1965-08-02 CC MinutesMINUTES OF A REGULAR MEETING CITY COUNCIL FARMERS BRANCH, TEXAS August 2, 1965 The following members Mayor Mayor Pro-Tem Councilmen Council were present: A. J. Airoldi Bill Hamilton Frank Tippitt Ed Rhodes Dick Myers J. M. Orman H. Louis Nichols Dorthanna Williams of the City City Manager City Attorney City Secretary Councilman Upfield 1 1 was absent. Mayor Airoldi called the meeting to order. Mr. Gibbs Morton, St. Paul Lutheran Church, gave the invocation. APPROVAL OF MINUTES The minutes of a regular meeting, July 12, were considered and approved. PUBLIC HEARING - AMENDMENT TO ZONING ORDINANCE - COMMERCIAL This public hearing was called to consider amending the Comprehensive Zoning Ordinance to delete "mortuary" from the permissive uses in the "C" Commercial District Regulations. The Plan Commission recommended that "mortuary" be deleted from the "C" Commercial District and placed in Article XIV Special Permits, to be allowed under special permit in the "C", "L-M" and "H-M" Districts, and that offstreet parking be required at a minimum ratio of one park- ing space for each five seats. There were none present to speak for or against the change. Coun- cilman Myers moved that the hearing be closed, seconded by Council- man Hamilton, all voting "ayes". Councilman Hamilton moved, have an ordinance prepared deleting "mortuary" from Commercial District Zoning and add "funeral chapel, funeral home, undertaking establishment, morgue, crematory and crematorium" to Article XIV Special Permits, to be allowed under special permit in the "C", "L-M" and "H-M" Districts and that off- street parking be required at a minimum ratio of one parking space for each five seats; seconded by Councilman Myers, all voting "ayes". Page 69 CONSIDER UPGRADING RESIDENTIAL ZONING Councilman Tippitt moved, request the Plan Commission to hold a public hearing to consider upgrading residential building require- ments and create a new zoning classification (such as R-1.5 or R-.5), seconded by Councilman Rhodes, all voting "ayes". ORDINANCE NO. 564 - AMEND ZONING ORDINANCE - BILL SKIPPING -_JOSEY LANE AND VALLEY VIEW LANE Upon a motion by Councilman Hamilton, a second by Councilman Myers, all voting "ayes", (exception - Councilman Tippitt abstaining for reason of being out of state at time of public hearing), the follow- ing captioned ordinance was passed: AN ORDINANCE AMENDING THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF FARMERS BRANCH, AS HERETOFORE AMENDED, SO AS TO CHANGE THE FOLLOWING DESCRIBED PROPERTY FROM "R-3" SINGLE FAMILY DWELL- ING DISTRICT TO "C" COMMERCIAL DISTRICT CLASSIFICATION UNDER A SPECIAL PERMIT, SAID TRACT BEING DESCRIBED AS FOLLOWS: BEING A TRACT OF LAND SITUATED IN THE ROBERT J. WEST SURVEY, ABSTRACT NO. 1576, CITY OF FARMERS BRANCH, DALLAS COUNTY, TEXAS, AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: (legal description); SUBJECT, HOWEVER, TO THE SPECIAL CONDITIONS HEREINAFTER MORE FULLY EXPRESSED; PROVIDING FOR A PENALTY NOT TO EXCEED TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE; AND DECLARING AN EMERGENCY. ORDINANCE NO. 565 - REGULATING PRIVATELY OWNED SCHOOL BUSES Upon a motion by Councilman Tippitt, a second by Councilman Hamilton, all voting "ayes", the following captioned ordinance was passed: AN ORDINANCE OF THE CITY OF FARMERS BRANCH, TEXAS, REGULATING THE OPERATION OF PRIVATELY OWNED SCHOOL BUSES WITHIN THE CITY; PROVID- ING FOR FRANCHISES; PROVIDING FOR A PENALTY NOT TO EXCEED TWO HUNDRED ($200.00) DOLLARS FOR EACH OFFENSE AND DECLARING AN EMERGENCY. ORDINANCE NO. 566 - OLD CARS AND OLD AIRPLANES Upon a motion by Councilman Rhodes, a second by Councilman Myers, (Councilmen Rhodes, Myers, Hamilton voting "ayes", Councilman Tippitt abstaining), the following captioned ordinance was passed: AN ORDINANCE OF THE CITY OF FARMERS BRANCH, TEXAS, MAKING IT UN- LAWFUL AND A NUISANCE TO LEAVE, PARK OR STAND FOR A PERIOD LONGER THAN SEVEN DAYS IN ANY FRONT, SIDE OR REAR YARD OF ANY LOT OR TRACT OF LAND IN THE CITY, ANY MOTOR VEHICLE OR AIRPLANE WHICH IS IN A CONDITION SUCH AS TO MAKE IT INCAPABLE OF BEING DRIVEN OR OPERATED; PROVIDING FOR A PENALTY NOT TO EXCEED TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE; AND DECLARING AN EMERGENCY. Page 70 ACCEPT R-O-W DEED - WEBB CHAPEL ROAD - METROPOLITAN HOSPITAL Upon a motion by Councilman Hamilton, a second by Councilman Rhodes, all