1965-06-07 CC MinutesMINUTES OF A REGULAR MEETING CITY COUNCIL FARMERS BRANCH, TEXAS June 7, 1965 The following members of the city Council were present: Mayor A. J. Airoldi Councilmen Frank Tippitt Ed Rhodes Dick Myers City Manager J. M. Orman City Attorney H. Louis Nichols City Secretary Dorthanna Williams Mayor Pro-Tem Hamilton and Councilman Upfield were absent. Mayor Airoldi called the meeting to order. Mr. J. W. Wade gave the invocation. FIRST REGULAR MEETING IN JULY The City Manager explained that the first meeting in July will be on July 5 which is a holiday. The Council set the meeting for the 12 rather than the 5. VARIANCE REQUEST BY GARNIA LEWIS Mr. Lewis requested a building permit without a subdivision plat as required by ordinance in "L-M" area west of IH 35E. Mr. Bob Langdon presented the request in Mr. Lewis' behalf. After much discussion the Council advised Mr. Lewis that his best recourse would be to go before the Board of Adjustment. PUBLIC HEARING - GERALD POINTER A public hearing was called to consider a zone change request that a 200 foot by 420 foot tract of land located 300 feet east of Josey Lane and 184 feet north of Heritage Circle be changed from apartment use under a special permit to "C" Commercial zone. The City Plan Commission had recommended that this request be granted subject to certain conditions. Mr. Pointer presented a plat and explained his request. There was no opposition to the request. Page 59 Regular Meeting Continued, June 9, 5:30 p.m. PUBLIC HEARING CONTINUED - GERALD POINTER After discussion Councilman Tippitt moved that the hearing be closed, seconded by Council Myers, all voting "ayes". ORDINANCE NO. 554 - AMEND ZONING ORDINANCE - GERALD POINTER Upon a motion by Councilman Rhodes, a second by Councilman Upfield, all voting "ayes", the following captioned ordinance was passed: AN ORDINANCE AMENDING THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF FARMERS BRANCH, AS HERETOFORE AMENDED, SO AS TO CHANGE THE FOLLOWING DESCRIBED PROPERTY FROM SPECIAL PERMIT APARTMENTS TO "C" COMMERCIAL UNDER A SPECIAL PERMIT, SAID TRACT BEING DES- CRIBED AS FOLLOWS: BEING A TRACT OF LAND SITUATED IN THE JOHN NIX SURVEY, ABSTRACT NO. 1088, CITY OF FARMERS BRANCH, DALLAS COUNTY, TEXAS, AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: (Legal description), SUBJECT, HOWEVER, TO THE SPECIAL CONDITIONS HEREINAFTER MORE FULLY EXPRESSED, THAT THE PROPERTY SHALL BE IM- PROVED ACCORDING TO PLANS AND SPECIFICATIONS SUBMITTED THEREFOR, WHICH SHALL BE APPROVED BY THE CITY PLAN COMMISSION AND THE CITY COUNCIL AND SUBJECT TO THE CONDITIONS CONTAINED HEREIN; PROVIDING FOR A PENALTY NOT TO EXCEED TWO HUNDRED DOLLARS ($200..00) FOR EACH OFFENSE AND DECLARING AN EMERGENCY. ORDINANCE NO. 555 - AMEND ZONING ORDINANCE - GERALD POINTER Upon a motion by Councilman Tippitt, a second by Councilman Upfield, all voting "ayes", the following captioned ordinance was passed: AN ORDINANCE AMENDING THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF FARMERS BRANCH, AS HERETOFORE AMENDED, SO AS TO CHANGE THE FOLLOWING DESCRIBED PROPERTY FROM "R-5" SINGLE FAMILY RESI- DENTIAL CLASSIFICATION TO "C" COMMERCIAL CLASSIFICATION UNDER A SPECIAL PERMIT, SAID TRACT BEING