1969-03-17 CC MinutesCITY OF FARMERS BRANCH MINUTES OF A REGULAR MEETING CITY COUNCIL March 17, 1969 7:30 P. M. Members of the City Council present were: Mayor Pro Tem W. C. Roberts, Jr. Councilwoman Alma Broadhurst Councilmen George Grimmer John D. Helms Ed Schedler, Jr. City Manager Dennis Spellmann City Attorney H. Louis Nichols City Secretary Ruth Ann Parish Mayor Langdon was absent. Mayor Pro Tem Bill Roberts called the meeting to order. Mr. Richard Seymour, Assistant minister of the Farmers Branch Church of Christ gave the invocation. APPROVAL OF MINUTES The minutes of a regular meeting, March 3, 1969 were considered and approved by motion of Councilwoman Broadhurst, a second by Councilman Grimmer, all voting "ayes". PRESENTATION OF APPRECIATION City Manager Mr. Spellmann presented to Mrs. Lauraleen Archer a certificate of appreciation for services rendered as interim librarian from the Council. A certificate of appreciation also was prepared for Mrs. Laura Jane Newkirk, not present, for her service for serving on the Planning and Zoning Board. ACCEPTANCE OF LETTER OF RESIGNATION - MRS. LAURA JANE NEWKIRK Upon a motion by Councilwoman Broadhurst, a second by Councilman Helms, all voting "ayea", accepted the resignation of Mrs. Laura Jane Newkirk from the Planning and Zoning Board due to the fact that she is moving from the City. Page 73 AWARD BID - SANITATION TRUCK WITH LOADER AND CONTAINERS After some discussion, a motion by Councilman Schedler, a second by Councilman Helms, all voting "ayes", accepted the bid from Pak-Mor Manufacturing Company on a 1969 Truck and Chassis with side loading unit in the amount of $12, 228. 00; and accepted the bid of Fabit Corporation in Lubbock, Texas for 70 3-cubic yard refuse containers in the amount of $9, 870. 00 and 30 4-cubic yard containers in the amount of $4, 730. 10 for the Sanitation Department and this be paid from 5-512. TABULATION OF BIDS ON SIDEWALK IMPROVEMENTS After some discussion and recommendation from City Manager and Director of Public Works, a motion by Councilman Grimmer, a second by Councilman Helms, all voting "ayes", rejected all bids for sidewalk improvements Street Project No. 68 on concrete and authorized the City Manager to readvertise for more bids. DATE SET FOR PUBLIC HEARING FOR ASSESSMENT ON STREET PROJECT NO. 68 Upon a motion by Councilman Schedler, a second by Councilman Helms, all voting "ayes", passed a resolution deemed it necessary to levy an assessment against the property and the owners thereof abutting upon Josey Lane from the north right-of-way line of Valwood Parkway to the south right-of-way line of Fyke Road; Mark Twain Drive from the east property line of Heartside Place to the west property line of Webb Chapel Lane; and fixing the date of April 21, 1969 the time for a public hearing of said owners. ORDINANCE NO. 774 - FIRE DISTRICT REGULATIONS After some discussion, a motion by Councilman Schedler, a second by Councilwoman Broadhurst, all voting "ayes", passed the following captioned ordinance with the deletion of HI-Heavy Industrial District uses mentioned four (4) times on page 2: AN ORDINANCE OF THE CITY OF FARMERS BRANCH, TEXAS, AMENDING ORDINANCE NO. 612, AN ORDINANCE OF THE CITY OF FARMERS BRANCH ADOPTING THE SOUTHERN STANDARD BUILDING CODE, 1965 EDITION, AS THE BUILDING CODE OF THE CITY OF FARMERS BRANCH, BY CREATING A THIRD FIRE DISTRICT, REGULATING CONSTRUCTION OF EXTERIOR WALLS IN ALL FIRE DISTRICTS, AND DESIGNATING THE LIMITS OF THE FIRST, SECOND AND THIRD FIRE DISTRICTS; PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200. 00) FOR EACH OFFENSE; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. a Page 74 ORDINANCE NO. 775 - OFFENSE TO LITTER After some discussion, a motion by Councilman Helms, a second by Councilman Grimmer, all voting "ayes", passed the following captioned ordinance: AN ORDINANCE OF THE CITY OF FARMERS BRANCH, TEXAS, MAKING IT AN OFFENSE TO THROW TRASH OR RUBBISH FROM ANY MOTOR VEHICLE OR TO DRIVE ANY TRUCK OR ANY VEHICLE WHICH IS CONSTRUCTED OR LOADED IN SUCH A MANNER AS TO CAUSE TRASH OR REFUSE TO BE BLOWN UPON STREETS AND PUBLIC PLACES IN THE CITY; PRO- VIDING FOR A PENALTY NOT TO EXCEED TWO HUNDRED ($200. 