1969-02-03 CC MinutesCITY OF FARMERS BRANCH MINUTES OF A REGULAR MEETING CITY COUNCIL February 3, 1969 7:30 P.M. Members of the City Council present were: Mayor Mayor Pro-Tem Councilwoman Councilmen City Manager City Attorney City Secretary Robert H. Langdon Bill Roberts, Jr. Alma Broadhurst George Grimm r Ed Schedler, Jr. Dennis Spellmann H. Louis Nichols Ruth Ann Parish Councilman John Helms was absent. Mayor Langdon called the meeting to order. Joe McKissick, Minister of Webb Chapel Church of Christ gave the invocation. Mayor Langdon welcomed Girl Scout Troup No. 39 to the meeting and the girls lead the Council and audience in the pledge to the flag. HONORED GUEST Mayor Langdon introduced and welcomed County Commissioner Mr. John Whittington to the audience. Mr. Whittington reported to the Council and citizens that the City's request of County participation on a project of drainage structure installed on Valley View Lane at Rawhide Creek has been approved by the County Department of Public Works. Mr. Whittington reported the County participation on this project will be in the amount of $35,000.00. PRESENTATION OF AWARDS Mayor Langdon presented City employees with 5 ye ars of service an award. They were: Rosalie Brown Corporation Court Clerk; Bobby G. Phillips, F. L. Savage, Jr. R. Smalley and R. M. Tumminello, of the Fire Department. Then, Mayor Langdon presented awards to City employees with 10 years service and they were: Clyde Adams, Engineering Department; and Bennie Liles and James Renfroe, Fire Department. Page 44 CHARLES GARTNER'S REQUEST FOR SITE PLAN APPROVAL Mayor Langdon turned the item over to Mayor Pro-Tem Bill Roberts and stepped down due to being business associated with shopping centers. Mr. Jack Gay represented Charles Gartner and presented site plan and blue print of a proposed building which will be a Minnie Pearl Fried Chicken restaurant. Mr. Gay stated that the ordinance on Mr. Gartner's property does prohibit a drive-in restaurant but this is not a drive-in. This property is located at the corner of Fyke Road and Josey Lane. After consideration onthe Planning and Zoning recommendation of approval, a motion by Councilman Schedler, a second by Councilman Broadhurst, all voting "ayes", approved the site plan as requested. ABANDONMENT OF EASEMENT - WELCH AND MIDWAY ROADS Upon a motion by Councilman Schedler, a second by Council- man Grimmer, all voting "ayes", approved the request, to abandon of a 15 foot drainage and utility easement located i way between Welch Road and Midway Road and running from the right-of-way of L.B.J. Freeway to north of the north sub- division line, by property owner Mr. John M. Holladay. STREET NAME CHANGE - BETA ROAD TO SIGMA ROAD Upon a motion by Councilman Roberts, a second by Councilwoman Broadhurst, all voting "ayes", passed a resolution changing the street name of Beta Road to Sigma Road existing in the far east City limits of the City of Farmers Branch. BID TABULATION - BASEBALL FIELDS After some discussion, a motion by Councilman Grimmer, a second by Councilman Schedler, all voting "ayes", awarded the bid in the amount of $10,475.00 to United States Steel Corp. for three galvanized chain link back-stops and 12 small back-stops to be located at various park sites in the City. REQUEST CORPS OF ENGINEERS TO CONDUCT FLOOD PLAIN STUDY Upon a motion by Councilman Roberts, a second by Councilman Schedler, all voting "ayes", passed a resolution whereas, the City of Farmers Branch respectfully request the U. S. Army Corps of Engineers to undertake a study of the areas of Farmers Branch and Rawhide Creeks, and to investigate the intensity of flood and establish flood elevations along said water course. Page 45 FRISCO RAILWAY COMPANY - INSTALL RAILROAD CROSSING Upon a motion by Councilwoman Broadhurst, a second by Council- man Schedler, all voting "ayes", passed a resolution whereas, the St. Louis-San Francisco Railway Company is hereby author- ized to install a new crossing on Valley View Lane. ASSESSMENT PROGRAMING INVOLVING VALLEY VIEW - STREET PROJECT 062 City Manager Mr. Spellmann explained to the Council that through an error on the administration part that a public hearing would have to be called over on the assessment pro- gram involving Street Project #62. There was a difference in dates that was in the paper and the letter that was sent to the property owners. The property owners have been informed of this. Upon a motion by Councilman Schedler, a second by Council- woman Broadhurst, all voting "ayes", cancelled the previous date of February 3, 1969 as the public hearing date for the assessment of property owners on Valley View Lane in Street Project #62. Upon a motion