Mayor Phelps called the City Council meeting of April 21, 1997, to order at
7:34 P.M. The meeting was televised.
A.1 INVOCATION.
Brother Eddy Ketchersid, Senior Pastor of Farmers Branch Church of
Christ gave the invocation and Councilman Bird led the pledge of
allegiance to the flag.
A.2 PRESENTATION OF 1997 MAYOR'S SCHOLARSHIP AWARDS BY
TOWN NORTH NATIONAL BANK.
Mayor Phelps stated that Mr. Reap, President of the Town North
National Bank wishes to present to the City Council the 1997 recipients
of the Mayor's scholarship award.
Mayor Phelps presented a proclamation to Natalie Burgin and Justin
Snyder of R. L. Turner High School.
Mr. Reap elaborated on how proud Town North National Bank was to be
associated with the Carrollton/Farmers Branch School system.

Selection Committee.
A.3 CONSIDER ACCEPTING TAX DIVIDEND REBATE FROM COUNCILMAN
BERRY GRUBBS AND COUNCILMAN CHARLIE BIRD.
Mayor Phelps stated Councilman Grubbs is not present due to business
out of town.
Councilman Bird requested this item be postponed until the May 5,
1997 City Council meeting.
A.4 CONSIDER ACCEPTING A DONATION FROM JOANNE COLEMAN TO
BE USED FOR PURCHASE OF WILDFLOWERS.
Ms. Joanne Coleman presented her tax rebate check to the City to be
used for the purchase of wildflower seeds for plantings in the City.

A motion by Councilwoman Davis, a second by Councilman Bird, all
voting "aye," accepted the dividend check from Ms. Coleman for the

Mayor Phelps read the Consent Agenda captions for the audience and
home viewers.
C.1 CITY MANAGER REPORTS.
City Manager Richard Escalante presented an informative report on the
status of various projects and activities in the City.
C.2 PUBLIC HEARING: CONSIDER THE REQUEST BY THE CITY OF
FARMERS BRANCH TO AMEND THE USE AND DEVELOPMENT
STANDARDS OF THE PLANNED DEVELOPMENT NUMBER 23 (PD-23)
ZONING DISTRICT LOCATED IN THE SOUTHWEST QUADRANT OF
THE INTERSECTION OF BELTLINE ROAD AND MARSH LANE AND
TAKE APPROPRIATE ACTION.
Mayor Phelps presented the following information for consideration. The
Planning and Zoning Commission previously directed Staff to call a
public hearing to consider amending the PD-23 zoning district. PD-23
encompasses approximately 5.4 acres of land located at the southwest
corner of the Beltline Road and Marsh Lane intersection. PD-23 was
established in 1978 with the adoption of Ordinance No. 1 177 and
allows Light Industrial (LI) uses as set forth in the Comprehensive
Zoning Ordinance.

Approximately one acre within PD-23 is occupied by the Main Street
Concepts development, a project which includes a fully automated
gasoline service station and a single building that houses five fast food
restaurants. A concept plan for a retail center and a drive-in bank has
been approved for the remaining 4.4 acres but the property is yet to be
developed and remains vacant today.
PD-23 allows a variety of commercial and industrial uses that are not
compatible with the approved concept plan, existing development on-
site, neighboring retail development or the long-term land use objectives
of the Comprehensive Plan.
The Planning and Zoning Commission, by unanimous vote, recommends
that PD-23 be amended to change the allowable uses and development
standards from Light Industrial to Local Retail-1 and further prohibit
agricultural uses and auto repair, service and installation.
Staff recommends the case be returned to the Planning and Zoning
Commission in order that consideration of the zoning amendment may
include the participation of the property's ownership.
Mayor Phelps opened the public hearing.
A motion by Mayor Pro Tern Moses, a second by Councilwoman Davis,
all voting "aye," closed the public hearing.
City Manager Richard Escalante stated the City's recommendation is to
return this item to the Planning and Zoning Commission for further
consideration.
There being no further comments, a motion by Councilman Bird, a
second by Mayor Pro Tern Moses, all voting "aye," returned this item
back to the Planning and Zoning Commission in order that consideration
of the zoning amendment include the participation of the property's
owners.
C.3 PUBLIC HEARING: CONSIDER THE REQUEST BY PRIMECO PERSONAL
COMMUNICATIONS FOR A SPECIFIC USE PERMIT AND SITE PLAN
APPROVAL TO ALLOW THE ERECTION OF A TELECOMMUNICATION
ANTENNA TOWER AND AN ASSOCIATED EQUIPMENT CABINET ON
THE TEXAS UTILITIES PROPERTY LOCATED IN A LOCAL RETAIL-2
(LR-2) ZONING DISTRICT AT 14400 JOSEY LANE AND TAKE
APPROPRIATE ACTION.

