1963-02-18 CC MinutesMINUTES OF A REGULAR MEETING CITY COUNCIL FARMERS BRANCH, TEXAS February 18, 1963 The City Council met in a regular session on February 18, 1963 in the Council Room at 7:30 p.m. with all members present: Mayor A. J. Airoldi Mayor Pro-Tem Bill Hamilton Councilmen Frank Tippitt Ed Rhodes W. D. Oradat Dan Regan City Manager J. M. Orman Assistant City Manager John C. Dodson City Secretary Dorthanna Williams Mayor Airoldi called the meeting to order. Mr. Gibbs Morton, St. Paul Lutheran Church, gave the invocation. Councilman Tippitt moved that the City Council of Farmers Branch recognize National Engineers Week, 17 - 23 February, 1963 and that the Council extends its congratulations to all the engineers of this City of this occasion; seconded by Councilman Regan, all voting "ayes". Councilman Hamilton said he would like to express his appreciation for all things done by engineers to make our lives more comfortable and enjoyable. 1 APPROVAL OF MINUTES An amendment to the minutes of January 21 and the minutes of a regular meeting of February 4 were considered and approved. ORDINANCE NO. 381 - FROM "R-4" AND "R-51° TO "R-4" AND "R-3" - AREA NORTH OF VALLEY VIEW LANE, WEST OF WEBB CHAPEL ROAD Mayor Airoldi explained that public hearings were held on February 4 on this ordinance and on the following two ordinances. These zone changes were approved at that meeting, the ordinances have now been prepared by the City Attorney as directed by the City Council and are ready for passage. Upon a motion by Councilman Hamilton, seconded by Councilman Oradat, all voting "ayes" an ordinance was passed amending the Comprehensive Zoning Ordinance. Caption of the ordinance: pa 56 AN ORDINANCE AMENDING THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF FARMERS BRANCH, AS HERETOFORE AMENDED, SO AS TO CHANGE THE FOLLOWING DESCRIBED PROPERTY FROM AN "R-4" AND "R-5" RESIDENTIAL CLASSIFICATION TO AN "R-3" RESIDENTIAL CLASSIFICATION, SAID TRACT BEING DESCRIBED AS FOLLOWS: (Description); AMENDING SAID COMPREHENSIVE ZONING ORDINANCE SO AS TO CHANGE THE FOLLOWING DESCRIBED PROPERTY FROM AN "R-5" RESI- DENTIAL CLASSIFICATION TO AN "R-4" RESIDENTIAL CLASSIFICATION, SAID TRACT BEING DESCRIBED AS FOLLOWS: (Description); PROVIDING FOR A PENALTY NOT TO EXCEED TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE; AND DECLARING AN EMERGENCY. ORDINANCE NO. 382 - FROM "R-l" TEMPORARY TO "L-M" UNDER SPECIAL PERMIT - AREA NEAR VALLEY VIEW LANE AND INWOOD ROAD Upon a motion by Councilman Rhodes, seconded by Councilman Regan, all voting "ayes" an ordinance was passed amending the Comprehensive Zoning Ordinance. REPORT FROM METROPOLITAN MEDICAL CENTER Dr. Frank Altick said, we have five members of our group present, two more will be here later. He explained that they have a very good pros- pect at this time, it is a local concern, they have a meeting set with them for Wednesday night and should have information at that time. He then asked for a 10-day extension for their report to the Council. S Mr. Louis Rubin, CPA, said, we have been pushing this thing hard, we are dealing with a local institution, they have asked for information that other institutions have not asked for and it has taken more time. He said that he believed they can have a full report in about ten days. Councilman Regan asked, if you are granted this extension can we expect some definite answer at that time? Mr. Rubin said, I believe we can have a definite answer at that time. Councilman Rhodes said that he was glad to hear such encouraging news. Mr. Narel Haynes said, I would like to see an extension of more than ten days, this will be very important to this community for the next 40 or 50 years. Councilman Oradat moved, delay discussion until the next regular Council meeting and at such time we will expect some information, seconded by Councilman Rhodes, all voting "ayes", Mayor Airoldi said, I am quite pleased with the momentum of your progress, we would at least like to see what has been done at that time. VALLEY VIEW LANE WIDENING Mr. Bob King and Mr. Ed Apel of Joe J. Rady Associates were present with plans showing the present right-of-way, present location of improvements and proposed right-of-way lines of Valley View Lane. Mr. King explained that they do not have the actual plans for the intersections. After discussion on right-of-way, median strip, width,etc., it was agreed that the Council would study the plans, go out with the City Engineer and