1968-02-05 CC MinutesCITY OF FARMERS BRANCH MINUTES OF A REGULAR MEETING CITY COUNCIL February 5, 1968 All members of the City Council were present: Mayor Mayor Pro-Tem Councilmen City Manager City Attorney Administrative Assistant City Secretary A. J. Airoldi Addison Bradford, Jr. George Grimmer Glen Doty Alma Broadhurst Bill Roberts, Jr. J. M. Orman H. Louis Nichols Philip Jackson Dorthanna Williams Mayor Airoldi called the meeting to order. Mr. Jack Ramsay, Covenant Presbyterian Church, gave the invocation. APPROVAL OF MINUTES The minutes of a special meeting, January 30, 1968, were considered and approved. REPORT FROM CITY CHARTER STUDY COMMITTEE Mr. William R. Linn, Chairman, presented the Committee's recommenda- tions to the City Council. Councilman Bradford moved to authorize preparation of an ordinance and to take the necessary steps to in- clude the proposed amendments to the City Charter in the City Elec- tion on April 6, seconded by Councilman Grimmer. A discussion followed and as a result Councilman Grimmer withdrew his second and Councilman Bradford withdrew his motion. Councilman Roberts moved to take the recommendations under advisement until the next Council meeting, seconded by Councilman Grimmer, all voting "ayes". PUBLIC HEARING - GARBAGE COLLECTION Mayor Airoldi opened the hearing to the public at 8:00 p.m. After four hours of pros and cons, Mayor Airoldi asked each member of the Council to express his opinion. After discussion and the closing of the hearing Councilman Bradford moved, the City Council appoint a committee of six citizens to make a study and investigate all Page 28 garbage collection systems and make a report to the Council as soon as practical, the citizens to use either cans or sacks to be picked up at the curb or the house line; Councilman Doty seconded the motion if amended to pick up at house line and leave cans at the curb. No vote taken on this motion. Councilman Roberts moved to appoint a committee of six members (the members to appoint a chairman) to investigate all systems and report to the Council, during the interim period sacks or cans can be used with the understanding that the sacks and/or cans be carried to the curb line; seconded by Councilwoman Broadhurst, all voting "ayes". Members of the City Council urged the citizens to use the sacks and earnestly requested that they cooperate with the City and that the City will do all possible to pick up all garbage while the committee is working. COMMITTE APPOINTED - GARBAGE COLLECTION The following citizens were appointed: Mayor Airoldi - Jerry Zekowski; Mayor Pro-Tem Bradford - Bill Case; Councilman Grimmer - Ed Smith; Councilman Doty - Ray Flaherty; Councilwoman Broadhurst - Gloria Dooley; Councilman Roberts - Sid Shaw. ORDINANCE NO. 710 - $1,500,000 GENERAL OBLIGATION BONDS Upon a motion by Councilman Bradford, a second by Councilman Grimmer, all voting "ayes", an ordinance was passed authorizing issuance of the following General Obligation Bonds: Street Improvement Bonds - $865,000 Police Department Bonds - 300,000 Park & Recreation Bonds - 275,000 Fire Department Bonds - 60,000 ORDINANCE NO. 711 - $1,000,000 REVENUE BONDS Upon a motion by Councilman Grimmer, a second by Councilman Bradford, all voting "ayes", an ordinance was passed authorizing issuance of the following Revenue Bonds: Waterworks System Bonds - $500,000 Sewer System Bonds - 500,000 ORDINANCE NO. 712 - $31,000 PARK WARRANTS Upon a motion by Councilman Roberts, a second by Councilwoman Broad- hurst, all voting "ayes", a resolution was passed directing the giv- ing of notice of intention to issue refunding bonds in the amount of $31,000. Page 29 ORDINANCE NO. 713 - AMEND ZONING - "TOWNHOUSE" Upon a motion by Councilwoman Broadhurst, a second by Councilman Grimmer, all voting "ayes", the following captioned ordinance was passed: AN ORDINANCE AMENDING THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF FARMERS BRANCH BY ADDING A NEW ARTICLE TO BE KNOWN AS ARTICLE VIIIA, PROVIDING FOR ATTACHED SINGLE FAMILY PLANNED UNIT DEVELOPMENT DISTRICT; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY OR FINE NOT TO EXCEED TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE; AND DECLARING AN EMERGENCY. PASS ORDER CALLING ELECTION - CITY OFFICIALS - APRIL 6, 1968 Upon a motion by Councilman Bradford, a second by Councilman Roberts, all voting "ayes", an order was passed that an election be held on April 6, 1968 for the purpose of electing a Mayor and two (2) Coun- cilmen for place numbers 2 and 4 for a term of two (2) years; post- ing notices, naming election judges and fixing absentee voting. ORDINANCE NO. 714 - ABANDON 15-FEET IN CULPEPPER ADDITION Upon a motion by Councilman Bradford, a second by Councilwoman Broadhurst, all voting "ayes", the following captioned ordinance was passed: AN ORDINANCE OF THE CITY OF FARMERS BRANCH ABANDONING A PORTION OF A 15-FOOT STRIP OF LAND DEDICATED FOR STREET PURPOSES WHICH IS NO LONGER NEEDED OR NECESSARY FOR PUBLIC STREET PURPOSES, BUT RESERV- ING AN EASEMENT FOR ALL PUBLIC UTILITY COMPANIES USING SAID STRIP FOR PUBLIC UTILITY PURPOSES; PROVIDING THAT SUCH ABANDONMENT SHALL BE IN FAVOR OF NEVA CULPEPPER AND ESTATE OF L. L. CULPEPPER, THE OWNERS OF THE ABUTTING PROPERTY; PROVIDING THAT SUCH ABANDONMENT SHALL BE INSOFAR AS APPLICABLE TO THE PUBLIC RIGHT, TITLE AND INTEREST IN AND TO SUCH RIGHT OF WAY FOR STREET PURPOSES ONLY; PRO- VIDING THAT SUCH ABANDONMENT SHALL NOT IN ANY WAY AFFECT THE RIGHT OF ANY PUBLIC UTILITY LOCATED IN SUCH RIGHT OF WAY; AND DECLARING AN EMERGENCY. BIDS ON PAVING VALLEY VIEW LANE - STREET PROJECT NO. 62 City Manager Orman presented the tabulation of bids received on January 26 on this project: Texas Bitulithic Company - $564,413.00 Uvalde Construction Company - 584,377.75 Austin Paving Company - 611,867.18 Councilman Bradford moved to accept the low bid of Texas Bitulithic Company and authorize the contract to be entered into at such time Page 30 as the bonds are sold, seconded by Councilman Roberts, all voting "ayes".