Mayor Phelps presented the following information for consideration.
PrimeCo PCS wants to place a cellular communications antenna tower
and an associated equipment cabinet on the Texas Utilities Electric
property located at 14400 Josey Lane, the northeast corner of Josey
Lane and Hollandale Lane.
The antenna tower and equipment cabinet will be installed generally
adjacent to the southeast corner of the existing masonry wall. The
antenna tower is comprised of a steel monopole 86.5 feet in height
including the triangular shaped antenna attached to the top of the pole.
The associated equipment cabinet is approximately 100 square feet in
area and approximately 10 feet tall.
The cellular communications antenna tower is permitted within the Local
Retail-2 zoning district with a specific use permit.
The Planning and Zoning Commission, by unanimous vote, recommends
the specific use permit for the telecommunication antenna tower and an
associated equipment cabinet be approved subject to the conditions of
proposed Ordinance No. 2311. Generally, those conditions require
installation of vegetative screening as approved by Staff, preservation of
co-location capability for at least one additional wireless communications
provider, and removal of the monopole and associated structures once
they are no longer being used.
Mayor Phelps opened the public hearing.
Ms. Donna Halstead, 500 South Ervay, representing PrimeCo
Communications, stated she has worked closely with city staff to
devise a plan that will benefit their customers as well as the concerns
of neighbors.
Ms. Halstead stated PrimeCo Communication's is requesting an 80 foot
monopole with an antenna attached to it to provide service to
customers in this region.
Ms. Halstead stated she worked with staff to provide an extensive
landscape buffer plan which will be attached to the ordinance. Ms.
Halstead also stated she had a slide show for Council to view if so
desired, so they could have a better understanding of PrimeCo's
request.
A motion by Councilman Pyle, a second by Mayor Pro Tern Moses, all
voting "aye," closed the public hearing.

Mayor Phelps asked if the material proposed for the buffer landscape
included photinias.
Ms. Halstead replied a mix of plant materials included photenias, holly
shrubs, and Bradford Pear trees are proposed.
Ms. Halstead gave a brief description of the landscape plan and stated it
will be automatically irrigated and maintained.
Mayor Phelps asked Ms. Halstead how tall the trees were going to be
and where will they be located.
Ms. Halstead replied trees will be located on the inside of the fence.
She stated in working with city staff it was recommended that trees be
used so when neighbors looked out their backyard they would see trees
instead of the monopole. Ms. Halstead explained that photenias would
be located to provide screening on the south of the fence along the east
property line.
Mayor Phelps stated in reading the ordinance and looking at the picture
he feels they do not tie together.
Mr. Kirk King, District Manager of TU Electric, 14400 Josey Lane,
stated the piece of information missing is that the fence already is a
screening fence. He stated the fence is 7 feet tall and has wood
interwoven into the wire. He stated it will accomplish screening below
the height of the pear trees and the trees should block the pole from
above the fence.
Mr. King stated at full height they should screen the entire expanse.
Mr. King also stated in working with staff this plan was deemed
acceptable.
Mayor Phelps again stated his concern is the ordinance and the drawing
are not consistent with each other.
Mr. Escalante stated Mayor Phelps is referring to Section 1 and Section
2 of the ordinance and asked Mr. Michael Spicer, City Planning Director,
to clarify.
Mr. Spicer stated the Planning and Zoning Commission left the decision
on screening in the hands of the staff.
Mr. Spicer stated along the east property line there are photenia shrubs
as well as trees. Mr. Spicer stated the proposed mix of shrubs and

