1969-05-27 CC MinutesCITY OF FARMERS BRANCH MINUTES OF A SPECIAL MEETING CITY COUNCIL May 27, 1969 7:30 P. M. The following members of the City Council were present: Mayor W. C. Roberts, Jr. Mayor Pro-Tem George Grimmer Councilmen John Helms Al Korioth W. R. Linn City Manager Dennis Spellmann City Attorney H. Louis Nichols Acting City Secretary J. W. Wade Councilman Ed Schedler was absent. Mayor Roberts called the meeting to order. REQUEST TO LOWER THE VOTING AGE FROM THE YOUNG DEMOCRATS After some discussion on the request from the Young Democrats to write to the Governor concerning lowering the voting age to 18, the Council elected to write to the Governor individually. ORDINANCE NO. 800 - BUILDING CODE BOARD OF APPEALS TO THE BOARD OF ADJUSTMENT After some discussion, a motion by Councilman Korioth, a second by Councilman Grimmer, all voting "ayes", passed the following captioned ordinance: AN ORDINANCE AMENDING SECTION 111 OF THE BUILDING CODE SO AS TO PROVIDE THAT THE ZONING BOARD OF ADJUSTMENT SHALL SERVE AS THE BOARD OF ADJUST- MENTS AND APPEALS AS PROVIDED FOR IN SECTION .111 OF THE BUILDING CODE; PROVIDING THAT THE PROCEDURE OF THE BOARD OF ADJUSTMENT SHALL BE APPLICABLE TO APPEALS UNDER THE BUILDING CODE; FIXING THE AUTHORITY OF THE BOARD OF ADJUSTMENT TO SITTING AS A BOARD OF ADJUSTMENTS AND APPEALS UNDER THE BUILDING CODE; AND DECLARING AN EMERGENCY. Page 109 ORDINANCE NO. 801 - NO PARKING ON PORTION OF GOLFING GREEN DRIVE Upon a motion by Councilman Korioth, a second by Councilman Linn, passed the following captioned ordinance with a vote of 3 to 1 with Councilmen Korioth, Linn, Grimmer voting "ayes" and Councilman Helms voting 'nay". AN ORDINANCE OF THE CITY OF FARMERS BRANCH, TEXAS, MAKING IT UNLAWFUL FOR ANY PERSON TO STOP, STAND OR PARK A VEHICLE, EXCEPT IN COM- PLIANCE WITH THE LAW OR THE DIRECTIONS OF ANY POLICE OFFICER OR TRAFFIC CONTROL OFFICER OR TRAFFIC CONTROL DEVICE ON THE WEST SIDE OF GOLFING GREEN DRIVE FROM ITS POINT OF INTER- SECTION WITH ERMINE WAY TO A POINT THREE HUNDRED (300) FEET SOUTH ON THE WEST SIDE OF GOLFING GREEN DRIVE IN THE CITY OF FARMERS BRANCH; PROVIDING FOR A PENALTY; AND DECLARING AN EMERGENCY. ORDINANCE NO. 802 - REDUCES SPEED LIMIT ON GOLFING GREEN Upon a motion by Councilman Helms, a second by Councilman Korioth, all voting "ayes", passed the following captioned ordinance: AN ORDINANCE OF THE CITY OF FARMERS BRANCH, TEXAS, ESTABLISHING A SPEED ZONE ON GOLFING GREEN DRIVE BETWEEN WEBB CHAPEL ROAD AND JOSEY LANE IN THE CITY OF FARMERS BRANCH, TEXAS, AND MAKING IT UNLAWFUL FOR ANY PERSON TO OPERATE ANY MOTOR VEHICLE ON SAID STREET AT A SPEED GREATER THAN TWENTY (20) MILES PER HOUR; PROVIDING FOR A PENALTY, AND DECLARING AN EMERGENCY. ORDINANCE NO. 803 - PARKING ON PRIVATE PARKING LOTS Upon a motion by Councilman Grimmer, a second by Councilman Korioth, all voting "ayes", passed the following captioned ordinance: AN ORDINANCE OF THE CITY OF FARMERS BRANCH, TEXAS, PROHIBITING THE PARKING OF MOTOR VEHICLES EXCEEDING TWO THOUSAND (2, 000) POUNDS, MANU- FACTURER'S RATED CARRYING CAPACITY, ON PRIVATE PROPERTY FROM 6:00 P.M. TO 7:00 A. M. DAILY, EXCEPT WHERE PARKED ON SAID LOTS WITH THE PERMISSION OF THE OWNER OR IN AREAS ZONED BY THE CITY OF FARMERS BRANCH AS LIGHT INDUSTRIAL, HEAVY INDUSTRIAL, OR COMMERCIAL; PROVIDING FOR A PENALTY, AND DECLARING AN EMERGENCY. Page 110 MEMBER OF RECREATION AND ACTIVITIES BOARD Mr. Wayne Glenn appeared before the Council seeking recommendations to help Recreation and Activities Board function. Mr. Glenn suggested in Ordinance 758, paragraph 3 concerning the absence of members be changed to where any member is absent 2 consecutive meetings without justification shall be automatically considered for removal by the City Council. AMEND BOARD ORDINANCES Upon a motion by Councilman Korioth, a second by Councilman Linn, all voting "ayes", instructed the City Attorney to amend all Board ordinances whereas any member is absent two (2) consecutive meetings without justification shall be automatically considered for removal bythe City Council. 4th OF JULY ACTIVITIES After some discussion, a motion by Councilman Grimmer, a second by Councilman Helms, all voting "ayes", authorized the Recreation and Activities Board to contact the Jaycees about 4th of July activities and approved the expenditures the insurance and fire works. TP&L SEWER LINE EASEMENT Upon a motion by Councilman Korioth, a second by Councilman Helms, all voting "ayes", accepted zc sewer line easement from Texas Power and Light Company across a strip of land fifteen (15) feet in width over, across and upon those certain tracts of land in the Thomas Keenan Survey, Abstract No. 733 , Dallas County, Texas, being a part of a 1. 032 acre trace of land described in deed dated June 4, 1964 and recorded in Volume 331, Pages 1066 and 1067 and Pages 1069 and 1070. FLOOD CONTROL DUTIES ASSIGNED TO PLANNING AND ZONING After some discussion, a motion by Councilman Korioth, a second by Councilman Grimmer, all voting "ayes", instructed the City Attorney to prepare an ordinance to abolish the Flood Control Board and assign the functions of this board to the Planning and Zoning Board. REPEAL ORDINANCE NO. 682 - Citizens Executive Bond Committee After some discussion, a motion by Councilman Linn, a second by Council- man Korioth, all voting "ayes", instructed the City Attorney to prepare an ordinance which would repeal Ordinance No. 682 which appointed the Citizens Executive Bond Committee because they have served their purpose.
