1965-09-20 CC MinutesMINUTES OF A REGULAR MEETING CITY COUNCIL FARMERS BRANCH, TEXAS September 20, 1965 The following members of the City Council were present: Mayor A. J. Airoldi Mayor Pro-Tem Bill Hamilton Councilmen Ed Rhodes Dick Myers City Manager J. M. Orman City Attorney H. Louis Nichols City Secretary Dorthanna Williams Councilmen Tippitt and Upfield were absent. Mayor Airoldi called the meeting to order. Mr. Bob Langley, Chapel Hill Methodist Church, gave the invocation. APPROVAL OF MINUTES The minutes of a special meeting, September 13, were considered and approved. PUBLIC HEARING - 1965-1966 BUDGET Mayor Airoldi opened the public hearing to the public. There were no comments from the audience. After a short discussion Councilman Hamilton moved that the public hearing be closed, seconded by Councilman Rhodes, all voting "ayes". ORDINANCE NO. 574 - ADOPT 1965-1966 BUDGET Upon a motion by Councilman Hamilton, a second by Councilman Myers, all voting "ayes", the following captioned ordinance was passed: AN ORDINANCE OF THE CITY OF FARMERS BRANCH PROVIDING FUNDS FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 1965 AND ENDING SEPTEMBER 30, 1966 BY APPROVING THE BUDGET FOR SAID PERIOD AND APPROPRIATING AND SET- TING ASIDE THE NECESSARY FUNDS OUT OF THE GENERAL AND OTHER REVENUES OF THE CITY OF FARMERS BRANCH FOR SAID FISCAL YEAR FOR THE MAINTE- NANCE AND OPERATION OF VARIOUS DEPARTMENTS AND FOR VARIOUS ACTIVITIES AND IMPROVEMENTS OF THE CITY; AND DECLARING AN EMERGENCY. RESOLUTION - APPROVE ASSESSMENT ROLLS Upon a motion by Councilman Rhodes, a second by Councilman Hamilton, all voting "ayes", the following resolution was passed: Page 81 WHEREAS, the Assessment Rolls for the year 1965, assessing all taxable property located in the City of Farmers Branch, have been prepared in due course; and WHEREAS, the Board of Equalization of the City of Farmers Branch has carefully examined and given hearings to the owners of property desiring to be heard on protests of valuations and has reviewed and fully and finally revised said assessment rolls; and WHEREAS, said Assessment Rolls for the year 1965 are in proper form, and are proper and correct as finally revised and equalized by the said Board of Equalization; now, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FARMERS BRANCH, TEXAS: SECTION 1. That the Assessment Rolls covering taxable property in the City of Farmers Branch, assessed for City purposes for the year 1965, be and the same are hereby in all things approved, con- firmed and adopted as the official Assessment Rolls, assessed for the benefit of the City of Farmers Branch for the year 1965. SECTION 2. That this resolution shall take effect from and after its passage as provided. RESOLUTION - SET TAX RATE Upon a motion by Councilman Hamilton, a second by Councilman Rhodes, all voting "ayes", the following resolution was passed: WHEREAS, assessments and renditions of all taxable property in the City of Farmers Branch have been made for the year 1965 by the Assessor and Collector of Taxes: NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FARMERS BRANCH, TEXAS: SECTION 1. That assessments and renditions for the year 1965 on all taxable property are hereby approved. SECTION 2. That the tax rate to be levied for the year 1965 on all taxable property, real, personal, or mixed, located within the City of Farmers Branch, be, and is hereby fixed at $1.05 per $100. SECTION 3. That this resolution shall take effect from and after its passage as provided. Page 82 RESOLUTION - AWARD CONTRACT FOR PROJECTS S-23 AND W-28 Upon a motion by Councilman Myers, a second by Councilman Rhodes, all voting "ayes", a resolution was passed whereas, sealed bids