00) DOLLARS; AND DECLARING AN EMERGENCY. ORDINANCE NO. 776 - DOG REGULATIONS After Council discussion and recommendation from Mr. Roddy Johnson and Mr. Ken Wallace of the audience, a motion by Councilman Schedler, a second by Councilman Helms, all voting "ayes", passed the following captioned ordinance with the corrections marked on the filed copy: AN ORDINANCE OF THE CITY OF FARMERS BRANCH, TEXAS REQUIRING ALL DOGS MORE THAN SIX (6) MONTHS OF AGE TO BE VACCINATED; MAKING IT ILLEGAL TO PERMIT ANY DOG, WHETHER VACCINATED OR NOT, TO RUN AT LARGE WITHIN THE LIMITS OF THE CITY; MAKING IT ILLEGAL TO PERMIT A DOG TO ENTER A PLACE OR ESTABLISHMENT WHERE FOOD IS SOLD OR SERVED; PRESCRIBING THE PROCEDURE TO BE FOLLOWED IN OBTAINING A LICENSE; PROHIBITING NOISES AND DISTURBANCES BY DOGS; AUTHORIZING INFECTED DOGS TO BE DESTROYED; AUTHORIZING THE CHIEF OF POLICE OR OTHER POLICE OFFICER OR OTHER EMPLOYEE OF THE CITY TO IMPOUND DOGS RUNNING AT LARGE AND PRESCRIBING THE PROCEDURE FOR REDEEMING SUCH DOGS, OR AUTHOR- IZING THE DISPOSING OF DOGS NOT REDEEMED; PROVIDING A PENALTY FOR VIOLATION OF THE ORDINANCE BY FINE OF NOT LESS THAN TEN ($10. 00) DOLLARS NOR MORE THAN TWO HUNDRED ($200. 00) DOLLARS FOR EACH OFFENSE; AND DECLARING AN EMERGENCY. ORDINANCE NO. 777 - ANIMAL CONTROL ORDINANCE Upon a motion by Councilman Schedler, a second by Councilwoman Broadhurst, all voting "ayes", passed the following captioned ordinance: Page 75 AN ORDINANCE OF THE CITY OF FARMERS BRANCH, TEXAS, MAKING IT UNLAWFUL FOR ANY PERSON RAISING OR KEEPING ANY ANIMAL OR FOWL TO FAIL TO PREVENT ANY SUCH ANIMAL OR FOWL TO RUN AT LARGE WITHIN THE CITY OR GO UPON THE PREMISES OF ANOTHER; AUTHORIZING THE IMPOUNDING OF ANY SUCH ANIMAL OR FOWL; ESTAB- LISHING A POUND; PROVIDING FOR THE SALE OF SUCH ANIMALS OR FOWL AND THE DISPOSITION OF PROCEEDS OF SUCH SALE; PROVIDING FOR THE DESTRUCTION OF SUCH ANIMALS OR FOWL; ESTABLISHING POUND FEES; PROVIDING FOR REDEMPTION OF SUCH ANIMALS OR FOWL; PROVIDING FOR PENALTY NOT TO EXCEED TWO HUNDRED DOLLARS ($200. 00) FOR EACH OFFENSE; AND DECLARING AN EMERGENCY. ORDINANCE NO. 778 - INSTALL CROSSING ON INWOOD ROAD An Ordinance of the City of Farmers Branch, Texas granting the St. Louis Southwestern Railway Company of Texas the right to install a railroad crossing on Inwood Road, subject to certain conditions was discussed by the Council and citizens in the audience. Mr. Ken Wallace, 3141 Brincrest, suggested that a time limit on blocking traffic should be considered. Mr. George Grenier, 2817 Bay Meadows Circle, asked the Council on the maintenance of the crossing - who was responsible ? Mrs. Lottie Archer, 13333 Mt. Castle, discussed the danger of the flashers with arms. The proposed crossing does not call for the arms. After Council discussion, a motion by Councilman Grimmer, a second by Councilman Schedler, tabled this Ordinance No. 778. Councilwoman Broadhurst and Councilman Helms opposed. Mayor Pro Tem Roberts, voted to break the tie, voted to table the Ordinance. Motion carried 3to2. DALLAS COUNTY FIRE CONTRACT After Council discussion on continuing temporarily in fighting fires in Addison until further study has been made, a motion by Councilman Schedler, a second by Councilwoman Broadhurst, all voting "ayes", accepted the contract with the County of Dallas to furnish fire protection and to answer all fire calls in the area adjoining the corporate limits of the City in corporate areas. Page 76 RESOLUTION PROVIDING FOR WAIVER OF LOCATION FOR LONE STAR GAS COMPANY After some discussion, a motion by Councilman Grimmer, a second by Councilman Helms, all voting "ayes", passed a resolution whereas, two 30, 000-gallon petroleum gas tanks on property at the intersection of Alpha and Inwood Roads in the city limits of Farmers Branch to be re- located at least 50 feet from the Dallas North 'Ibllwayextension right-of-way, but less than 100 feet along the East boundary of said storage facility. RESOLUTION PROVIDING FOR THE IMPROVEMENT OF FORD ROAD 11 After some discussion, a motion by Councilman Grimmer, a second by Councilwoman Broadhurst, all voting "ayes", passed a resolution where- as, the Department of Public Works has submitted preliminary plans for improving Ford Road; and the improvements shown on the plans conform to recommendations made by the City to the adjoining propery owners; and the City concurs in the roadway alignment and future construction as shown on said plans. DATE SET TO MEET WITH SCHOOL BOARD The Council set the date of March 27, 1969 for a Special Meeting for the purpose of meeting with the School Board. The Council will meet at the City Hall at 7:30 P. M. then recess to the Administration office to meet with the School Board for the purpose to discuss the purchaseof the old Farmers Branch Elementary School, then reconvene back to the city hall. 5 P.M. 1 ity Secretary Page 77
