1968-04-01 CC MinutesLJ n 1 CITY OF FARMERS BRANCH MINUTES OF A REGULAR MEETING CITY COUNCIL April 1,1968 All members of the City Council were Mayor Mayor Pro-Tem Councilmen City Manager City Attorney Administrative Assistant Director of Finance present: A. J. Airoldi Addison Bradford, Jr. George Grimmer Glen Doty Alma Broadhurst Bill Roberts, Jr. J. M. Orman H. Louis Nichols Philip Jackson J. W. Wade Mayor Airoldi called the meeting to order. Mr. Wade gave the invocation. APPROVAL OF MINUTES The minutes of a regular meeting, March 18 and a special meeting, March 25, were considered and approved. APPROVE SITE PLAN - FARMERS BRANCH SHOPPING CENTER Mr. Rand Holman presented the site plan on apartments to the Council for consideration and approval. After much discussion Councilman Doty moved approval of the site plan, seconded by Councilman Grimmer. Councilmen Doty, Grimmer and Bradford voting "ayes", Councilwoman Broadhurst and Councilman Roberts voting "nays". APPROVE SITE PLAN - BROOKHAVEN DEVELOPMENT, INC. Mr. Robert Meyers, Attorney, and Mr. Claycroft, Architect, pre- sented the site plan for apartment in Brookhaven Estates. After discussion the Council agreed to return the site plan to the Planning and Zoning Commission for their action. PETITION - REQUEST FOR CHANGE OF ZONING - BROOKHAVEN ESTATES A petition was filed by a group of home owners in the Brookhaven area requesting a public hearing for the purpose of rezoning the 13 acres (above) of special permit apartments to "R-2" Residential Classification. Page 54 Councilman Roberts moved to instruct the Planning and Zoning Commission to conduct a public hearing as petitioned, seconded by Councilwoman Broadhurst. Councilwoman Broadhurst and Coun- cilmen Roberts, Grimmer and Doty voting "ayes", Councilman Brad- ford voting "nay". Councilman Roberts moved to deny site plan approval, seconded by Councilwoman Broadhurst. Councilwoman Broadhurst and Coun- cilmen Roberts, Grimmer and Doty voting "ayes", Councilman Brad- ford voting "nay". ORDINANCE NO. 729 - MOBIL OIL COMPANY Upon a motion by Councilman Bradford, a second by Councilman Doty, all voting "ayes", the following captioned ordinance was passed: AN ORDINANCE AMENDING THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF FARMERS BRANCH, AS HERETOFORE AMENDED, SO AS TO CHANGE THE FOLLOWING DESCRIBED PROPERTY FROM "R-2.5" SINGLE FAMILY RESIDENTIAL ZONING TO "L-M" LIGHT MANUFACTURING ZONING CLASSIFI- CATION, SAID TRACTS BEING DESCRIBED AS FOLLOWS: A TRACT OF LAND OUT OF THE NOAH GOOD SURVEY, SAID DESCRIBED AS FOLLOWS: (legal desc ACRES OF LAND; THAT SUCH PROPERTY MANUFACTURING PURPOSES; PROVIDING TWO HUNDRED ($200.00) DOLLARS FOR AN EMERGENCY. TRACT BEING MORE PARTICULARLY ription) AND CONTAINING 79.54 IS TO BE USED FOR "L-M" LIGHT FOR A PENALTY NOT TO EXCEED EACH OFFENSE; AND DECLARING Included in the above action the Council authorized the purchase of 1.089 acres at $7,500 per acre for a fire station site. RESOLUTION - APPROVE CONTRACT FOR CITY DEPOSITORY Upon a motion by Councilman Grimmer, a second by Councilman Doty; Councilwoman Broadhurst and Councilmen Grimmer and Doty voting "ayes", Councilman Roberts voting "nay" and Councilman Bradford abstaining (for reason of being director of bank), a resolution was passed, whereas, the City of Farmers Branch, Texas, has here- tofore advertised for bids under the provisions of Article 2559 of the Revised Civil Statutes of Texas for the designation of a City Depository; that the City has received a bid and application from the Central Bank & Trust Company of the City of Farmers Branch to be designated as the City Depository; that the Central Bank & Trust Company has elected to pledge securities in lieu of a surety bond to secure the City deposits under the provisions of Article 2560 of the Revised Civil Statutes of Texas; that the Page 55 City of Farmers Branch desires to accept the application of the Central Bank & Trust Company to be designated as the City Deposi- tory; that the Central Bank & Trust Company of the City of Farmers Branch, Texas, is hereby designated the City Depository for the City of Farmers Branch under the provisions of Chapter 3, Title 47 of the Revised Civil Statutes of Texas, for the period of one (1) year, commencing the 18th day of March, 1968; and, that J. W. Wade