public hauler
vehicles given by Solid Waste Management Associaton in a nationwide
contest to the Sanitation Division. Earl Deland, Director of Public
Works, Lee Wayne Darnell, Shop Superintendent, and Don Moore, Garage
Superintendent, accepted the award.
AGENDA ITEM NO. B.3-CONSENT ITEMS.
Mayor Dodd explained that under the title of consent items are items
that are to be considered and action taken that may not need
discussion individually. Any member of the Council or member of the
audience may request to withdraw any item from the consent items and
place the item before the Council for full discussion. The concept
for the consent items is being established in order to speed up
discussion for those items that need more time for discussion.
After some discussion, a motion by Councilman Glancy, a second by
Councilman Blair, all voting "aye", the following consent items were
approved.
a. Approved the minutes of the July 26, 1982 meeting.
b. Approved the following captioned Ordinance No. 1377
establishing a school zone on Josey Lane at Dennis Lane.
"An Ordinance Of The City Of Farmers Branch, Texas Amending
Ordinance No. 1210 By Designating A School `Lone On Josey Lane
At Dennis Lane And Specifying The Speed Limit Within This
School Zone; Providing For A Penalty Of Fine Not To Exceed
Two Hundred Dollars ($200.00) For Each Offense; Providing A
Severability Clause; And Declaring An Emergency."
C. Authorized the City Manager to execute an annual contract
with the North Texas Commission.
MAYOR DODD RECOGNIZED FORMER COUNCIL MEMBER RAY FLAHERTY, CHAIRMAN OF
THE TRANSPORTATION COMMITTEE FOR THE FARMERS BRANCH BUSINESS CHAMBER
OF COMMERCE, WHO PRESENTED THE GREATER DALLAS COUNTY MOBILITY STUDY
REPORT.
Mr. Flaherty gave a report on the transportation needs and problems in
the Farmers Branch area and asked that the Chamber of Commerce be
given the opportunity to show a slide program of these transportation
needs and problems at the next City Council meeting in August.
ITEM NO. C.1-PUBLIC HEARING: TO DETERMINE WHETHER THE ZONING SHOULD
BE CHANGED FROM EXISTING ZONING TO PLANNED DEVELOPMENT PD ZONING
ALLOWING CERTAIN USE. REQUESTED FOR THE PROPERTY BEGINNING AT
STEMMONS FREEWAY AND THE NORTH CITY LIMITS, THENCE SOUTH ALONG

STEMMONS FREEWAY TO THE SOUTH CITY LIMITS, THENCE EAST ALONG HE CITY
LIMITS LINE TO FORD ROAD, PROCEEDING NORTH ALONG FORD ROAD ACROSS

BEE STREET, NORTH ALONG BEE STREET TO A POINT 250' NORTH OF WICKER

Mayor Dodd opened the public hearing by giving the following infor-
mation from an administration memo. This item is a continuation of
the July 26, 1982 meeting. The item was continued to allow the
Planning and Zoning Commission and the Old Downtown Farmers Branch
Study Committee the opportunity to hold a joint meeting to consider
the standards for the Old Downtown Farmers Branch study area.
Mayor Dodd asked Mr. Seiley to come forward and address the City
Council. Mr. Seiley gave a report on the July 28 meeting between the
Planning and Zoning Commission and the Old Downtown Farmers Branch
Study Committee. Mr. Seiley described the standards that were recom-
mended for the PD areas during the meeting and suggested that the City
Council make a resolution to begin capital improvements in the Old
Downtown Farmers Branch Study Area.
Mayor Dodd opened the discussion to the audience. The following
spoke:
Ms. Barbara Blackburn, 14005 Bee Street, stated that the property
owners in and adjacent to the rezoning area along Bee Street requested
that no truck traffic signs be erected at the north end of Bee Street
at Valwood and at the south end of Wicker Street to stop truck traffic
along that street. Ms. Blackburn stated that with this traffic sign
request the property owners she represented were in favor of the
zoning change.
Mr. John Oeschner, 5515 Purdue of Dallas, expressed concern about the
uses allowed in PD-35. He felt that the PD-35 area should allow office
and retail uses instead of the office use proposed. He stated that
there were not enough people in the area to generate restaurant and
retail uses.
Councilman Johnson made a motion to close the public hearing.
Councilman Glancy seconded the motion with all members voting "aye".
The public hearing was closed.
Councilwoman Dingman commented that it might be helpful to have an
official reference to additional guidelines in the ordinance. She
stated that she had attended the July 28 meeting between the Planning
and Zoning Commission and the Old Downtown Farmers Branch Study
Committee and felt that the standards were acceptable to the people
that were at the meeting that night. Her main concern had been that
the residential areas adjacent to the Old Downtown Farmers Branch

