1963-05-06 CC MinutesMINUTES OF A REGULAR MEETING CITY COUNCIL FARMERS BRANCH, TEXAS May 6, 1963 The City Council met in a regular meeting on May 6, 1963 in the Council Room at 7:30 p.m. with all members present: Mayor Mayor Pro-Tem Councilmen City Manager Assistant City Manager City Secretary City Attorney A. J. Airoldi Bill Hamilton Frank Tippitt Ed Rhodes W. D. Oradat Dan Regan J. M. Orman John C. Dodson Dorthanna Williams Robert Baker Mayor Airoldi called the meeting to order. Mr. Gibbs Morton, St. Paul Lutheran Church, gave the invocation. APPROVAL OF MINUTES The minutes of April 15 were considered and approved by motion of Councilman Tippitt, seconded by Councilman Hamilton, all voting "ayes". PUBLIC HEARING - DR. BEN LAWRENCE Dr. Lawrence requested that Lots 29, 30 and 31, Block 1, D. T. Macon Subdivision, be changed from "R-5" Residential to Commercial under Special Permit. These three lots located on Valley View Lane imme- diately east of the Fire Station. The City Planning and Zoning Com- mission recommended approval of this request. In discussion Dr. Lawrence agreed that upon approval of the site plan he will negotiate for right-of-way for widening Valley View Lane. He will also provide a walkway from the apartments behind his property and also screening. City Manager Orman read a letter from the owner of property at 13217 Goodland (Mr. A. L. Gastman, Kansas City, Missouri). Mr. Gastman stated that he was against the zone change request. Councilman Tippitt asked, where are we going to stop commercial growth going east? Councilmen Regan and Oradat said, at Nestle Street. Councilman Oradat moved approval of the request subject to all dis- cussion, seconded by Councilman Tippitt, all voting "ayes'".* Page 89 PUBLIC HEARING - MAYLAR CORPORATION This land is located on the north side of Valwood Parkway between the Sarver Nursery and the Nazarene Church. The request is that it be changed from "R-5" Residential to Commercial under Special Permit. The City Planning and Zoning Commission has recommended that this request be denied. 1 C1 in favor of the change. Mr. R. N. Ginsberg, Attorney for Valwood Investment Company, spoke against the request for the zone change. Mr. Grady Cates also spoke against the change. Mr. Addison Bradford presented the request and asked the Council to consider the best use of the land. Mr. Stanley Hickman, President of Maylar Corporation and Mr. F. W. Rogers, Pastor of the church, spoke Councilman Oradat moved denial of the request, seconded by Councilman Hamilton, all voting "ayes". ORDINANCE NO. 396 - NEW WATER AND SEWER CHARGES The City Manager presented the ordinance and explained that it had been prepared in keeping with the recommendations approved by the Council at the last meeting. Councilman Tippitt moved passage of the ordinance, seconded by Councilman Rhodes, all voting "ayes". Caption of the ordinance; AN ORDINANCE OF THE CITY OF FARMERS BRANCH, TEXAS, FIXING THE RATES TO BE CHARGED FOR SERVICES FURNISHED BY THE WATER WORKS AND SANITARY SEWER SYSTEMS OF THE CITY OF FARMERS BRANCH- PROVIDING FOR THE PAY- MENT OF BILLS; AUTHORIZING SERVICES TO BE DISCONNECTED FOR NON-PAYMENT OF BILLS; FIXING A RECONNECTION CHARGE; PROHIBITING FREE SERVICES; PROVIDING FOR DEPOSITS; PROVIDING FOR EFFECTIVE DATE OF ORDINANCE; AND DECLARING AN EMERGENCY. RESOLUTION - FINAL PAYMENT - STREET PROJECT NO. 21. Upon a motion by Councilman Tippitt, seconded by Councilman Oradat, all voting "ayes", that a resolution be passed that on September 13, 1962 the City of Farmers Branch and the County of Dallas entered into an agreement whereby the County would improve and resurface Valley View Lane between Webb Chapel Road and the City's east city limits; the City and County agreed to share equally in the cost of the project; the project has been completed and a statement has been rendered by the County for $23,053.07; that the City Manager is hereby authorized to make payment to the County of Dallas and that payment be made from funds previously appropriated to Street Project No. 21. Page 90 ADVISORY BOARD APPOINTMENTS Planning and Zoning Commission Councilman Oradat moved, reappoint Richard L. Myers and Bill Thomas to serve until May, 1966, seconded by Council- man Rhodes, all voting "ayes". Park and Recreation Commission Councilman Oradat moved, reappoint Robert L. Reagan, appoint Nancy Acciarito and Larry Wallace to serve until May, 1966, seconded by Councilman Tippitt, all voting "ayes". Library Board Councilman Tippitt moved, reappoint Peter Geilich, appoint Vera McDaniel and Marcella Shaw to serve until May, 1965, seconded by Councilman Hamilton, all voting "ayes". RESOLUTION - APPRECIATION TO COMMISSIONERS' COURT Councilman Regan moved a resolution be written and mailed to Mr. Frank Crowley, County Commissioner, expressing the City's appreciation to the County Commissioners' Court for their cooperation with the City in the City's Library, roads and bridges; seconded and unanimously approved. DAMAGE SUIT OF MRS. M. T. BOYD City Manager Orman explained that this is the case where Mrs. Boyd injured herself when she stepped into an unlocked water meter box. Mrs. Boyd's Attorney, Mr. Jack Gay, and the City's Attorney, have agreed on a settlement of $750.00. After discussion Councilman Regan moved to deny the claim, seconded by Councilman Tippitt, all voting "ayes". PROPOSED APARTMENT DISTRICT REGULATIONS The Council members decided to present the prepared proposal to the Plan Commission for recommendations. Councilman Tippitt suggested that they consider a minimum 15 to 30 foot side yard and a maximum number of units per floor per building - 7 units per floor or 14 units, back to back. PROTEST ON STREET NAME CHANGE Mr. Clem Richardson, 14311 Josey Lane, appeared to protest the change from Josey Lane to Dennis Lane. He had previously written a letter of protest to the Council suggesting that all people concerned be notified before such a change is made (letter filed for record in City Council file). Councilman Tippitt moved, seconded by Councilman Rhodes, all voting "ayes'", that in the future all people concerned be notified before a change is made. Page 91 RESOLUTION - ZONE CHANGE REQUESTS Upon a motion by Councilman Oradat, seconded by Councilman Hamilton, all voting "ayes", a resolution was passed that only when the City Council denied a zone change request an interval of 12 months between submission of zone change requests will be required. PUBLIC HEARING ON BROOKHAVEN SHOPPING CENTER SPECIAL PERMIT Councilman Regan moved direct the Plan Commission to initiate a public hearing to determine whether or not the Special Permit Ordinance (Ordi- nance No. 269) on the Brookhaven Shopping Center should remain in effect. Councilman Tippitt moved that the Council review any special permit ordinance (other than L-M) that has not developed within twelve months of the date of passage, seconded by Councilman Regan, all voting "ayes". REPORTS FROM CITY MANAGER City Manager Orman reported; Bus Service for City A letter from Continental Bus Company giving reasons why they cannot furnish improved service in Farmers Branch. Fyke Road County is making estimate of cost to improve this road, should get this estimate soon. Valwood Parkway Extension Dr. Thompson has not signed legal instruments nor put up the $24,000. Garbage Collection Investigating possibility of garbage collection by contract. ABSENCE OF COUNCILMAN TIPPITT Councilman Tippitt announced that he will be absent from the City from May 18 through July 27. ADJOURNMENT. Dorthanna Williams, City Secretary 1 Page 92
