A.1 INVOCATION AND PLEDGE OF ALLEGIANCE. Mayor Phelps gave the invocation and led the pledge of allegiance. Volume 98, page 1 A.2 PRESENTATION ANNOUNCING THE GRAND OPENING OF THE CITYWIDE WIFI NETWORK. Alan Crancer, Vice President of Sales and Marketing from MobilePro/Kite, gave an update on the Farmers Branch WiFi and stated the commercial launch date will be November 1, 2006. A.4 PROCLAIM THE MONTH OF OCTOBER 2006 AS "FIRE PREVENTION MONTH" IN FARMERS BRANCH, TEXAS. Mayor Phelps presented the following information. The Fire Department will be busy throughout the month of October presenting fire prevention programs at schools in Farmers Branch. The programs are age specific and teach a variety of fire and life safety topics. The Branch Brigade Clowns, made up of Fire Department personnel, will perform for the youngest students. Fire Administration and the Fire Prevention Division personnel will use storytelling, games and demonstrations to teach the older children about safety. The Fire Department also sponsored the Eleventh Annual Fire Prevention Poster Contest for the third grade students in Farmers Branch schools. Mayor Phelps read and presented a proclamation to Chief King, Lieutenant Reginald Alexander, and Fire Prevention Training Coordinator Wendi Kimpton, proclaiming October 2006 as "Fire Prevention Week" in Farmers Branch, Texas. A.3 PRESENTATION OF AWARDS FOR THE FIRE PREVENTION POSTER CONTEST. The Mayor and Fire Department staff presented awards to winners in the Eleventh Annual Fire Prevention Poster Contest. All third grade students from Farmers Branch Elementary, Janie Stark Elementary, Dave Blair Intermediate and Mary Immaculate School were invited to participate. The Best of Show went to Adrian Lopez of Janie Stark Elementary. A.5 PRESENTATION OF BOARD APPLICATIONS. There were no applications presented. A.6 REPORT ON STUDY SESSION ITEMS. Mayor Phelps and the City Council gave a brief summary of the items discussed in Study Session. B.0 CONSIDER THE FOLLOWING AS CONSENT ITEMS AND TAKE APPROPRIATE ACTION. Volume 98, page 2 Mayor Phelps stated consent items are items that are to be considered that may not need discussion individually. Any member of the City Council or the audience may request to withdraw any item from the consent items and place the item before the Council for full discussion. The concept for consent items is to speed up discussion for those items that need more time for discussion. A motion by Mayor Pro Tern Robinson, seconded by Deputy Mayor Pro Tern O'Hare, all voting "aye," added Agenda items D.1, D.2 and D.3 to the Consent Agenda. A motion by Mayor Pro Tem Robinson, seconded by Councilman Smith, all voting "aye," accepted the Consent Agenda as amended. B.l APPROVED MINUTES OF CITY COUNCIL MEETING OF SEPTEMBER 18, 2006. B.2 ADOPTED ORDINANCE NO. 2887 AMENDING THE CITY OF FARMERS BRANCH CODE OF ORDINANCES, CHAPTER 82, TRAFFIC AND VEHICLES, ARTICLE II, DIVISION 6, SECTION 82- 95; PROHIBITING PARKING ALONG PORTIONS OF DISTRIBUTION WAY. AN ORDINANCE OF THE CITY OF FARMERS BRANCH, TEXAS AMENDING THE CODE OF ORDINANCES, CHAPTER 82, TRAFFIC AND VEHICLES, ARTICLE II, OPERATION OF VEHICLES, DIVISION 6, PARKING, SECTION 82-95, NO PARKING ZONES; REPEALING ANY CONFLICTING ORDINANCES; PROVIDING A PENALTY; PROVIDING A SEVERABILITY CLAUSE, AND PROVIDING AN EFFECTIVE DATE. B.3 ADOPTED RESOLUTION NO. 2006-105 REJECTING ALL PROPOSALS FOR GROUP SHORT-TERM DISABILITY INSURANCE. D.1 ADOPTED ORDINANCE NO. 2880 APPROVING THE REQUEST FROM METROPCS FOR A SPECIFIC USE PERMIT TO COLLOCATE A SIX-PANEL CELLULAR ANTENNA SYSTEM ON THE