1963-02-07 CC MinutesMINUTES OF A SPECIAL MEETING CITY COUNCIL FARMERS BRANCH, TEXAS February 7, 1963 The City Council met in a special session in the Council Room on February 7, 1963 at 9:30 p.m. with all members present: Mayor A. J. Airoldi Mayor Pro-Tem Bill Hamilton Councilmen Frank Tippitt Ed Rhodes W. D. Oradat Dan Regan City Manager J. M. Orman JAS ~t~71(~- POINTER APARTMENTS ON DBIt ' Mr. Gerald Pointer presented a revised site plan and building eleva- tions of his proposed apartments which will be located along Dennis Road north of Cooks Branch. Inasmuch as these apartments and their accompanying drives and parking areas will be built immediately north of Cooks Branch, Councilman Regan brought up the possibility of flood waters in the creek scouring and undermining parts of these drives, etc. He did not want the City to be held responsible for any damage caused by this scouring. Mr. Pointer said he agreed to hold the City harmless for this type of damage but would expect the City to perform normal maintenance on the drainage channel. Councilman Oradat did not believe rip-rap was necessary as had been recommended by Rady and Associates. Mr. Pointer agreed to hold the City harmless and that he will provide suitable splash aprons where his storm sewer enters the channel. Councilman Hamilton moved, seconded by Councilman Tippitt, with all voting "ayes" to accept site plan (marked Exhibit "A") for apartments, accept general appearance of front and side elevations as those to be used throughout the development (marked Exhibit "B"); on Dennis Road side and on sides next to parks between buildings use plan marked Exhibit "C" and on sides next to parking lot, use high windows; on Exhibit "A" to develop the southwest corner first and then go north- ward along Dennis Road in the order 1, 2a, 2b, 3a, 3b and 4 (Exhibit "A") when further development is made; and that Mr. Pointer will execute a "hold harmless" instrument on channel scouring unless he chooses to follow requirements as set out by the City. Since this new plan was considered a minor revision of the original site plan, these stipula- tions replace any conflicts with original, otherwise non-conflicts as listed in original special permit will still apply, such as screening, size of apartments, etc. Page 54 VALWOOD BOWLING LANES PARTIAL PAYMENT REQUEST Officials of Valwood Lanes had requested that they be permitted to pay their 1962 taxes in four payments beginning immediately with one-fourth followed on the first of each succeeding month with an additional one- fourth plus accrued interest, the final payment to be made on May 1. The paymentsto be as follows: Immediately $802.01 plus $80.21 (P. & I.); on March 1 $802.04 plus $40.11 (P. & I.); on April 1 $802.05 plus $60.17 (P. & I.) and on May 1 $802.05 plus $80.21 (P. & I.); the total amount of taxes amounting to $3,208.15. Councilman Oradat moved, seconded by Councilman Rhodes, with all voting "ayes" to approve this partial payment plan provided payments are received promptly on the first of each month until paid.