voting "ayes", a dedication deed for a ten (10) foot wide strip of land for the widening of Webb Chapel Road was accepted from the Metropolitan Medical Center for the purpose of having the City of Farmers Branch use the same for public street right-of-way only. ORDINANCE NO. 567 - NEW APARTMENT REGULATIONS Upon a motion by Councilman Hamilton, a second by Councilman Tippitt, all voting "ayes", the following captioned ordinance was passed regulating any apartment zoning that has not been platted: AN ORDINANCE AMENDING THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF FARMERS BRANCH, AS HERETOFORE AMENDED, SO AS TO ADOPT A NEW ARTICLE IX, "A" APARTMENT DISTRICT REGULATIONS, REPEALING THE EXISTING APARTMENT DISTRICT REGULATIONS; REQUIRING ALL FUTURE DEVELOPMENT WITHIN AN APARTMENT DISTRICT ZONE TO CONFORM TO THE REQUIREMENTS OF THE NEW ORDINANCE; PROVIDING A PENALTY FINE NOT TO EXCEED A SUM OF TWO HUNDRED ($200.00) DOLLARS FOR EACH OFFENSE; AND DECLARING AN EMERGENCY. RESOLUTION - RE: AMEND MOTOR CARRIER ACT OF TEXAS Upon a motion by Councilman Tippitt, a second by Councilman Myers, all voting "ayes", a resolution was passed whereas, the Legisla- ture of the State of Texas amended the Motor Carrier Act of Texas; the Railroad Commission of Texas is authorized to create and define commercial zones within the State of Texas to permit the free flow of commerce and trade; and, it is deemed vital and essential to the economic future of this city that the free flow of trade and com- merce be encouraged and permitted by establishing one commercial zone among all of the municipalities in Dallas and Tarrant Counties. REJECT STORM SEWER BID - JOSEY LANE AT FARMERS BRANCH CREEK Upon a motion by Councilman Myers, a second by Councilman Tippitt, all voting "ayes", a storm sewer bid on Josey Lane at Farmers Branch Creek was rejected and the project was added to Street Project No. 45. STREET PROJECT NO. 45 - STORM SEWER IMPROVEMENTS Upon a motion by Councilman Rhodes, a second by Councilman Hamilton, all voting "ayes", the City Manager was authorized to proceed with obtaining bids on storm sewer project on Templeton Trail, Rockmartin Drive and Josey Lane. Page 71 RESOLUTION - STREET PROJECT NO. 48 - TRAFFIC SIGNALS Upon a motion by Councilman Tippitt, a second by Councilman Hamilton, all voting "ayes", a resolution was passed whereas, bids were received July 19 for the installation of traffic sig- nals at Valwood Parkway and Josey Lane; Sharrack Brothers, Inc. of Dallas, Texas submitted the only bid of this work; however, this bid is in line with estimated costs; Sharrack Brothers, Inc. submitted an alternate bid in the amount of $1,490 for above ground work; that Sharrack Brothers, Inc. be awarded the contract for installing only the above ground work; and that payment be made from funds appropriated to Street Project No. 48. ORDINANCE NO. 568 - LIBRARY PROJECT NO. 1 - REFUND TO STREET FUND Upon a motion by Councilman Hamilton, a second by Councilman Rhodes, all voting "ayes", an ordinance was passed refunding a total of $15,000 to the Street Improvement Bond Fund Unappropriated Reserves. By Ordinance No. 471 dated April 20, 1964 and Ordinance No. 515 dated October 19, 1964 this amount was appropriated as a loan to Library Project No. 1 out of the Street Improvement Bond Fund Unappropriated Reserves to be repaid at such time as Library Bonds were sold and funds were available with which to repay these loans. WATER LINE - BROOKHAVEN ESTATES BETWEEN BROOKHAVEN CLUB DRIVE AND GREEN ACRES TERRACE After much discussion on low water pressure in this area Councilman Myers moved authorization of an $1,800 appropriation for a 6-inch water line to increase water pressure for the area if Joe J. Rady Consulting Engineers could not work out a booster plan; seconded by Councilman Rhodes, all voting "ayes". DATE SET FOR ELECTION - CIVIL SERVICE ACT Upon a motion by Councilman Hamilton, a second by Councilman Myers, all voting "ayes", an election was set for August 27, 1965 for the purpose of submitting the following proposal to the qualified voters of the city: FOR/AGAINST - the adoption of the Firemen's and Policemen's Civil Service Act. The election to be held in the City Hall between the hours of 7:00 a.m. and 7:00 p.m. The follow- ing members of the Fire Department were present: James Potts, Billy Bollier, Melvin Johnson and Luther Moore.