trees provided an effective screen that satisfies the intentions of the
Planning and Zoning Commission.
Mr. Escalante asked Mr. Spicer to verify that on the east property line,
starting on Hollandale going north, there will be some photenias by the
asphalt lot and there will not be photenias along the property line by the
larger parking lot.
Mr. Spicer verified that information and said the fence and the tree line
will create a fairly effective screen.
Mr. Escalante asked if there will be photenias in front of the trees.
Mr. Spicer replied not along the east property line because that is where
the fence is located.
Councilman Bird asked how tall will the trees be and are they planted.
Mr. Spicer replied the trees have not yet been planted but the
specifications call for a 3Y2 - 4 inch caliper with a full canopy.
Mr. Spicer stated in speaking with the city's landscape architect a tree
of those dimensions should range from 12 - 15 feet in height at the
time of planting.
Mr. Jeff Fuller, Director of Parks and Recreation, stated the Aristocrat
Pear is 3 %2 - 4 inch in caliper is going to be about a 15 foot tall tree
and should have a good canopy.
Councilman Bird asked if red tips are needed for shrubs.
Mr. Fuller stated he is not familiar with the plan so he cannot respond.
Mr. Spicer stated there is a screening fence that is existing today locatd
east of the proposed tree line along the east property line. He stated
the Nellie R. Stevens Holly, which are effective screening comparable to
photenias, will be used along the north property line.
Mayor Phelps asked if the Nellie R. Stevens Holly reach 8 feet in height.
Mr. Fuller replied the Nellie R. Stevens Holly and photenias, if left in a
natural state, could reach 15 feet in height.
There being no further discussion, a motion by Councilman Pyle, a
second by Councilman Bird, all voting "aye," adopted the following

captioned Ordinance No. 2311 approving the specific use permit and
associated equipment cabinet as recommended by the Planning and
Zoning Commission.

Mayor Phelps presented the following information for consideration. The
Planning and Zoning Commission continued the public hearing until its
April 28, 1997 meeting.
In accordance with the Comprehensive Zoning Ordinance, the City
Council must receive a recommendation from the Planning and Zoning
Commission before action may be taken on any proposed zoning
amendment. Therefore, no action may be taken by the City Council at
this time.
Staff recommends the public hearing be continued to the May 5, 1997
City Council meeting.
A motion by Councilman Pyle, a second by Councilwoman Davis, all
voting "aye," continued the public hearing to the May 5, 1997 City
Council meeting.
C.5 CONSIDER REQUEST OF JOSEPH B. TURNER OF 31 17 BROOKHAVEN
CLUB DRIVE TO AMEND ORDINANCE NUMBER 811 TO ALLOW

RESIDENTS TO KEEP VIETNAMESE POT BELLIED PIGS AND TAKE
APPROPRIATE ACTION.
Mayor Phelps presented the following information for consideration.
Ordinance No. 811 regulates the keeping of specific animals within the
City limits of Farmers Branch. It expressly prohibits keeping horses,
mules, cows, pigs, goats and sheep on any premises unless the animals
are located more than 100 feet from any adjacent property. This
regulation makes it unlawful to keep pigs on most residential premises.
Mr. Turner requests that the City amend Ordinance No. 811 so that
Vietnamese pot bellied pigs may be kept as pets on any residential
premises.
The City Council previously reviewed and discussed a similar request
several times in 1992. At that time, the Council decided to maintain
Ordinance No. 811 as it was originally written without making any
changes.
Staff recommends that the request to amend Ordinance No. 811 be
denied.
Dr. Valerie Tines, veterinarian, Seven Points, Texas, stated she provides
health care for pot-belly pigs. Dr. Tines feels the report from Council that
Mr. Turner received was very narrow and biased and she would like the
Council to do more research.
Dr. Tines explained the good qualities of a pot-belly pig and the benefits
of having them as a house pet. She also stated there is no reason to
treat a pet pig any different than you would a pet dog.
Dr. Tines stated her purpose as a veterinarian is to educate people on
pot-belly pigs and to care for them appropriately and prevent cast off
animals.
Dr. Tines stated pot-belly pigs owners do not have a monopoly on being
irresponsible pet owners. She stated owners of other animals all over
the country make those same errors.
Dr. Tines stated she does not like to see pet owners having to give up
their loved pets because of an ordinance that was written to apply to
farm animals.

