APPROVAL OF MINUTES PUBLIC HEARING - FRED GONZALES Mayor Langdon opened the hearing. Mr. Gonzales presented his request that lots 9, 8, 7 and the west one-half of 6, Valley View Addition No. 1 be changed from 11R-5 zone under a special permit for a private school" to a "special permit for office use". Mr. Gonzales stated the property east of his is already zoned for office use and he would like to remodel this property to the best use for the City and himself. The Council questioned Mr. Gonzales on Deed re- strictions and the surrounding property owners' consent. Mr. Gonzales answered that the deed restrictions have been waived and he had listed the consent of the property owners. After some discussion on the consent of the property owners a motion by Councilman Schedler, seconded by Councilman Grimmer, all voting "ayes", closed the hearing. Page 4 The Council agreed that since this would be considered spot zoning, and that's what the City is trying to get away from, would like to hold this under advisement pending on Marving Springer's study of the zoning of the City. Upon a motion by Councilman Schedler, a second by Council- woman Broadhurst, all voting "ayes", tabled this hearing to hold under advisement, pending their decision for Marvin Springer's study. AWARD BID - DISPOSABLE REFUSE CONTAINERS Upon a motion by Councilman Schedler, a second by Council- woman Broadhurst, all voting "ayes", a resolution was passed whereas, on October 11, 1968 sealed bids were re- ceived and then opened and publicly read aloud for furnishing 490,000 garbage disposable refuse sacks; of the seven bids received, Bancroft Bag, Inc. submitted the lowest and best bid that met the specifications at $88.90/per thousand sacks; that the bid of Bancroft Bag, Inc. of $87,122.00 be accepted for a total of 490,000 sacks, and, that payment for the above/made from Acct. 5-206. PUBLIC HEARING DATE SET - DAVID MOSS Upon a motion by Councilman Roberts, a second by Council- woman Broadhurst, all voting "ayes", set the date of November 18, 1968 as the date for a public hearing re- quested by David Moss. Mr. Moss request to consider a zone change request on a 0.47 acre lot located between Spring Valley Road and Valwood Parkway, approximately 500 feet East of Denton Drive be changed from "L M" Manufacturing Zone to "S" Service Zone. PUBLIC HEARING - NORTHWOOD HOMES Mayor Langdon opened the hearing. Mayor Langdon explained the existing zoning and the requested zoning by Northwood Homes, Inc. on a 34.56 acre tract of land located on the north side of Valley View Lane west of Webb Chapel. This 34.56 acre tract comprises all of the vacant property at the northwest corner of Valley View and Webb Chapel, except a tract 500 ft. by 500 ft. located at the immediate corner of the intersection. The existing zoning is 11R-2" Single-Family Residential fronting 1200 ft. along Valley View and fronting 450 ft. along Webb Chapel from street intersection, the remainder of this vacant property is zoned "R-3" Single-Family Residential. Mayor Langdon explained Northwood Homes had deleted the area zoned "R-3" from this request. Page 5 The request is that the to "R-2.5" Sfngle-Family size change. The "R-2" requested, "R-2.5" zone both with 1800 sq.ft. h property zoned "R-2" be changed Residential, which means lot zone is 13,000 sq.ft. lot area; with 10,000 sq.ft. lot area, Ouse size. Mayor Langdon explained that Northwood Homes has stated and would sign an agreement to the City that their company would build nothing less than 1600 sq.ft. houses on the area now zoned 11R-311. Also, Northwood Homes is going to build a fence or wall around this project. Mr. Don White, 13060 Glenside, was the only person appearing in opposition. Mr. White questioned about the fence to be put up and was concerned on how this matter had been handled. The Council explained to Mr. White the proposal that Mr. Pollman of Northwood Homes had made to the City and the Council thought this was in the best interest to the City. Councilman Roberts commended Mayor Langdon and the City Manager Dennis Spellmann for the time and work they had spent with Northwood Homes on a solution for the best interest of the City on this valuable piece of property. Upon a motion by Councilwoman Broadhurst, a second by Councilman Schedler, all voting "ayes", closed the hearing. After the Council expressed their views a motion by Council- man Schedler, a second by Councilman Roberts, all voting "ayes", approved the zone change request "R-2" Residential to "R-2.5" Residential on location of property mentioned previously and to secure a written agreement on the proposal of 1600 sq. ft. house size on the now zoned "R-3" Single Family Residential from Northwood Homes, Inc. FIRST BAPTIST CHURCH AND METHODIST CHURCH REQUEST ZONE CHANGE A request for a Public Hearing on zone change to permit pre- school and kindergarten uses on property bound by Valley View Lane, William Dodson Parkway, Pepperwood Street and Goodland Street/,$Hsented by the First Baptist Church and the Webb Chapel Methodist Church of Farmers Branch. Attorney Louis Nichols advised that since this was sponsored by the church and not an individual that a zone change would not be necessary. The Council asked Attorney Louis Nichols to give a letter stating his opinions to the City on this subject. Councilwoman Broadhurst stated since the churches put up the fee of $100 for zone change request, that this Page 6 1 1 should be returned. The Council agreed. PROPOSED STUDY OF ZONING - MARVIN SPRINGER After some discussion on a proposal to prepare a land use and zoning study and recommendation for all of that portion of the City of Farmers Branch located east of Interstate Highway 35E by Marvin Springer and Associates, urban planning and area development consultants, a motion by Councilman Helms, a second by Councilman Roberts, all voting "ayes", authorized Marvin Springer and Associates to prepare the study mentioned above for the fee of $5,275.00. SIGN ORDINANCES City Attorney Louis Nichols explained that in order to amend the Comprehensive Zoning ordinance to change certain regulations in certain use districts so as to regulate temporary non-commercial signs and garage sale signs in certain use districts, the City will have to hold public hearings. Mr. Nichols advised the Planning and Zoning Commission would hold their hearing and make their re- commendation to the Council, then the Council would hold their hearing. Superintendent of Inspections T. J. Strother expressed the need of this sign amendment to the Council. Upon a motion by Councilman Schedler, a second by Council- man Roberts, all voting "ayes", authorized Attorney Louis Nichols to prepare the necessary ordinance providing for temporary signs. RAILROAD FLASHERS Councilman Helms inquired about the latest status with the Frisco Railway Company on the flashing signals especially at Valwood Parkway. Councilman Helms reported of complaints on near-accidents that happened at Valwood Parkway and the railroad. He stated that pressure is needed to be put on the company to get them rolling on putting up these flashers. Mayor Langdon said he would have the engineer to check with Frisco again and see what can be done to hurry this situation. L. L. KAMMERER Mr. Kammerer asked the Council for some information on his service station located corner of Valley View and Rossford. His question was -what would he have to do to get a permit to build or rebuild on his property? This is a fulfillment of our promise to you to adopt a Master Plan in order to eliminate the problems of the past. The Zoning problems of the present era have become so compli- cated that we as a City are faced with the continual threat of law suits unless we have a sound zoning ordinance and a Master Plan that will hold up in the courts. To evolve such a plan requires a firm foundation. It cannot be easily accomplished by amateur planners. For your protection we engaged the professional services of a man whose reputation for integ- rity and ability is recognized throughout the United States - Mr. Marvin Springer. His mission is two fold: (1) To recommend a zoning ordinance that will give the Planning and Zoning Board and the Council the most up-to-date tools to accomplish their job. (2) To develop a map showing his recommendations as to the highest and best use for each vacant piece of land. Mr. Springer will present his recommendations to you, the citizens, at the public hearing on February 6th and you will be given the opportunity to question Mr. Springer as to the reasons behind his recommendations. Your opinions regarding these recom- mendations will be tape recorded for detail study by the Board and the Council. No decisions will be made on any recommendations until after the public hearings have been held. The Board and the Council will study your comments and desires and Mr. Springer's recommendations.