Study Area would have high rise buildings located behind them, but
this objection had been addressed by limiting the buildings to two
stories.
Councilman Blair asked how the request by the citizens for no truck
traffic signs along Bee Street should be handled. Mayor Dodd
suggested that the request be a separate motion from the zoning change
to include other items of concern such as a no truck zones.
Councilwoman Dingman made a motion to approve the Old Downtown Farmers
Branch Study Committee's recommendations with the considerations
recommended by the Planning and Zoning Commission by adopting the
following captioned ordinances:

Councilman Blair seconded the motion with all members voting "aye".

The City Council commended the members of the Old Downtown Farmers
Branch Study Committee and Doug Creer, City Planner, for their work on
the Old Downtown Farmers Branch Area.
Councilwoman Dingman made a motion to remove the moratorium on the Old
Downton Farmers Branch Area. Councilman Weidinger seconded the motion
with all members voting "aye". The motion carried.
Councilwoman Dingman made a motion to pass a resolution to initiate
capital improvements in the Old Downton Farmers Branch Area in an
appropriate manner and time. Councilman Glancy seconded the motion
with all members voting "aye". The motion carried.
Councilman Blair made a motion to instruct the City Staff to study and
erect the proper signage that would prohibit truck traffic along Bee
Street from Wicker Street to Valwood Parkway and have the appropriate
ordinance prepared for the next Council meeting. Councilman Johnson
seconded the motion with all members voting "aye". The motion
carried.
ITEM NO. C.2-HEAR PRESENTATION FROM CITIZENS OF THE OAKBROOK AREA FOR
IMPROVEMENTS TO OAKBROOK PARKWAY.
Mayor Dodd opened the discussion by giving the following information
from an administration memo. This item has been placed on the agenda
at the request of Mrs. Sue Bloom, of 3414 Gatwick Place.

Mrs. Bloom gave a description of the Oakbrook area and presented a
request on behalf of the Citizens for a Beautiful Oakbrook. She asked
that the citizens of the Oakbrook area and City Council and Parks and
Recreation Department be given a chance to work together to make
improvements to the Oakbrook area. Mrs. Bloom explained that the
Oakbrook property owners would like to see the medians and
right-of-ways sprinklered and planted with grass, shrubs and trees;
and secondly, the beautification of Oakbrook lake and park. Mrs.
Bloom requested that $50,000 from the 1982-83 budget be used for the
first phase of the development of the medians and right-of-ways on
Oakbrook Parkway. She displayed pictures of the entrance off Webb
Chapel and compared them with the unimproved medians to the east.
Mrs. Pat Allen, 3117 Goldenoak, representing the homeowners of the
Oakbrook Townhouses, came forward to request the improvement of the
medians in the Oakbrook area.
Mrs. Bloom stated that they felt that $50,000 was a starting figure
for the most immediate needs and were not sure how much the median
irrigation and reclamation of Oakbrook Lake would cost but that they
did wish to be considered in the 1982-83 budget.
Maintenance of the present area was discussed.
After some discussion of the cost of improvements requested,
Councilman Glancy made a motion to instruct the Staff to set $62,000
in the 1982-83 budget for the initial phase of landscaping for the
medians and, if additional funds are available, begin the next phase.
After some discussion of studying the request, Councilman Glancy
withdrew the motion.
There was discussion by the members of the Council that the Staff meet
with the Oakbrook homeowners' representative and come up with a phased
plan and estimates of the cost.
Councilwoman Dingman made a motion to include the first phase of
landscaping of the Oakbrook medians and right-of-ways for con-
sideration in the 1982-83 budget. Councilman Johnson seconded the
motion with all members voting "aye". The motion carried.
AGENDA ITEM NO. C.3-HEAR PRESENTATION BY FREESE AND NICHOLS, INC.
CONSULTING ENGINEERS ON THE STORM DRAINAGE STUDY.
Mayor Dodd opened the discussion by giving the following information
from an administrative memo. Freese and Nichols, Inc., consulting
engineers, were hired by the City to perform a Storm Drainage Study.
Mr. Lee Freese and Mr. Jerry Fleming of Freese and Nichols will make a
report to the City Council of the work performed on the Storm Drainage
and their findings.