Dr. Tines stated she received a letter from the USDA that classified pot-
belly pigs as pets not livestock. She also stated she would give a copy
to the Council.
Dr. Tines stated most surrounding cities have amended their ordinances
to allow pot-belly pigs as long as they abide by certain restrictions,
similar to owning dogs.
Mr. Joe Turner, 31 17 Brookhaven Circle Drive, stated he received his pig
from him children approximately seven months ago. Mr. Turner stated
his family called the City and asked if they were going against any
ordinance by having a pot-belly pig and they were told no. Mr. Turner
stated they did not ask with whom they were speaking.
Mr. Turner stated the pot-belly pig is part of his family and they have had
only one incident with the pig. He stated he has distributed a petition in
his neighborhood and received 116 signatures in favor of keeping the
pot-belly pig. Mr. Turner stated he would be glad to give the Council a
copy of the petition.
Mr. Turner showed the Council a picture of his granddaughter with the
pig and explained the pig is kept outside for exercise, sunshine, and
fresh air. Mr. Turner also explained the pig has not been a problem for
anyone and is no more aggressive than his dog.
Mr. Turner stated he has always wanted a pot-belly pig and now that he
has one he is not able to give it away.
Mr. Turner is asking the Council to look at Ordinance No. 811 and
provide an exception so he can keep his pig. Mr. Turner reiterated the
pot-belly pig is not a problem and will not be a problem to anyone.
Mr. Turner stated after receiving the document from the City, he is also
asking for more time to review this document before the Council makes
their final decision.
Mayor Phelps wanted to clarify that the document Mr. Turner is referring
to is the same information Council received in their Council packet.
Mayor Phelps stated that in 1992, staff did a lot of research on this issue
and this issue has been on the agenda four different times.
Mr. Tom McDougald, Environmental Health Officer, stated the City has
done extensive research and spoken to many people concerning pot-belly
pigs and numerous agencies associated with pot-belly pigs. Mr.

McDougald stated most of the information the Council has received was
quoted from the book entitled "Pot-Belly Pet Pigs and Training," written
by an animal health technician and a veterinarian specializing in pot-belly
pigs.
Mr. McDougald stated when pot-belly pigs are young they are cute and
attractive, but as they get older (2-3 years of age) they tend to get too
heavy, destroy surroundings and require special attention. Mr.
McDougald stated when the pigs start becoming a problem pet owners
want to put them in sanctuaries to get rid of them.
Mayor Phelps asked Mr. McDougald if the information had been updated
since 1992.
Mr. McDougald replied it had been updated. Mr. McDougald also stated
the Humane Society of the United States was contacted recently by city
staff and the Humane Society again stated that the Society discourages
the keeping of a pot-belly pig as a pet.
Mayor Phelps commented that Mesquite had updated their ordinance on
pot-belly pigs which is more restrictive than Farmers Branch.
Mr. McDougald stated Farmers Branch ordinance requires pigs be kept
100 feet from any adjoining property line.
Ms. Laurie Hemings, 1301 Key Lane, Aubrey, stated the book that Mr.
McDougald referred to was published in 1989. Ms. Hemings stated
there has been more information on pot-belly pigs since 1989.
Ms. Hemings stated in reference to pot-belly pigs behavior, the pig is
intelligent enough to respect discipline and pet owners are responsible for
giving their pigs guidelines.
Ms. Hemings asked the Council not to take away the opportunity for Mr.
Turner to have his pet. She suggested to the Council they visit Mr.
Turner's home to see where the pig lives.
Mr. Nick Korba, 13210 Shahan Drive, commented there are goats and
sheep next door to City Hall. He suggested to the Council that the City
have a Special Animal Permit (SAP)) for those individuals wanting special
animals. Mr. Korba stated there would not be many pigs in the City.
Mr. Nick Turner, son of Mr. Turner, 4804 Harwood Lane, Dallas, asked
the Council to consider all the issues and to read the packet of