by Councilman Schedler, a second by Councilman Grimmer, all voting"ayes", set the date of March 3, 1969 for public hearing for property owners being assessed on Valley View Lane in Street Project No. 62. RESOLUTION FOR PREPARATION FOR PLANS AND SPECIFICATIONS AND DIRECTING ADVERTISEMENT FOR BIDS IN ASSESSMENT PROGRAM ON SIDEWALKS ON JOSEY LANE AND MARK TWAIN. Upon a motion by Councilman Schedler, a second by Council- man Roberts, all voting "ayes", passed a resolution whereas, all of those portions of the following highways and streets shall be improved by constructing sidewalks, to-wit: Josey Lane from the north right-of-way line of Valwood Parkway to the south right-of-way line of Fyke; Mark Twain Drive from the east property line of Heartside Place to the west property line of Webb Chapel Lane; whereas, specifications were ordered to be made by the Director of Public Works; and, whereas, the City Secretary is hereby instructed to advertise for sealed bids for the construction of said improvements. ORDINANCE NO. 766 - ADOPTING PLUMBING CODE Upon a motion by Councilwoman Broadhurst, a second by Council- man Grimmer, all voting "ayes", passed the following captioned ordinance. Page 46 AN ORDINANCE OF THE CITY OF FARMERS BRANCH REGULATING THE INSTALLATION OF PLUMBING IN THE CITY OF FARMERS BRANCH BY ADOPTING "THE DALLAS PLUMBING CODE" BEING CITY OF DALLAS ORDINANCE NO. 12093 PASSED MARCH 4, 1969, OF THE ORDINANCES OF THE CITY OF DALLAS, TEXAS, AS THE OFFICIAL PLUMBING CODE OF THE CITY OF FARMERS BRANCH, SUBJECT TO CERTAIN AMENDMENTS CONTAINED HEREIN; PROVIDING FOR THE ISSUANCE OF PERMITS AND THE COLLECTIONS OF FEES THERE- FOR; PROVIDING FOR INSPECTIONS; PROVIDING FOR PENALTY OF FINE NOT TO EXCEED $200.00 FOR THE VIOLATION THEREOF; PROVIDING A SAVING CLAUSE AND REPEALING WITH ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. ORDINANCE NO. 767 - PROVIDES INCREASE IN TMRS. After some discussion concerning the retirement benefits for the city employee, a motion by Councilman Roberts, a second by Councilman Schedler, all voting "ayes", passed the following captioned ordinance; AN ORDINANCE PROVIDING FOR INCREASED MUNICIPAL CONTRIBUTIONS TO THE CURRENT SERVICE ANNUITY RESERVE AT RETIREMENT OF THE EMPLOYEES OF THE CITY OF FARMERS BRANCH, TEXAS. FIRE DISTRICTS DISCUSSED City Manager Mr. Spellmann lead a discussion which if the proposed ordinance and map of the Master Plan be approved by the City, considerable thought would have to be given on the subject of Fire Districts. Mr. Spellmann presented thoughts of changes of the Fire Districts 1 and 2; eliminate sheet iron or metal buildings or if necessary consider a heavy industrial district to allow this type of building in which a Fire District 3 could be formed. Mr. Spellmann stated this has been studied and is in need for further study. RESOLUTION EXTENDING NOR-TEX CONTRACTORS TIME After some discussion, a motion by Councilwoman Broadhurst, a second by Councilman Schedler, all voting "ayes", passed a resolution whereas, the City extended the time for completion of work under said contract to August 5, 1968 to the contractors named Nor-Tex on Water Project No. 38. PASS ORDER CALLING ELECTION - CITY OFFICIALS - APRIL 5, 1969 Upon a motion by Councilman Schedler, a second by Councilman Grimmer, all voting "ayes", passed an order that an election Page 47 be held in the City of Farmers Branch on the 5th day of April, 1969 for the purpose of electing three Councilmen places 1, 3, and 5 for a two year term, and that Tom Lisenby is appointed the Presiding Election Judge and Gerald Zekowski is appointed Alternate Presiding Judge, and the Presiding Election Judge shall appoint six Election Clerks to serve at the election; and, setting the absentee voting. W. A. TAYLOE - METAL BUILDING ADDITION Mr. Spellmann, City Manager, brought out to the Council that Mr. Tayloe has requested the addition of another metal building on his property located on the southwest corner of Valley View Lane and Nicholson Road, and there is a question con- cerning the pro rata fee. Mr. Spellmann recommended that the City not issue a building permit unless Mr. Tayloe meet the standards on the pro rata fee on Valley View and Nicholson Road and dedicate the right-of-way necessary on Nicholson Road. Upon a motion by Councilman Roberts, a second by Councilwoman Broadhurst, all voting "ayes", approved the recommendation of the City Manager and agreed that the City Manager should work with Mr. Tayloe for an agreement. Mayor Langdon announced that the Joint Public Hearing of the Planning and Zoning Board and the Council on February 6, 1969 will open at the City Hall but will reconvene up at the Recreation Center.