Mayor Dodd asked Mr. Lee Freese to come forward and address the City
Council. Mr. Freese introduced Mr. Michael Bennet, project engineer,
and Mr. Jerry Fleming.
Mr. Fleming made a presentation giving the results of valuating the
flooding potential on major drainageways within the City. The results
of this evaluation will provide the City with a current flood plain
management program and a comprehensive stream improvement program
identifying specific flood relief facilities. Streams included in the
study are Cooks Branch Creek, Rawhide Creek and Farmers Branch Creek.
This study provides data updating flood maps needed for flood plain
management by the City and for flood insurance administered under the
National Flood Insurance Progam. Flood control improvements for each
stream have been evaluated and are presented for consideration of
funding in Capital Improvement Programs. These improvements have been
prioritized to identify those projects which are considered essential
for flood relief.
Implementation of these proposed improvement plans for Cooks Branch
Creek, Rawhide Creek and Farmers Branch Creek should provide flood
control to either reduce or eliminate flooding at most of the problem
areas throughout the City. These proposed improvements are based on
the 100-year frequency flood and the assumption that the entire
drainage area is totally developed. The possible combinations of
solutions for flood relief are unlimited. The recommended solutions
are general applications for flood control projects and are general
planning purposes. The proposed improvements for each stream,
including channel improvements and bridges to be replaced and/or
modified was discussed.
Mr. Fleming stated that the study was based on the amount of land
removed from the flood plain and the number of facilities removed from
the flood plain based upon the costs required to make that improve-
ment. He stated that they are trying to give the greatest amount of
protection for the dollar spent.
Mayor Dodd recognized Mr. Jerry Smith, 2508 Rugby Lane. Mr. Smith
stated that he would be glad to give up a portion of his back yard to
keep the area from flooding.
Mayor Dodd recognized Mr. Bob Linker who asked when the report would
be available for viewing and where. Mayor Dodd stated that the report
would be on file at the Library and the City Hall for viewing and a
copy could be purchased at the City Hall.
Mayor Dodd recognized John Glasschroeder, of Arawak Place. Mr.
Glasschroeder asked whether the 300 acre triangular tract of land that
had some impact upon the flood plain be identified. Mr. Fleming
stated that the tract of land was located in the Town of Addison. Mr.
Glasschroeder then asked what impact the building of 2100 condominiums
on the southeast corner of Beltline and Marsh have on the flood