information, rather than relying on the document written in 1992. Mr.
Turner stated he feels the 1992 document is extremely unfair and biased.
Ms. Alice Butler, Crossroads, Texas, Vice President of the Metroplex
Association of Pot-Belly Pigs Enthusiast. Ms. Butler stated she also runs
the local rescue for pot-belly pigs and would be willing to help the
Farmers Branch Animal Control if they need her assistance. Ms. Butler
also stated she works with many animal shelters in the area.
After a lengthy discussion, a motion by Councilman Bird, a second by
Councilwoman Davis, all voting "aye," denied the request to amend
Ordinance No. 811.
C.6 CONSIDER PETITION SUBMITTED BY MRS. JEANNE SAWYER FOR AN
INDOOR SINGLE-LEVEL SWIMMING POOL AT THE NEW SENIOR
ADULT ACTIVITY CENTER
Mayor Phelps presented the following information for consideration. This
item has been placed on the agenda at the request of Mrs. Jeanne
Sawyer of 3520 Pebble Beach.
Ms. Jeanne Sawyer, 3520 Pebble Beach, stated it took her and her
husband 20 years to find the best living place and that place is Farmers
Branch. Ms. Sawyer stated a few years ago she discovered the Senior
Adult Activity Center and believes it has a positive impact on senior
citizens.
Ms. Sawyer stated that to continue to have the best Senior Center she
has submitted a petition to the Council that is signed by 375
constituents requesting a swimming pool at the new Senior Adult
Activity Center.
Ms. Sawyer read the statement on the petition to the Council and went
on to explain how the petition came about. She also explained the
signatures on the petition are city-wide not just in her neighborhood.
Ms. Sawyer stated she hopes the Council will accept the petition.
Ms. Sawyer stated a pool at the Senior Center would be primarily for
participants health in addition to their social well-being and trusts the
Council's wisdom and good judgment.
Mayor Phelps stated the City has received many calls on this subject
and the City has been meeting with senior groups to see what their
needs are at the Senior Center.

Mayor Phelps stated nothing has come before the Council because it is
still in the planning stage.
Mayor Phelps explained Phase I is to get the building built and before
Phase II can be started, the Council will have to get prices for cost.
Mr. Escalante stated there has been a Task Force formed that is made-
up of Seniors, Parks Board members, and Parks and Recreation staff.
He stated they have toured a number of facilities and have gone
through a process of questioning the qualifications of architects.
Mr. Escalante stated Phase I would be to develop the scope of work to
identify what services and what facilities need to be in the Senior
Center. Mr. Escalante also mentioned there will have to be a lot of give
and take through this process and seniors on the Task Force will be
involved in making these recommendations.
Mr. Escalante suggested to Mayor and Council that the information be
provided to the Task Force so in their deliberations they can look at
whether it is appropriate to have a swimming pool.
Mr. Escalante stated the City had initially sought an ideal match
between the natatorium and the Senior Center but now it will not be a
reality.
Mr. Escalante stated there may be facilities available through the school
district.
Mr. Escalante stated he feels it appropriate the Task Force look at the
Senior Center and consider the petition and benefits of a facility to do
planning for Phase I and Phase II of the Senior Center.
Councilman Bird said he wanted to commend Ms. Sawyer for all her
work on getting the petition out to the residents.
Councilman Bird also stated if the pool cannot go in Phase I it may be
included in Phase II and will be looked at.
Mayor Phelps thanked Ms. Sawyer and assured her that the City
Manager will forward the petition to the Task Force for their
consideration in deliberations.

Mayor Phelps presented the following information for consideration. City
staff presented City Council with updated operating and Capital
Improvement Program budget projections as part of the Mid-Year Budget
Review on April 3, 1997.
Ordinance No. 2310 amends the 1996-97 operating budget and the CIP
budget to reflect the mid-year budget changes discussed during the Mid-
Year Budget Review. This budget amendment includes expenditure and
revenue adjustments made within each operating fund.
Each change is consistent with the long-term financial objectives of the
City and will permit the City to end the fiscal year in good financial
health.
City staff recommends the adoption of Ordinance No. 2310 amending
the 1996-97 operating and capital improvement program budget.
Mr. Escalante stated changes from mid-year represent (1) $19,000 for
overtime for the Police Department; (2) additional funding for the Denton
Road Project, and (3) advance the Brookhaven Club Drive project one
year.
Mr. Escalante stated those were changes that were discussed in mid-year
review.
Councilman Moses commented in reference to the Denton Road
reconstruction, as to whether there will be sidewalks.
Mr. Escalante stated he does not believe there will be sidewalks the
entire length but there are certain places where sidewalks will be
incorporated.
Mr. John Burke, Assistant City Manager, stated there are sidewalks on
some streets in the Valley View area. Mr. Burke stated there was
discussion about a walkway along Denton Road, but currently there are
no plans for a sidewalk.
A motion by Councilwoman Davis, a second by Councilman Bird, all
voting "aye," added an amendment to proposed Ordinance No. 2310
with the stipulation that $200,000 in the General Fund Non-
Departmental, Dividend Program Projects, account be designated for
Marsh Lane and Webb Chapel beautification.

