1965-03-15 CC Minutes1 MINUTES OF A REGULAR MEETING CITY COUNCIL FARMERS BRANCH, TEXAS March 15, 1965 The following members of the Mayor Mayor Pro-Tem Councilmen City Manager City Attorney City Secretary City Council were present: A. J. Airoldi Bill Hamilton Frank Tippitt Ed Rhodes Dick Myers J. M. Orman H. Louis Nichols Dorthanna Williams Councilman Upfield was absent. Mayor Airoldi called the meeting to order. Mr. F. W. Rogers, Church of the Nazarene, gave the invocation. APPROVAL OF MINUTES The minutes of a regular meeting of March 1 were considered and approved. PUBLIC HEARING - GERALD POINTER - JOSEY LANE Mr. Gerald Pointer requested a change in zoning to Commercial on three tracts of land on Josey Lane. Plan Commission recommended approval of change from Special Permit Apartments to Commercial on Tract A, from "R-5" to Commercial on Tract B and tabled the decision on Tract C. The City Manager indicated the location of the tracts on the map. Mr. Pointer said that this request concerns approximately 6 acres of land adjoining Commercial property already owned by him and completely surrounded by his property. After discussion Councilman Tippitt moved that the hearing be closed, seconded by Councilman Myers, all voting "ayes". 1 Councilman Rhodes moved that the request for change be granted and a special permit ordinance be prepared specifying at least a 6-foot high wood screening fence and that the site plan be approved by the Plan Commission, seconded by Councilman Myers, all voting "ayes". Page 39 COMPREHENSIVE ZONING ORDINANCE - LIVESTOCK The City Manager presented excerpts pertaining to livestock from several of the area cities. A delegation from Sunbeck Circle and Mr. Gene Thompson, Bee Street, were present to discuss the keeping of horses within the city limits of Farmers Branch. After much discussion and study it was agreed by the Council to leave the ordinance as amended in September 1957 and still in effect. ORDINANCE NO. 542 - ZONE CHANGE - WARREN CLARK Upon a motion by Councilman Hamilton, a second by Councilman Tippitt, all voting "ayes", the following captioned ordinance was passed: AN ORDINANCE AMENDING THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF FARMERS BRANCH, AS HERETOFORE AMENDED, SO AS TO CHANGE THE FOLLOWING DESCRIBED PROPERTY FROM "R-3" SINGLE FAMILY TO "R-2" SINGLE FAMILY CLASSIFICATION, SAID TRACT BEING DESCRIBED AS FOLLOWS: BEGINNING (Legal description), ALL OF BROOKHAVEN HILLS ADDITION TO THE CITY OF FARMERS BRANCH, TEXAS, TO THE CENTER LINE OF MARSH LANE AND THE POINT OF BEGINNING; RESTRIC- TING SUCH PROPERTY TO THE USES PROVIDED FOR UNDER THE COMPREHEN- SIVE ZONING ORDINANCE; PROVIDING FOR A PENALTY NOT TO EXCEED TWO HUNDRED ($200.00) DOLLARS FOR EACH OFFENSE; AND DECLARING AN EMERGENCY. LOCATIONS FOR WATER STORAGE TANKS AND RESERVOIRS The City Manager was instructed by the City Council to begin negotiations to secure locations for two ground storage water reservoirs and two tower water tanks. MCDOWELL vs CITY OF FARMERS BRANCH Mr. Nichols advised the Council that although the Court awarded $3,000 to the McDowell's they have repealed the case. The Coun- cil authorized the City Attorney to go as high as $4,000 if he could reach a settlement out of court. RESOLUTION - EAST HILL PARK Upon a motion by Councilman Rhodes, a second by Councilman Myers, all voting "ayes", a resolution was passed authorizing the City Manager to sign an agreement whereas, Yacht Harbor Corporation has requested that the City of Farmers Branch approve and consent to certain agreements between Yacht Harbor Corporation and Gulf Oil Corporation of certain improvements at East Hill Park at Garza-Little Elm Lake, and for other purposes, which agreement further provides for the substitution of Gulf Oil Corporation as Concessionaire under the Concession Agreement in the event Yacht Page 40 Harbor Corporation should default in its agreement with Gulf Oil Corporation, and whereas, the City of Farmers Branch has determined that the agreements between Yacht Harbor Corporation and Gulf Oil Corporation will be beneficial to the interests of the City of Farmers Branch in that additional improvements will be erected on the premises described in the city's concession agreement.