were received and opened on December 18, 1964 for constructing water and sewer mains on the east service road of I.H. 35E; and, whereas, Feazell Construction Company, Arlington, Texas, submitted the lowest and best bid in the amount of $13,064.70; that Feazell Construction Company be awarded the contract for these projects; that the City Manager is hereby authorized to execute the contract pertaining to these projects; and, that the water main project be known as Water Project No. W-28 and that the sewer main project be known as Sanitary Sewer Project No. S-23. _AGREEMENT - ARCHITECT J. S. EPPS. JR. - CITY SERVICE CENTER Upon a motion by Councilman Rhodes, a second by Councilman Hamilton, all voting "ayes", City Manager Orman was authorized to sign the standard form of agreement for architectural services between the city and the architect for the new city service center. WATER LINE CONSTRUCTION - BROOKHAVEN ESTATES Upon a motion by Councilman Myers, a second by Councilman Hamilton, all voting "ayes", plans were authorized for construction of addi- tional water supply mains to serve the northern part of Brookhaven Estates. SITE PLAN APPROVAL - JOSEY LANE AND ROLLINGDALE LANE Henry S. Miller Company, represented by Mr. Weitzman, presented a site plan for approval by the Council on the corner of Josey Lane and Rollingdale Lane. After a discussion on set-back on Rollingdale Lane the Council returned the site plan to the Plan Commission for further consideration. VALLEY VIEW LANE ENTRANCE AT I. H. 35E Councilman Hamilton moved that no city money be spent on this project without Council approval, seconded by Councilman Myers, all voting "ayes". ORDINANCE NO. 575 - TRANSFER FUNDS - YEAR-END ADJUSTMENTS Upon a motion by Councilman Rhodes, a second by Councilman Myers, all voting "ayes", the following captioned ordinance was passed: AN ORDINANCE TRANSFERRING FUNDS AS INDICATED FOR THE PURPOSE OF MAKING YEAR-END ADJUSTMENTS IN THE BUDGET. Page 83 ORDINANCE NO. 576 - CONSTRUCTION INSPECTOR Upon a motion by Councilman Myers, a second by Councilman Rhodes, all voting "ayes", the following captioned ordinance was passed: AN ORDINANCE APPROPRIATING FUNDS FROM THE STREET IMPROVEMENT, SANITARY SEWER AND WATER BOND FUND UNAPPROPRIATED RESERVES TO THE GENERAL FUND REVENUES FOR SERVICES PERFORMED BY THE CONSTRUC- TION INSPECTOR AND FOR ENGINEERING SERVICES. ORDINANCE NO. 577 - STREET PROJECT NO. 50 - DRAINAGE ON JOSEY LANE AT I. H. 635 Upon a motion by Councilman Myers, a second by Councilman Hamilton, all voting "ayes", the following captioned ordinance was passed: AN ORDINANCE SETTING FORTH THE ESTIMATED COST OF 120 FEET OF 48-INCH CONCRETE CULVERT PIPE AND APPROPRIATING FUNDS THEREFOR OUT OF THE STREET IMPROVEMENT BOND FUND UNAPPROPRIATED RESERVES. SANITARY SEWER CONNECTION FOR CITY OF ADDISON The City of Addison requested a sanitary sewer service connection at Marsh Lane and Spring Valley Road without a metering station per the agreement between Farmers Branch and Addison. This tap to be paid per amount of water use. After discussion Councilman Rhodes moved approval for a period of one year or until additional taps are made, seconded by Councilman Myers; Councilmen Rhodes and Myers voting "ayes", Councilman Hamil- ton voting "nay". Upon a motion by Councilman Hamilton, a second by Councilman Rhodes, all voting "ayes", the request for the City of Farmers Branch to participate in the cost of laying the sewer line was denied. PAVING OF VINTAGE STREET (BETWEEN BEE AND GOODLAND STREETS) Upon a motion by Councilman Myers, a second by Councilman Rhodes, all voting "ayes", the City Manager was authorized to trade pave- ment for 30 feet of right-of-way on improving this street.