DESCRIBED AS FOLLOWS: BEGINNING AT THE SOUTHWEST CORNER OF HERITAGE PARK ADDITIONA NO. 1 TO THE CITY OF FARMERS BRANCH, TEXAS; (Legal description), SUBJECT HOW- EVER, TO THE SPECIAL CONDITIONS HEREINAFTER MORE FULLY EXPRESSED, THAT DEVELOPMENT SHALL BE GENERALLY IN CONFORMANCE WITH A SITE PLAN TO BE APPROVED BY THE CITY PLANNING AND ZONING COMMISSION AND THE CITY COUNCIL AND THAT ADEQUATE SCREENING SHALL BE PROVIDED TO SEPARATE THE PROPERTY COVERED BY THIS SPECIAL PERMIT FROM THAT LYING ADJACENT TO IT AND WHICH IS ZONED RESIDENTIAL, AND SAID SCREENING SHALL CONSIST OF A WOODEN SCREENING FENCE NOT LESS THAN SIX (6) FEET IN HEIGHT; PROVIDING FOR A PENALTY NOT TO EXCEED TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE; AND DECLARING AN EMERGENCY. Page 60 RESOLUTION - STREET PROJECT NO. S-48 - TRAFFIC SIGNAL Upon a motion by Councilman Tippitt, a second by Councilman Myers, all voting "ayes", a resolution was passed whereas, sealed bids were received and opened for the furnishing of certain materials for traffic signal installation at Valwood Parkway and Josey Lane; Signal Sales and Maintenance Corporation of Dallas submitted the lowest and best base bid in the amount of $2,678.78; that Signal Sales and Maintenance Corporation be awarded the bid; and, that this project be known as Street Project No. S-48. Other bids were: Kar-Trol Signal Company, Inc. $3,136.70 Signal Engineering Company j,250.00 RESOLUTION - PAINTING OF CITY HALL Upon a motion by Councilman Rhodes, a second by Councilman Myers, all voting "ayes", a resolution was passed whereas, bids were received on June 3, A. R. Jordan submitted the lowest and best bid for using the same colors as now exist in the City Hall for a one-coat job; that A. R. Jordan be awarded the contract for painting the City Hall; and, that funds presently available in Account No. 51 B-1 be used for payment of this contract. The three bids were: Jordan $1,185.00 Glidewell-- 11190.00 Allen 1,695.00 PARTITIONS FOR CENTRAL OFFICE Four bids were received for this installation: Royalmetal $2,402.25; Partitionaire $2,745.24; General $2,861.19; Partition-ette $3,060.12. Councilman Rhodes moved that Royal- metal be awarded the bid; the motion died for lack of a second. ORDINANCE NO. 556 - RESCIND ORDINANCE NO. 553 Upon a motion by Councilman Tippitt, a second by Councilman Rhodes, all voting "ayes", the following captioned ordinance was passed: AN ORDINANCE RELEASING $1,200.00 FROM ACCOUNT NO. 01 C-6 AND RETURNING IT TO THE GENERAL FUND RESERVE THEREBY NULLIFYING THE APPROPRIATION THAT WAS MADE IN ORDINANCE NO. 553. AUTHORIZE PREPARATION JOB DESCRIPTIONS Upon a motion by Councilman Tippitt, a second by Councilman Myers, all voting "ayes", the Council authorized the preparation of job descriptions for a Building Inspector and an Assistant City Engineer. Page 61 ORDINANCE NO. 557 - TRANSFER FUNDS GFR TO 18 A-2 Upon a motion by Councilman Tippitt, a second by Councilman Myers, all voting "ayes", the following captioned ordinance was passed appropriating $535.00: AN ORDINANCE APPROPRIATING FUNDS OUT OF THE GENERAL FUND RESERVE FOR THE EMPLOYMENT OF A PART-TIME CLERK IN THE LIBRARY DURING THE MONTHS OF JUNE, JULY AND THE FIRST HALF OF AUGUST.