Mr. Powell stated that they had had a meeting with FAA and Charlie
Taylor, the local FAA representative in Dallas, had inspected the
field and given T.V. Corporation written permission to go ahead with
the stunt.
No action on this item was taken by the Council.
AGENDA ITEM NO. D.1-DISCUSS APPROPRIATE CONDUCT OF FARMERS BRANCH
COUNCIL MEMBERS WITH THE CITY OF ADDISON.
Mayor Dodd opened the discussion by stating that the Town of Addison
had invited the members of the City Council of Farmers Branch to a
fish fry Friday night. Mayor Dodd stated that he thought that the
fish fry was to be a social but because of items that could possibly
come under discussion at the fish fry he felt a notice of the meeting
should be posted as outlined in the Open Meeting Act. Mayor Dodd
stated that he had talked with Mayor Jerry Redding who was in
agreement and he is to bring the matter before his Council so that
correct procedures would be followed in advertising through the media.
Mayor Dodd stated that Mayor Redding had postponed the meeting for
weather reasons and is to reschedule the meeting with proper adver-
tising.
There was some discussion of whether a social function of the City
Council was considered a part of the Open Meetings Act and of the fact
that notices were not posted when Council attended organizational
meetings such as the Texas Municipal League, National League of
Cities, Chamber meetings, etc.
City Attorney, John Boyle, explained that the Open Meeting Act
addressed that a quorum of the City Council members meeting to discuss
or take action on public business requires the posting of notice of
that meeting. Mr. Boyle stated that if a quorum was present at the
meeting of the two City Councils and public business was discussed,
there might be a question as to whether public notice of the meeting
should have been given.
Mayor Dodd stated that the intent of his bringing this up was to have
a good meeting between the two councils in a social atmosphere with
the ability to discuss ideas and concerns.
AGENDA ITEM NO. D.2-CONSIDER SCHEDULING A DATE FOR PUBLIC HEARING TO
CONSIDER THE RECOMMENDED CHARTER REVISIONS.
Mayor Dodd opened the discussion by giving the following information.
This item has been placed on the agenda at the request of Councilwoman
Dingman. Councilwoman Dingman suggests the date of August 30 or
September 13 for the public hearing in order to have the election in
January.

control. Mr. Fleming stated that when studying the area they had made
the assumption that the entire area was totally developed so that the
maximum anticipated run-off would be experienced.
Mr. Glasschroeder then asked whether the roads under current construc-
tion were being built to coincide with flood control. Mayor Dodd felt
that this question could be best answered in the study session.
Mayor Dodd asked if the flood insurance maps were being prepared. Mr.
Fleming stated that the maps were being prepared. Mr. Fleming stated
that they did not forsee any significant change.
Mayor Dodd asked if there was anymore discussion. No one spoke.
Mayor Dodd then concluded the discussion and stated that there would
be a study session conducted on the Drainage Study.
AGENDA ITEM NO. C.4-CONSIDER REQUEST TO CLOSE LUNA ROAD FOR THIS
WEEKEND AND TAKE APPROPRIATE ACTION.
Mayor Dodd opened the discussion by giving the following information
from an administrative memo. On this date it was requested by Mr. M.
N. Furr, Security Coordinator for T.V. Corporation of Dallas, to make
an emergency appearance before the City Council to request the closing
of Luna Road between Valley View and 635 this Saturday and Sunday,
August 7th and 8th, for the purpose of filming a movie.
The Staff recommended that the City Council approve the closing of
Luna Road on Saturday and Sunday, August 7th and 8th, between Valley
View and 635, with conditions.
Mayor Dodd recognized Mr. M. N. Furr, of 14417 Forestdale in Farmers
Branch. Mr. Furr stated that their original intention was to ask the
City Council to close Luna Road. The proposal before the City Council
now was to construct a special effects sign board one-quarter of a
mile off Luna Road on private property. Mr. Furr stated that they
would like to use off-duty Farmers Branch Policemen for crowd control.
Mayor Dodd recognized Mr. Gary Powell, 1810 Securr in Irving, stunt
coordinator for T.V. Corporation. Mr. Powell stated that they had
asked for the closing of Luna Road to protect the stunt people and for
the safety of the general public while the stunts are being performed.
He stated that an airplane, motorcycle and car were involved in the
stunt. Mr. Powell stated that the stunts would be performed on private
property one-quarter mile off Luna Road and that the airplane would
not touch down on the property. He stated that they would rehearse on
Saturday and would do their filming on Sunday.
The City Attorney, John Boyle, stated that the City did not need to
take any action since the request to close Luna Road had been
withdrawn. He stated that the FAA would be involved with flying regu-
lations and insurance.

