2012-08-02 CC Minutes��� �� �� FARMERS BRANCH City of Farmers Branch City Council Special Meeting Minutes City Hall Plaza 13000 William Dodson Parkway Farmers Branch, Texas 75234 Thursday, August 2, 2012 6:00 p.m. The meeting was called to order by Mayor Pro Tern Koch at 6:00 p.m. with the following members of the City Council present: Mayor Pro Tern David Koch Deputy Mayor Pro Tern Tim Scott Councilmembers Ben Robinson Harold Froehlich Jeff Fuller The following members of the Administration were present: City Manager City Attorney Finance Director City Secretary Gary D. Greer Pete Smith Charles Cox Angela Kelly Trey Dowdy and Jadd Masso from Strasburger Attorneys at Law were also present. And with a quorum present, the following items were addressed: REGULAR MEETING 1. Invocation and Pledge of Allegiance. Deputy Mayor Pro Tern Scott gave the Invocation and Councilmember Froehlich led the Pledge of Allegiance. Mayor Pro Tern Koch read the captions for Agenda Items 2 and 3 aloud: City Council Special Meeting Minutes of August 2, 2012 Page 1 of 3 2. Discussion, consideration, and possible action regarding lawsuit styled Villas at Parkside Partners, et. al. v The City of Farmers Branch, Texas, Case No. 10 -10751 in the United States Court of Appeals for the Fifth Circuit. 3. Discussion, consideration, and possible action regarding lawsuit styled Ramos v The City of Farmers Branch, Texas, et. al, Case Nos. 06- 12227; 07 -04936 and 08- 01277, 116th Judicial District Court, Dallas, County, Texas. EXECUTIVE SESSION The City Council convened into Executive Session at 6:08 p.m. 4. Discuss pending and contemplated litigation — Texas Government Code Section 551.071: (a) Pending litigation styled Villas at Parkside Partners, et. al. v The City of Farmers Branch, Texas, Case No. 10 -10751 in the United States Court of Appeals for the Fifth Circuit. (b)Pending litigation styled Ramos v The City of Farmers Branch, Texas, et. al, Case Nos. 06- 12227; 07 -04936 and 08- 01277, 116th Judicial District Court, Dallas, County, Texas. The City Council concluded Executive Session at 7:21 p.m. THE COUNCIL RECONVENES INTO OPEN SESSION The City Council reconvened into Regular Session at 7:23 p.m. 5. Consider necessary action on items discussed in the Executive Session. No action was taken regarding Agenda Item 4(a). The following action was taken regarding Agenda Item 4(b): Motion by Councilmember Fuller to approve the settlement and authorize the City Manager to sign all necessary documents on behalf of the City of Farmers Branch to settle the Ramos I, Ramos II, and Ramos III cases by accepting the terms of the settlement, which terms include a dismissal of these cases with prejudice, the City paying attorneys' fees as agreed to be accepted by the Plaintiff's attorneys, the City recording its closed meetings for a period of five years, and the parties not disparaging one another. Motion seconded by Deputy Mayor Pro Tem Scott; motion passed with all ayes. 6. Adjournment. Motion by Councilmember Robinson to adjourn; motion seconded by Councilmember Froehlich.
