1965-02-15 CC Minutes1 1 MINUTES OF A REGULAR MEETING CITY COUNCIL FARMERS BRANCH, TEXAS February 15, 1965 All members of the City Council Mayor Mayor Pro-Tem Councilmen City Manager City Attorney City Secretary were present: A. J. Airoldi Bill Hamilton Frank Tippitt Ed Rhodes Dick Myers James Upfield J. M. Orman H. Louis Nichols Dorthanna Williams Mayor Airoldi called the meeting to order. Mr. Marlin Maddoux, Bethany Temple Church, gave the invocation. APPROVAL OF MINUTES The minutes of a Regular Meeting, and approved. February 1, 1965 were considered PUBLIC HEARING - ZONE CHANGE REQUEST - CHARLES GARTNER Mr. Charles Gartner requested a change in zoning from "R-5" to "C" Commercial on a 10-acre tract of land on the southeast corner of Fyke Road and Josey Lane. The Planning and Zoning Commission recom- mended denial of this request. Mr. Morris Jaffe, Attorney for Mr. Gartner, spoke in favor of this zone change. He introduced the architect who presented plans for the development of the 10-acre tract. Others speaking in favor of the change were: Mr. Gartner, Mr. Lonnie Hudkins and Mr. Ed Schedler. Those speaking against the request were: Messrs. Grady Cates and Sam Laughlin, developers of Valwood Village; and Mr. Pat Murphree, 1914 Lawndale, Carrollton. Councilman Myers moved that the hearing be closed, seconded by Councilman Tippitt, all voting "ayes". Councilman Rhodes moved to table the decision for two weeks, seconded by Councilman Upfield, all voting "ayes". Page 29 PUBLIC HEARING - ZONE CHANGE REQUEST - GERALD POINTER Mr. Gerald Pointer requested a change in zoning from "C" Special Permit allowing office buildings, dental and medical offices and clinics, and public utility center to "C" Special Permit to allow the following additional uses: gasoline service station, barber shop, drive-in grocery store, cleaning and Laundry establishment. This tract of land has a depth of 300 feet and lies on the south side of the proposed extension of Hollandale Lane. The Planning and Zoning Commission recommended denial of this request. Mr. Pointer presented his reasons for the changes per his request. Mr. Grady Cates spoke in opposition to the change. Councilman Upfield moved that the hearing be closed, seconded by Councilman Myers, all voting "ayes". After discussion Councilman Myers moved change from Special Permit to "C" Commercial Classification, seconded by Councilman Rhodes, all voting "ayes". PUBLIC HEARING - ZONE CHANGE REQUEST - WARREN CLARK Mr. Warren Clark requested a change in zoning on two tracts: one involves a 5-acre irregular shaped tract located east of Rawhide Creek along the north side of the proposed extension of Pebble Beach Drive in Brookhaven Hills Addition (from "R-3" to "R-211); the second involves a 20-acre irregular shaped tract located west of Rawhide Creek along both sides of the proposed extension of Pebble Beach Drive in Brookhaven Hills Addition (from "R-2" to "R-3"). The Planning and Zoning Commission has recommended that the request on the former be denied and that the latter request be granted. Mr. Clark presented his request to the Council. There was no opposition to the change. Councilman Myers moved that the hearing be closed, seconded by Councilman Tippitt, all voting "ayes". After discussion Councilman Myers moved approval of the request, seconded by Councilman Tippitt, all voting "ayes". ORDINANCE NO. 534 - APPROPRIATE FUNDS FOR LIBRARY BOOKS Upon a motion by Councilman Myers, a second by Councilman Tippitt, all voting "ayes", the following captioned ordinance was passed: AN ORDINANCE APPROPRIATING $800 FROM GENERAL FUND RESERVE TO ACCOUNT 18 Z-5 FOR THE PURCHASE OF LIBRARY BOOKS. Page 30 APPOINTMENT TO LIBRARY BOARD Upon a motion by Councilman Rhodes, a second by Councilman Myers, all voting "ayes", Mrs. Harris T. Clark, 13640 Littlecrest, was appointed to the Library Board to fill a vacancy left by Mrs. Vera McDaniel's resignation (moved out of state). Mrs. Clark's term to expire May, 1965. ORDINANCE NO. 535 - APPROPRIATE FUNDS FOR BUILDING INSPECTOR ENGINEER Upon a motion by Councilman Hamilton, a second by Councilman Tippitt, all voting "ayes", the sum of $4,422 was appropriated by the follow- ing captioned ordinance: AN ORDINANCE PROVIDING FUNDS FOR THE SALARY, RETIREMENT FUND CONTRIBUTION, SOCIAL SECURITY, INSURANCE AND CAR ALLOWANCE FOR THE BUILDING INSPECTOR ENGINEER AND APPROPRIATING FUNDS TO ACCOUNTS 10 AND 20 FROM GENERAL FUND RESERVE. ORDINANCE NO. 536 - SETTING SPEED LIMITS IN CITY Upon a motion by Councilman Rhodes, a second by Councilman Tippitt, all voting "ayes", the following captioned ordinance was passed: AN ORDINANCE DEFINING MOTOR VEHICLE; REGULATING THE SPEED OF MOTOR VEHICLES OPERATED WITHIN THE CITY OF FARMERS BRANCH, TEXAS; ESTAB- LISHING MAXIMUM SPEED LIMITS AT DESIGNATED PLACES WITHIN THE CITY; PROVIDING A PENALTY FOR VIOLATION OF THE PROVISIONS OF THIS ORDINANCE; REPEALING ALL ORDINANCES. FIRE FIGHTING CONTRACT - COUNTY AND CITY Upon a motion by Councilman Tippitt, a second by Councilman Hamilton, all voting "ayes", the annual Fire Fighting Contract, in the amount of $2,500, between the County of Dallas and the City of Farmers Branch was approved. RESCIND RESTRICTION ON COUNTRY CLUB ESTATES Upon a motion by Councilman Rhodes, a second by Councilman Hamilton, all voting "ayes", action taken on December 21, 1964 (Volume 11, page 14) to restrict issuance of building permits was rescinded by the Council. ORDINANCE NO. 537 - STREET PROJECT NO. 42 - SIGNAL LIGHTS Upon a motion by Councilman Myers, a second by Councilman Hamilton, all voting "ayes", $801.93 was appropriated by the following captioned ordinance: AN ORDINANCE SETTING FORTH THE COST OF INSTALLING TRAFFIC SIGNALS ON VALLEY VIEW LANE AT BEE STREET AND AT DENTON DRIVE AND APPRO- PRIATING FUNDS THEREFOR OUT OF THE STREET IMPROVEMENT BOND FUND UNAPPROPRIATED RESERVE. 31 M DATE SET FOR PUBLIC HEARING ON NEW APARTMENT REGULATIONS A Special Council Meeting on March 8, 1965 was the date set for this public hearing.
