1963-04-15 CC MinutesMINUTES OF A REGULAR MEETING CITY COUNCIL FARMERS BRANCH, TEXAS April 15, 1963 The City Council met in a regular meeting on April 15, 1963 in the Council Room at 7:30 p.m. with all members present: Mayor A. J. Airoldi Mayor Pro-Tem Bill Hamilton Councilmen Frank Tippitt Ed Rhodes W. D. Oradat Dan Regan City Manager J. M. Orman Assistant City Manager John C. Dodson City Secretary Dorthanna Williams Mayor Airoldi called the meeting to order. Mr. Bourdon Smith, Christ Methodist Church, gave the invocation. APPROVAL OF MINUTES The minutes of April 1, 1963 were considered and approved by motion by Councilman Oradat, second by Councilman Regan, all voting "ayes". PROPOSED BOND PROGRAM AND BOND SALE The City Manager presented the proposed expenditures for the next twelve months on the current bond program. Mr. Lewis Lyne, the City's fiscal agent, was present for the discussion. Mr. Orman recommended the sale of: $200,000 General Obligation Bonds ($68,000 for street improvements and $132,000 for fire station improve- ments); $400,000 Revenue Bonds ($200,000 each to water and to sanitary sewer improvements). He explained that, although the fiscal agent would allow going to 10% of the assessed valuation in General Obligation bonded indebtedness he could not recommend it at this time because, "(1) I prefer to limit it to 8% and (2) we will not have sufficient funds to finance a larger amount." Mr. Lyne suggested not selling the bonds until the City is ready to spend the money. He explained a bill in Austin at the present time, if passed the City can refund present bonds, reissue at a lower interest rate and save a considerable amount of money in interest rates. Councilman Oradat moved, authorize the City Manager to work with Mr. Lyne on sale of bonds, seconded by Councilman Rhodes, all voting "ayes". Page 82 BIDS ON SUBURBAN FIRE STATION City Manager Orman presented the bids on the Suburban Fire Station. John W. Taylor, General Contractor the contractor who built the City Hall was low bidder with a bid of $68,796. He recommended that John Taylor be awarded the contract. The second lowest bidder Marvin Connell Construction Company - $71,225 and third lowest bidder- King and Reeder - $73,000. In the discussion the Council asked that the City Manager get costs of three different types of windows (the large one on the front): the window in the final plans, a flush window and the window in the original plan. Councilman oradat also wanted the extra cost on more structural slab - from 6" to 8" and a clarification of the foundation preparation. The Mayor summarized ask two low bidders to submit sealed bids on these specifications and changes. SPEED OF EMERGENCY VEHICLES In a short discussion on the legal speed of emergency vehicles ambulance, fire trucks, police cars, etc. Fire Chief Yager, Police Chief Green, City Manager Orman and City Attorney Nichols were instructed to prepare an ordinance to regulate the speed of such vehicles for the consideration of the Council. BIDS ON FIRE PUMPER City Manager Orman reported the bids received on the Fire Truck for the new suburban fire station. The three lowest bids were: Fire Trucks, Inc. - $26,561; Peter Pirsch and Sons - $27,693; Central Fire Trucks - $27,771. Chief Yager was present to discuss the bids and make his recommendation. Chief Yager said, these are all net figures and my recommendation is go- ing to be the second lowest bidder, Peter Pirsch and Sons. He gave the following reasons for his recommendation: same equipment as last pur- chase, standardization of minor repairs, quality, workmanship, dependable delivery and company's financial status. Mr. Stuart Luce said that he was a friend of the company with lowest bid, Fire Trucks, Inc. He felt they should be awarded the bid on their low bid. Fire Trucks, Inc. has just delivered one truck to the City of Mesquite and four trucks to the City of Fort Worth. He and Mr. Ben Lampe of the company answered questions from the members of the Council and asked that they look at these trucks before making a decision. Councilman Regan said he would like a financial statement from them and locations of their equipment in the area. Mr. Lampe said this would be supplied. Page 83 Mayor Airoldi appointed a committee of Councilmen Rhodes and Hamilton to go with Chief Yager to see these trucks and come back to the Council with a recommendation. GARDEN CLUB COUNCIL Mrs. Addison Bradford said she had received a letter from Mrs. Russell Holman, a former citizen of Farmers Branch now living in France in a small city which is a suburb of Paris. This small city has a classic work of art which they plan to present to a small city in another country. Mrs. Holman has offered to do what she can to obtain this art (a statue) for the City of Farmers Branch if they are willing to accept it. Mrs. Dyer said, it is a beautiful gesture, if there are no disadvantages she would like the City to accept. It is an excellent idea, the government of one city making contact with the government of another city. Councilman Hamilton said that he is a personal friend of the Holman's, they have also written to him about this statue and knowing them he felt it would be acceptable to the citizens of Farmers Branch. Councilman Regan suggested that the Mayor write to Mrs. Holman and explore the idea. In discussion Mayor Airoldi agreed to