1965-02-01 CC Minutes1 MINUTES OF A REGULAR MEETING CITY COUNCIL FARMERS BRANCH, TEXAS February 1, 1965 All members of the City Council were Mayor Mayor Pro-Tem Councilmen present: A. J. Airoldi Bill Hamilton Frank Tippitt Ed Rhodes Dick Myers James Upfield J. M. Orman H. Louis Nichols Dorthanna Williams City Manager City Attorney City Secretary Mayor Airoldi called the meeting to order. Mr. Gibbs Morton, St. Paul Lutheran church, gave the invocation. APPROVAL OF MINUTES The minutes of a regular meeting, January 18, were considered and approved. PUBLIC HEARING - MRS. DOROTHY ENGLAND - VALWOOD PARKWAY Mayor Airoldi read the request: To consider request of Mrs. Dorothy England that Lot 1, Block B, Valwood Park No. 2 be changed from "R-5" Single Family to special permit to allow office use. This property is located at 2501 Valwood Parkway. The Planning and Zoning Commission has recommended denial of this request. Mrs. Dorothy England presented her request use of the front of the house for office, the rear portion to be used as residen- tial. She discussed at length other business uses in residential areas of the city and petitions for and against her proposal. Mr. Bill Shepherd spoke in favor of the request. Those speaking in opposition were: Mr. and Mrs. Harvey Thompson, 2540 Valwood Parkway; Mr. Edward Tix, 2505 Valwood Parkway; Mr. L. R. Spence, 2503 Valwood Parkway. Councilman Rhodes moved to close the hearing, seconded by Council- man Upfield, all voting "ayes". Councilman Hamilton moved to deny the request, seconded by Council- man Upfield, all voting "ayes". Page 26 TOM WORSHAM CLAIM FOR DAMAGES TO CARPET Mr. Tom Worsham, 3011 Joanna, introduced his attorney, Ken Glacier, to present for the second time a claim for damage to his carpet in the amount of $300. This damage was caused by sewage backing up into his house. Attorney Nichols said it is illegal for the City to pay under the present laws and that there is no legal liability on the part of the City. PAVING POLICY IN INDUSTRIAL AREAS Mr. Olin Humphries, Assistant Manager of Industrial Development of Cotton Belt Railroad, was present to discuss the City's policy regarding developer's paving costs in industrial areas. The pav- ing in question is on Spring Valley Road in the Cotton Belt's development. After discussion the Council agreed to carry the present policy of participating in thoroughfare paving on into the commercial and other industrial areas the City will pay paving costs on pavement wider than 41 feet and thicker than 6 inches. CITY LIBRARY Mr. Peter Geilich, Chairman of the Library Board, reported to the Council that the Board was very pleased with the construction of the addition to the Library. He said he wanted to go on record as making a request from the Board for $1,600 for books for the Library. This amount was requested in the budget but was denied at the time. The Council deferred an answer until the first four months financial report was received. DAMAGE SUIT: CITY vs MRS. M. T. BOYD City Manager Orman explained that the City Attorney reported that this case will come up for trial in a few days. Involved is an injury to Mrs. Boyd when she stepped on a water meter box. Some- time ago her attorney offered to settle for $750, which was declined by the Council. Attorney Nichols says he believes he can get them to settle for $500. The Council agreed to go to Court with the case. ORDINANCE NO. 533 - WATER PROJECT NO. W-2$ & SANITARY SEWER PROJECT NO. 5-23 Upon a motion by Councilman Tippitt, a second by Councilman Myers, all voting "ayes", the following captioned ordinance was passed: AN ORDINANCE APPROPRIATING $409.11 OUT OF THE WATER BOND FUND UNAPPROPRIATED SURPLUS AND $100.41 OUT OF THE SANITARY SEWER BOND P 27 1 FUND UNAPPROPRIATED SURPLUS IN ORDER TO PROVIDE FUNDS FOR PREPARING WATER AND SANITARY SEWER PLANS ALONG THE EAST SERVICE ROAD NORTH OF COOKS BRANCH. Councilman Tippitt moved that Feazell Construction Company, the low bidder on the projects, be notified of the cancellation of the projects, seconded by Councilman Myers, all voting "ayes". Councilman Rhodes moved that the original agreement with Mr. Malone on the above projects be rescinded, seconded by Councilman Hamilton, all voting "ayes". TRAFFIC SIGNAL LIGHT - VALWOOD PARKWAY AND JOSEY LANE The Council authorized the advertising for bids for this traffic signal light. AUTHORIZE POSITION OF BUILDING INSPECTOR ENGINEER The City Manager requested that in lieu of employing a part-time consultant a full-time Building Inspector Engineer be employed to become head of the Inspection Division. After discussion Council- man Tippitt moved approval of this request, seconded by Councilman Myers, all voting "ayes". 1 AUTHORIZE BIDS ON PATROL CARS City Manager Orman reported that replacement of four patrol cars is needed and asked for authority to advertise for bids. These patrol cars are included in the approved budget for the Police Department. Councilman Upfield moved approval, seconded by Coun- cilman Hamilton, all voting "ayes". DATE SET FOR WARREN CLARK PUBLIC HEARING March 1, 1965 was date set for public hearing on zone change request by Warren Clark. ADJOURNMENT - 10:50 p.m. fJ A. J.