Councilwoman Dingman stated that the dates for public hearing had been
discussed before and she felt that the date of August 30 or September
13 for the public hearing would give plenty of time for advertising
before an election in January.
After some discussion, Councilwoman Dingman made a motion that a
public hearing be called for October 4, the first Council meeting in
October. to consider the recommended Charter amendments.
Councilman Johnson asked to include in the motion that all the notifi-
cation possible such as advertising to the public in newspapers, the
newsletter, on cable television and at a meeting at the Library that

AGENDA ITEM NO. D.3-CONSIDER RESOLUTION #82-011 CALLING A PUBLIC
HEARING TO SET A TAX RATE FOR 1982-83.
Mayor Dodd opened the discussion by giving the following information
from an administrative memo. The City has received a new tax roll
from the Dallas County Appraisal District. The total assessed value
for Farmers Branch on July 21, 1982 was $2, 331,203,718.00. This
figure is subject to additional changes prior to the certification of
our tax rolls.
The City Staff has estimated the 40% homestead exemption granted by
the City Council will further reduce the July 21, 1982 assessed values
by $164,000,000.00 This adjustment will reduce the total assessed
value to $2,167,203,718.00.
The effective tax rate calculation as required by state law will pro-
duce an effective tax rate of $.3048 per $100.00 of assessed value.
The total tax levy using the calculated effective tax rate will be
approximately $6,605,638.00 using a 100% collection factor. Using a
95% collection factor would reduce the levy to $6,275,356.00.
Subtracting the debt service requirements of $1,454,643.00 provides
$4,820,713.00 for General Fund operations. This compares with the
current year estimates of $4,856,688.00.
After some discussion, Councilman Weidinger made a motion to adopt
Resolution #82-011 calling for a public hearing on August 30, 1982 to
consider the tax rate for 1982-1983 fiscal year.Councilman Johnson
seconded the motion with Councilmembers Weidinger, Johnson, Blair and
Glancy voting "aye" and Councilwoman Dingman voting "nay". The motion
carried by a 4 to 1 vote.
AGENDA ITEM NO. D.4-CONSIDER RESOLUTION ADOPTING A UNIFORM POLICY FOR
PLACEMENT OF NEIGHBORHOOD CRIME WATCH SIGNS.
Mayor Dodd opened the discussion by giving the following information

from an administrative memo. It appears to be advisable to adopt a
uniform policy for placement of Neighborhood Crime Watch Signs after
a watch program has been organized and installation of Watch Sings has
been requested.
The proposed Resolution states that signs furnished by an organization
will be installed by the City. Chairman of an organization must
attest that over 50% of the homes lying within the boundaries where
signs are requested are participating in the program.
It is recommended that the City Council approve Resolution #82-010
adopting a uniform policy for the placement of Neighborhood Crime
Watch Signs.
After some discussion relating to the type of sign desired, Councilman
Johnson made a motion to Resolution #82-010 that adopts a uniform
policy for the placement of Neighborhood Crime Watch Signs and adopt
the "eye sign" incorporating the warning "Farmers Branch is a Crime
Watch Community". Councilman Weidinger seconded the motion with all
members voting "aye". The motion carried.
AGENDA ITEM NO. D.5-CONSIDER PASSING RESOLUTION EXPRESSING OPPOSITION
TO THE 1982-83 FISCAL YEAR BUDGET OF THE DALLAS COUNTY APPRAISAL

Mayor Dodd opened the discussion by giving the following information.
This item was placed on the agenda at the request of Mayor Dodd. The
proposed 1983 budget of the DCAD recommends expenditures of
$8,743,009.00. This compares with 1982 budget of $8,193,282.00.
There was a proposed contingency of $150,000.00. Salaries have
increased in the proposed budget in escess of 13%.
The proposed budget provides no comparison with estimated expenditures
for 1982 only the orginal proposed budget.
After some discussion, Councilman Johnson made a motion to adopt
Resolution #82-012 that the City Council of the City of Farmers Branch
oppose the 1982-83 fiscal year budget of the Dallas County Appraisal
District. Councilman Weidinger seconded the motion with
Councilmembers Johnson, Weidinger, Blair and Glancy voting "aye".
Councilwoman Dingman voted "nay". The motion carried 4 to 1.