do a "foot" survey to establish a right-of-way line. The Page 58 Council agreed to review the commitment made to Mr. Bob Langdon last summer. No formal action was taken by the Council. COOKS BRANCH CHANNEL WEST OF DENTON DRIVE In a discussion on the straightening of Cooks Branch channel in the west industrial area the Mayor said, one property owner has said he would give the right-of-way to get the channel. Mr. Bob Langdon discussed drainage, bridges, Dr. Thompson's property in Carrollton, right-of-way for streets and utilities. Councilman Regan said that he would take exception to the statement that the City has an obligation to provide drainage. Mr. Langdon said, generally a municipality is responsible for drainage. Councilman Regan said, we are responsible to see that the developer puts in proper drainage, the City sets the standards. Mr. Langdon said, the City should have control of all drainage area, Farmers Branch has three principal drainage channels. Councilman Tippitt said, we have just required a developer to put in a 50-year storm frequency lined channel. Councilman Regan said, we will be glad to work with the developer and will do what we believe is public responsibility, we should wait for the report from Powell and Powell. Mayor Airoldi said, we have made a commitment on the extension of Val- wood Parkway, the drainage may be on one man's property and need to be on another man's property. Mr. Webb Roberts agreed to have Cooks Branch straightened on his property (between Denton Drive and Highway 35E). He said, I do not need this situation but would be glad to do this for the good of the City. Mayor Airoldi suggested this discussion wait until they ge the drainage report. Mr. Langdon said he would like to discuss with the Council who should contact the City of Carrollton on a land swap of property belonging to Dr. Thompson. Dr. Thompson has said he will not do anything to bring this about but will not object. In a discussion on how it would be decided where the channel would be located City Attorney Baker said, we do not have the right to go on property without permission. Mayor Airoldi asked, would we have power of condemnation? Mr. Baker said, yes. Page 59 Councilman Tippitt said, I would like to have set on the agenda a full discussion of legal aspects of where we stand on drainage. Councilman Rhodes said he thought they should wait for the Master Plan. Council- man Tippitt said he would like some legal ideas before they start the study on the Master Plan. CORPORATION COURT JUDGE Mr. Carl Skibell, newly appointed City Judge, was present to meet the Council and discuss his duties as Judge. The Council agreed that the City Manager, City Attorney, Chief of Police and City Judge should have a meeting, go over ordinances the City now has and decide on other ordinances the City should have to conduct the Court with dignity and to see that all people get fair treatment. ORDINANCE NO. 384 - PROVIDING FOR PRO RATA CHARGES Upon a motion by Councilman Tippitt, seconded by Councilman Regan, all voting "ayes", a pro rata ordinance was passed. Caption of the ordinance: AN ORDINANCE OF THE CITY OF FARMERS OF WATER AND SEWER MAIN EXTENSIONS, PROVIDING FOR REFUNDS, PROVIDING AN WATER AND SEWER MAINS, METHOD OF EN: PROVIDING THE EFFECTIVE DATE OF THE BILITY CLAUSE. BRANCH REGULATING THE INSTALLATION PROVIDING FOR PRO RATA CHARGES, ALTERNATE METHOD FOR EXTENDING FORCING PAYMENT OF PRO RATA CHARGES, ORDINANCE AND PROVIDING A SEVERA- STUDENT GOVERNMENT DAY Mr. Orman announced that Student Government Day would be held in the City Hall on Friday, February 22. The schedule will be lunch at 12:00 noon, time for the Student and the Department Head or Council Member from 1:00 until 3:00 p.m. He urged each member of the Council to attend if at all possible and said that several of the teachers from the High School will attend. AREA PLANNING ACT FOR LOCAL GOVERNMENT - RESOLUTION Councilman Tippitt moved that the City Council go on record and pass a resolution as being opposed to Mayor Cabell's (Dallas) bill introduced to use 2% of the County tax money for a Councy wide Planning Committee. Councilman Hamilton seconded and said he believed in self-government and the proposed bill could and would endanger the individuality of the City of Farmers Branch, he believed in cooperating but he opposed the bill on grounds that certain of its present local self-government rights would be endangered if not entirely eliminated.