Mayor Phelps presented the following information for consideration. The
City Charter requires that the City Council designate an independent
certified public accountant to perform an annual audit of the City. The
City recently completed a five year audit services contract with the firm
of Arthur Andersen, L.L.P. The City Council determined that it was
appropriate to review audit firms and appointed Mayor Bob Phelps,
Councilmembers Calla Davis, and Charlie Bird to an Auditor Selection
Committee to review proposals, interview firms and recommend an
independent auditor.
The Auditor Selection Committee interviewed and rated four audit firms.
The firm receiving the highest score was Arthur Andersen, L.L.P.
Resolution No. 97-047 designates Arthur Andersen, L.L.P. as
independent auditor for a five year period and authorizes the City
Manager to enter into a letter agreement for audit services.
The Auditor Selection Committee recommends Arthur Andersen, L.L.P.
as the City's independent auditor and authorizes the City Manager to
enter into a letter agreement for audit services.
Councilwoman Davis stated as a member of the audit committee there
were four firms interviewed. Councilwoman Davis stated the committee
set-up a criteria and judged the firms. Arthur Andersen, LLP came out
with the highest rating and gave the best performance and review of
what they would provide for the City of Farmers Branch.
There being no further discussion, a motion by Councilwoman Davis, a
second by Councilman Pyle, all voting "aye," adopted Resolution No. 97-
047 designating Arthur Andersen, L.L.P. as independent auditor for a five

D.3 CONSIDER ADOPTING RESOLUTION NO. 97-058 AWARDING THE BID
FOR THE PURCHASE OF A SUPPLY OF AGGREGATE MATERIALS AND
TAKE APPROPRIATE ACTION.
Mayor Phelps presented the following information for consideration.
Requests for bids for the 1996-1997 supply of Aggregate Materials were
mailed to five 5 vendors. Four bids were received and opened on April 1,
1997. The bid consisted of sandy loam and four different types of
crushed limestone.
The lowest bids received meeting specifications were from Marock, Inc.
for three items. Big City Crushed Concrete, Inc. for another item, and
Caylor Specialties for the remaining item.
Funds in the amount of $47,500.00 are available in the 1996-1997
Public Works operating budget to purchase these items.
The Director of Public Works recommends that the 1996-1997 supply
of aggregate materials be awarded to the lowest bidders meeting
specifications for each item, Caylor Specialties, Big City Crushed
Concrete, Inc., and Marock, Inc. For a total payment not to exceed
$47,500.00.
There being no discussion, a motion by Mayor Pro Tern Moses, a
second by Councilman Pyle, all voting "aye," approved the 1996-1997
supply of aggregate materials to the lowest bidders meeting
specifications for each item, Caylor Specialties, Big City Crushed

D.4 CONSIDER COUNCIL TRAVEL REPORTS AND REQUESTS AND THE
APPROPRIATE ACTION
Mayor Phelps stated last Thursday he made a trip to Bellaire, Texas
with Mayor Pro Tern Moses, Councilman Bird, City Manager Richard
Escalante, and Community Services Director Tom Scales, to look at
Bellaire's revitalization program.
Mayor Phelps stated they were all amazed at what they were doing and
all their accomplishments.