FARMERS BRANCH WATER TOWER LOCATED ON APPROXIMATELY 6.01 ACRES AT 3725 VALLEY VIEW LANE, GENERALLY LOCATED ON THE NORTH SIDE OF VALLEY VIEW LANE AND EAST OF MARSH LANE WITHIN THE ONE FAMILY RESIDENCE DISTRICT- 2 ZONING DISTRICT AND TAKE APPROPRIATE ACTION. Volume 98, page 3 D.2 ADOPTED RESOLUTION NO. 2006-103 ENDORSING THE "JOINT RECOMMENDATION FOR REGIONAL RAIL IN NORTH CENTRAL TEXAS" AS APPROVED BY THE BOARDS OF DALLAS AREA RAPID TRANSIT, THE DENTON COUNTY TRANSPORTATION AUTHORITY AND THE FORT WORTH TRANSPORTATION AUTHORITY. D.3 ADOPTED RESOLUTION NO. 2006-104 AUTHORIZING PURCHASES OF OFFICE SUPPLIES UTILIZING THE TARRANT COUNTY COOPERATIVE PURCHASING PROGRAM CONTRACTOR. C.1 PUBLIC COMMENTS. Karen Smith, 3720 Blue Trace, stated she would like to see a user-friendly animal shelter in Farmers Branch with appropriate signage. Tony Salerno, 2519 Danny Lane, stated he would like for the City to have a cost- benefit analysis conducted regarding how much it is costing the City to pursue enforcing federal illegal immigration laws. Matt Burton, 3212 Rolling Knoll Place, spoke supporting proposals regarding illegal immigration. Kathleen Matsumura, 3938 Clubway Drive, stated she would like to see citizens involved in the Revitalization Task Force. Thomas Bohmier, 14506 Oakmont Drive, stated he was encouraged regarding the turn around in code enforcement and spoke supporting proposals regarding illegal immigration. D.l CONSENT. D.2 CONSENT. D.3 CONSENT. DA CONSIDER APPOINTMENTS TO THE PARKS AND RECREATION BOARD AND COMMUNITY WATCH COMMITTEE AND TAKE APPROPRIATE ACTION. A motion by Councilman Smith, seconded by Deputy Mayor Pro Tem O'Hare, all voting "aye," reappointed Jimmy Thompson, Joan Abbey, Margaret Young and Patricia Thompson to the Parks and Recreation Board. Volume 98, page 4 D.5 CONSIDER COUNCIL TRAVEL REPORTS AND REQUESTS, AND COUNCIL COMMITTEE AND ORGANIZATION REPORTS, AND TAKE APPROPRIATE ACTION. There were no travel reports or requests. Mayor Phelps stated on September 25, 2006, City Manager Linda Groomer, Assistant City Managers Mary Jane Stevenson, Greg Vick, Tina Firgins and he attended the Vision North Texas Conference in Arlington, Texas. Mayor Phelps stated on October 2, 2006, Public Works Director Mark Pavageaux and he attended a meeting with Maureen Dickey, County Commission of District 1, regarding the shut down of the Precinct 4 road and bridge division. MAYOR PHELPS ANNOUNCED THAT THE ITEMS ON THE AGENDA FOR THE EXECUTIVE SESSION WERE DISCUSSED AFTER THE REGULAR CITY COUNCIL STUDY SESSION MEETING. MAYOR PHELPS EXPLAINED THE CITY COUNCIL CONVENED INTO EXECUTIVE SESSION AT 5:05 P.M. AND CONCLUDED THE EXECUTIVE SESSION AT 5:40 P.M. FOR THE REGULAR CITY COUNCIL MEETING AT 6:30 P.M. TEXAS GOVERNMENT CODE CHAPTER 551 OF THE OPEN MEETING LAW PROVIDES THAT SUCH ITEMS AS PERSONNEL MATTERS, LAND ACQUISITION AND PENDING AND CONTEMPLATED LITIGATION MAY BE DISCUSSED IN CLOSED SESSION. E.1 DISCUSS CONFIDENTIAL SALES TAX INFORMATION -TEXAS TAX CODE SECTION 321.3022 (I). Discuss confidential sales tax information. Mayor Phelps stated that staff was present to discuss this item with City Council. E.2 DISCUSS LAND ACQUISITIONS - TEXAS GOVERNMENT CODE SECTION 551.072. Discuss Keenan Cemetery acquisition. Discuss land sale, purchase, trade or lease of properties at 500 Huffines Road. Mayor Phelps stated that staff was present to discuss this item with City Council. F.1 CONSIDER NECESSARY ACTION ON ITEMS DISCUSSED IN THE EXECUTIVE SESSION. Mayor Phelps explained that Council was updated on items in executive session and no action was necessary.