send a cable that evening. Macon Manor Apartments - Special Permit Ordinance No. 343 City Manager Orman told the Council that Mr. Macon has requested that he be allowed to build the No. 3 Unit on the west side of his apart- ments before he builds the No. 2 Unit on the north. This request to change the order of his apartment units is to be able to build the swimming pool. Mayor Airoldi said that his loan company will not let him put in the swimming pool until this unit is built on the west. Councilman Tippitt said he feels it is worth compromising to get the playground and recreation area - then moved to change the order of Units 2 and 3; seconded by Councilman Rhodes, all voting "ayes". ORDINANCE NO. 394 - AMEND ORDINANCE NO. 170-PARKS & RECREATION Upon a motion by Councilman Regan, seconded by Councilman Oradat, all voting "ayes", an amendment to Ordinance No. 170 was passed changing the wording in Section 3 and Section 4. Caption of the ordinance: AN ORDINANCE AMENDING SECTION 3 AND SECTION 4 OF ORDINANCE NO. 170. DEED TO DISTRIBUTION WAY AND UTILITY EASEMENT City Manager Orman presented a deed to Distribution Way and a utility easement and said, this street has never been dedicated even though repeated efforts to have it done have failed up to this time. He asked the Council for formal acceptance. Page 84 Councilman Oradat moved acceptance, seconded by Councilman Hamilton, all voting "ayes". CONSIDER ELIMINATING $1.00 CHARGE ON DOG TAGS City Manager Orman said, only $400 was realized last year from the sale of dog tags, much more should have been received. The sole pur- pose of the present ordinance is to have every dog vaccinated. It is proposed to have tags available at our two vets and the City Hall for free issuance if a current vaccination certificate is presented. He believed it would be a good public relations gesture. After discussion Councilman Oradat moved, have free registration period, charge $1.00 after June lst. deadline; seconded by Councilman Rhodes, all voting "ayes". ORDINANCE NO. 395 - BOB HEISER-ZONE CHANGE FROM "R-3" TO "R-3.5" Upon a motion by Councilman Oradat, seconded by Councilman Rhodes, all voting "ayes", an ordinance was passed changing the zone classification on the property described in the caption below: AN ORDINANCE AMENDING THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF FARMERS BRANCH, AS HERETOFORE AMENDED, SO AS TO CHANGE THE FOLLOWING DESCRIBED PROPERTY FROM AN "R-3" RESIDENTIAL CLASSIFICATION TO AN "R-3.5" RESIDENTIAL CLASSIFICATION, SAID TRACT BEING SITUATED IN THE CITY OF FARMERS BRANCH, TEXAS, AND BEING DESCRIBED AS FOLLOWS: BEGINNING AT THE INTERSECTION OF VALLEY VIEW LANE AND DENNIS ROAD; THENCE WESTERLY ALONG VALLEY VIEW LANE TO ITS INTERSECTION WITH TOM FIELD ROAD; THENCE NORTHERLY ALONG TOM FIELD ROAD TO ITS INTERSECTION WITH THE SOUTH LINE OF VALWOOD PARK ADDITION NO. 28 TO THE CITY OF FARMERS BRANCH, TEXAS; THENCE EASTERLY FOLLOWING THE SOUTH LINES OF VALWOOD PARK ADDITIONS NOS. 28, 10, 17, 25 AND 26 TO THE CITY OF FARMERS BRANCH, TEXAS AND THE EASTERLY PROLONGATION OF THE SOUTH LINE OF SAID VALWOOD PARK ADDITION NO. 26 TO ITS INTERSECTION WITH DENNIS ROAD; THENCE SOUTHERLY ALONG DENNIS ROAD TO THE PLACE OF BEGINNING. RESOLUTION - FINAL PAYMENT-PROJECT NO. 5-13 Upon a motion by Councilman Regan, seconded by Councilman Hamilton, all voting "ayes", a resolution was passed that work has been completed on the sanitary sewer (Denton Drive) that serves Truett Laboratories and Superior Products; that a final payment in the amount of $3,426.46 be made to Cullum Construction Company from funds previously allocated to this project. WATER RATE STUDY A water rate study was presented by City Manager Orman for the considera- tion of the Council. After much discussion Councilman Oradat moved, put into effect,Rate Schedule No. 1, $1.85 monthly sewer charge and on Page 85 1 J D reconnect charges for water: Monday through Friday, 8 a.m. to 5 p.m. - $2.50; all other times - $7.50. Seconded by Councilman Hamilton, all voting "ayes". IMPROVEMENT OF FYKE ROAD The City Manager reported that the right-of-way has been acquired from Mr. Nix. A meeting was held Friday with Frank Crowley, Roy Rasberry, John Sarris and Mr. Orman to discuss paving, etc. The County is now in the process of making an estimate of the cost of improvements. Carroll- ton and Farmers Branch will share equally in the entire cost of the drainage structures and on the roadway the County will pay one-half and the two cities one-fourth each. DRAINAGE WEST OF HIGHWAY 35E Councilman Tippitt reported on progress of opening Rawhide and Farmers Branch Creeks to relieve flooding conditions in the west industrial area. Even though an appropriation has been made for this project Councilman Tippitt reported they may be able to get this done without cost to the City. CHANGE NAME OF DENNIS ROAD AND OF JOSEY LANE Councilman Oradat moved that Dennis Road be changed to Josey Lane all the way through the City and Josey Lane be changed to Twilight Trail; seconded by Councilman Regan, all voting "ayes". GARBAGE COLLECTION Several reports of complaints on garbage collection and garbage collec- tors were made by members of the Council. BUS STOP Councilman Regan asked the City Manager to see get a bus stop in Farmers Branch. He suggested Bus to make a loop into Farmers Branch to pick designated bus stop.