Mayor Phelps stated a real estate agent told the officials of Bellaire they
had three things going for them location, location, location. Mayor
Phelps stated he believed Farmers Branch has a better location than
Bellaire.
Mayor Phelps stated Bellaire started this project in 1986 by building
eight homes and since that time they have built 1304 homes with a
total value of $3.3 million added to the tax base. Mayor Phelps also
stated 4,920 homes have been remodeled with a total value of $33. 5
million.
Mayor Phelps stated in speaking with Mr. Escalante he requested that
Farmers Branch start a program like this. Mayor Phelps suggested
obtaining a realtor and builders to come up with a plan to revitalize
some of the older homes in Farmers Branch.
Mayor Phelps stated it was a long day, a well spent day that could
benefit Farmers Branch.
Councilman Bird stated he had a similar report as Mayor Phelps.
Councilman Bird stated he was impressed with Bellaire because it is a
city similar to Farmers Branch and at one time showing signs of aging.
Councilman Bird stated there were several things he was impressed
with. Bellaire being an "All American City," and many of the homes
having front entry garages, and garages not converted into another
room.
Councilman Bird stated the day was a very profitable day and a day will
spent by the Council.
Mayor Pro Tern Moses stated Bellaire's population was made up of 85
percent residential and 15 percent corporate which is the reverse of
Farmers Branch. Mayor Pro Tern Moses stated Bellaire's tax rate is .51
cent and Farmers Branch tax rate is .44 cent. He stated when homes
are taken care of the property value will increase.
Mayor Pro Tern Moses stated clearly he does not want to raise property
taxes, just that when properties are taken care of their value will go up.
Mayor Pro Tern Moses stated it was a successful day and those in
attendance were amazed at the success that Bellaire has had in the past
10 years with growth and planning.

Mr. Escalante stated he and staff did visit Bellaire, looked at the
community and took pictures but suggested you have to take the trip to
see how the houses are situated.
Mr. Escalante stated reading reports and looking at the studies, is not as
effective as visiting the community, speaking with officials, getting
good information, and bringing back the information to Farmers Branch.
Mr. Escalante stated at the next City Council meeting, the Council has
directed staff to make a presentation on housing redevelopment. Mr.
Escalante stated what was seen on the trip to Bellaire will play a key
role in developing the Farmers Branch program.
Mr. Escalante stated this plan will be proposed to the City Council on
May 5, 1997.
Mayor Pro Tem Moses stated the tour showed the difference between
the cities of Bellaire and Houston. Mayor Pro Tem Moses stated when
driving down one street that divided the two cities, on one side of the
street house maintenance was not kept up, and across the street you
could see the difference in what code enforcement has done for
Bellaire.
D.5 CITIZEN PARTICIPATION
Mr. Nick Korba, 13210 Shahan Drive, stated there is a building at the
northwest corner of Tanglewood and Brookhaven that is listed as 3663
Brookhaven Club Drive, and it is not listed on the computer tax roll.
Mr. Korba asked if the building was on the tax roll or is it tax free.
Ms. Debbie Champion, Chief Accountant, stated the address is not on
tax roll but she spoke with the Engineering Department and the building
is part of 13905 Tanglewood.
Mr. Korba questioned the discrepancy between the mailing address and
the tax address.
Ms. Champion replied that she was not aware of postal regulations but
would be glad to check into this matter.
Mayor Phelps stated there could be no action taken on this matter.
Mr. Korba asked Council to check into the property and maybe change
the address.

Mayor Pro Tem Moses stated as a citizen he and wife Barbara would
like to donate their two rebate checks to the Farmers Branch Senior
Citizens Game Night. Mayor Pro Tern Moses also stated on behalf of a
former employee of Farmers Branch, Ruth Ann Parish, she and her
husband J. T. Parish would like to also donate their tax rebate check to
the Farmers Branch Senior Citizens Game Night.
Mr. Tom Scales, Director of Community, stated in response to the
property located at Brookhaven and Tanglewood. The property has a
dual address, the mailing address is not the same as the tax address
that shows up on files at the County.
Mr. Scales stated it is confusing and suggested it needs to be worked
out on the computer system and he would work with Ms. Champion on
correcting the problem.
Mr. Korba asked about the type of building that is on the property.
Mr. Scales stated the building was used as a sales office for
Brookhaven Development. Mr. Scales stated they could ask the
property owner to remove the building.
Mayor Phelps asked if the building was used at all or was it empty.
Mr. Scales stated to the best of his knowledge it is vacant.