be, and he is hereby authorized to execute the agreement between the City of Farmers Branch and the Central Bank & Trust Company, setting forth the conditions under which the Central Bank & Trust Company will act as the City Depository. PAYMENT TO AL HOPPER, APPRAISER - RIGHT-OF-WAY VALLEY VIEW LANE Councilman Roberts moved to table approval of payment for addi- tional information, seconded by Councilman Doty, all voting "ayes". PAYMENT TO RADY & ASSOCIATES - RIGHT-OF-WAY VALLEY VIEW LANE Councilwoman Broadhurst moved to table approval of payment, seconded by Councilman Grimmer, all voting "ayes". APPROVE SITE PLAN - SERVICE STATION - VALLEY VIEW CENTRAL Councilman Roberts moved to deny approval of this site plan, seconded by Councilwoman Broadhurst; Councilwoman Broadhurst and Councilmen Roberts, Grimmer and Doty voting "ayes", Council- man Bradford voting "nay". RIGHT-OF-WAY - VALLEY VIEW LANE - STREET PROJECT NO. 62 Rady and Associates offered to obtain the remaining right-of-way on this project for $100 per parcel. Councilman Roberts moved to authorize the City Manager to negotiate for $50 per parcel or on a per diem basis, seconded by Councilman Doty, all voting "ayes" ADDITIONAL APPRAISER FOR COTTEN CASE - STREET PROJECT NO. 56 Upon a motion by Councilman Bradford, a second by Councilman Roberts, all voting "ayes", City Attorney Nichols was authorized to select an additional appraiser for the City's condemnation case against Mr. Cotten. RESOLUTION - PAYMENT ON REFUSE BAGS Upon a motion by Councilman Doty, a second by Councilman Grimmer; Councilwoman Broadhurst and Councilmen Doty and Grimmer voting "ayes", Councilmen Bradford and Roberts voting "nays", a resolu- tion was passed, whereas, bids were previously received and con- tract entered into for furnishing refuse sacks; that the contract was rescinded by the City Council because of insufficient notice being given to prospective bidders; that 357,916 sacks were Page 56 delivered under the previous contract and have not been fully paid for; that new bids were received and a new contract entered into for furnishing sacks; that the sacks previously received should be paid for at the price quoted in the new bids; that the City Manager be, and is hereby, authorized to pay St. Regis Paper Company the sum of $8,960.13, the balance remaining due on 357.916 sacks which were received in November and December, 1967 and subsequently distributed to the citizens of Farmers Branch; and, that payment for the above be made from Account 13 B-6. FLASHING SIGNALS ON RAILROAD CROSSINGS -,STREET PROJECT NO. 62 City Manager reported on estimated costs of protecting Valley View Lane, Royal Lane and Valwood Parkway with flashing signals. The Katy Railroad had agreed to participate in one-half the cost if the City would raise the speed limit from 10 MPH to 45 MPH through the City. The cost to the City would be approximately $20,500. The three crossings on the Frisco could be protected for an estimated additional cost of $2,500. After discussion Councilwoman Broadhurst moved to accept the offer and to raise the speed limit to 45 MPH and that the speed limit be enforced; seconded by Councilman Doty. Councilwoman Broadhurst and Councilmen Doty, Grimmer and Roberts voting "ayes", Councilman Bradford voting "nay". BIDS ON REFUSE PACKER BODY City Manager Orman recommended that the Council reject all bids on the refuse packer body and to hold bids on the trucks until new bids could be received on the refuse packer body. Council- man Grimmer moved to accept the recommendation. seconded by Councilman Doty, all voting "ayes". DEFEND LAW SUIT FILED BY MR. ZEKOWSKI Upon a motion by Councilman Roberts, a second by Councilman Brad- ford, all voting "ayes", the Council authorized the City Attorney to defend the law suit and that any and all records are accessible to the public provided due notice is given and does not constitute an undue burden on city employees and payment made for all copies. After discussion on amending the motion, Councilman Roberts moved to rescind the motion, seconded by Councilman Bradford, all voting "ayes". Councilman Roberts moved to authorize the City Attorney to defend the law suit filed by Mr. Zekowski, seconded by Councilman Bradford, all voting "ayes". ADJOURNED - 11:10 P.M. Airoldi,-Mayor J. .
