1965-01-18 CC MinutesMINUTES OF A REGULAR MEETING CITY COUNCIL FARMERS BRANCH, TEXAS January 18, 1965 The following City Council members were present: Mayor A. J. Airoldi Mayor Pro-Tem Bill Hamilton Councilmen Frank Tippitt Ed Rhodes Dick Myers City Manager J. M. Orman City Attorney H. Louis Nichols City Secretary Dorthanna Williams Councilman Upfield arrived at 9:35 p.m. Mayor Airoldi called the meeting to order. Mr. W. T. Smith, Farmers Branch Church of Christ, gave the invocation. APPROVAL OF MINUTES The minutes of a regular meeting, January 4, were considered, corrected and approved. The minutes of a special meeting, January 11, were considered and approved. REQUEST BY MR. HIRAM GRIFFIN Mr. Hiram Griffin, Realtor, appeared before the Council with a request to stop Texas Industries construction of a concrete hatch- ing plant in the eastern part of the city. The Council informed Mr. Griffin that the zoning of the area allows such construction and it will be controlled by the "Performance Standards and Related Regulations For Industrial Areas" as prepared by Marvin Springer and Associates in November, 1963. DATES SET FOR PUBLIC HEARINGS The regular meeting of February 15 was the date set for the following public hearings: 7:30 - Mr. Charles Gartner 8:15 - G. M. Pointer 9:00 - Warren Clark ORDINANCE NO. 532 - MARVIN SPRINGER - FORD ROAD AND I.H. 635 Upon a motion by Councilman Myers, a second by Councilman Hamilton, all voting "ayes", the following captioned ordinance was passed: AN ORDINANCE SETTING FORTH THE COST OF SERVICES INVOLVING CONSULTA- TION AND PREPARATION OF ZONING AND STREET STUDIES FOR THE AREA Page 23 NORTH OF IH 635 AND EAST OF FORD ROAD BY MARVIN SPRINGER AND APPROPRIATING FUNDS THEREFOR OUT OF THE STREET IMPROVEMENT BOND FUND UNAPPROPRIATED SURPLUS. PETITION PRESENTED Mr. Alfred Bistany of Alexander, Mackey and Bistany, 1505 Dallas Federal Savings and Loan Building, presented a petition, with approximately 365 signatures, requesting that the City Council call an election in not less than 30 days nor more than 90 days to present to the voters two amendments to the City Charter. Mayor Pro-Tem Hamilton read a letter prepared by the City Attorney that the last Charter amendment was made in April, 1964. The provisions of the Home Rule Charter as well as the Article 1175 of the State Law provides that the Charter may not be amended more than once every two years. Since the last Charter amendment was in April, 1964, it would not be possible to amend your Charter until April, 1966. It is also my opinion that it is not possible to amend your Home Rule Charter without an election being called as is provided for under provisions of Article 1170 of Vernon's Revised Civil Statutes. The petition was filed with the City Secretary. CONTRACT SERVICE FOR BUILDING INSPECTION DIVISION After discussion on contract service for the Building Inspection Division the Mayor appointed a Committee of Councilmen Myers and Tippitt and City Manager Orman to have a recommendation within a week. AUDIT REPORT - 1963-1964 FISCAL YEAR Mr. J. R. Hurt, C. P. A., presented the Report of Examination for the year ended September 30, 1964. After discussion Councilman Tippitt moved that the Audit be accepted and that the Combined Balance Sheet - All Funds (page 32 - Exhibit H) be published in the official newspaper, seconded by Councilman Hamilton, all voting "ayes". Councilman Tippitt moved that Mr. J. R. Hurt be appointed Auditor for the 1964-1965 Fiscal Year and that the report be submitted to the Council by the first meeting in November, 1965; seconded by Councilman Hamilton, all voting "ayes". CONCRETE COMPANY TRUCKS DUMPING The City Manager was instructed to notify all concrete companies that they are not to dispose of surplus concrete or the wash water from their concrete mixers anywhere on city streets or other city property.
